On February 2, 1998, the President requested $7.8 billion for the Environmental Protection Agency (EPA) in FY1999. The Senate Appropriations Committee reported S. 2168 (S.Rept. 105-216) on June 12; the full Senate passed the bill on July 17. The House Committee reported H.R. 4194 (H.Rept. 105-610) on July 8, 1998; the full House passed it on July 29; and the Senate passed it on July 30 after incorporating S. 2168's provisions. During the week of October 6, the House and Senate approved the conference report, H.Rept. 105-769, which includes $7.5 billion, thus clearing the bill for the President's signature of October 21 (P.L. 105-276). The Omnibus Appropriations Act (P.L. 105-277) added $30 million more in FY1999 funds.

The Bureau of Land Management (BLM, Department of the Interior) and the Forest Service (Department of Agriculture) manage approximately 70% of the 650 million acres of land owned by the federal government and many of these lands are classified as rangeland. Both agencies have well-established programs permitting private livestock grazing. The Administration issued new, controversial BLM rangeland management rules effective in August 1995. Supporters contended that the Administration's new rules were a step forward in sound resource management, but some believed they did not go far enough to protect rangelands and riparian areas. Many in the ranching community opposed the new rules, believing that they would ultimately reduce private livestock activity on federal lands, and increase operating costs. This report examines the debate over federal grazing management.

The year 2000 (Y2K) computer problem poses a potential threat to the continued proper functioning of many national infrastructures. These include telecommunications, utilities, financial services, health care, transportation, government services, and military preparedness. Other sectors -- such as water, agriculture, food processing and distribution, emergency services, and small and medium sized businesses -- have also been identified as having potentially significant Y2K problems but, due to space constraints, are not discussed here. While public and private sector entities report progress toward resolving their Y2K problems, much uncertainty remains regarding which systems are most vulnerable to failures. The overall impact resulting from the Y2K problem to some degree still depends on remediation progress made in 1999.

Several regions of the country have experienced natural disasters this year that have significantly reduced farm income for affected producers. The U.S. Department of Agriculture administers three major, permanently authorized programs to help mitigate the financial effects of natural disasters -- federal crop insurance, emergency disaster loans, and a noninsured assistance program. Some disaster programs are also available to help livestock producers rebuild herds or purchase feed when a disaster strikes

Section 401 of the Clean Water Act requires that an applicant for a federal license or permit provide a certification that any discharges from the facility will comply with the Act, including water quality standard requirements. Disputes have arisen over the states' exercise of authority under Section 401. Until recently, much of the debate over the Section 401 certification issue has been between states and hydropower interests. A 1994 Supreme Court decision which upheld the states' authority in this area dismayed development and hydroelectric power interest groups. The dispute between states and industry groups was a legislative issue in the 104th Congress through an amendment to a House-passed Clean Water Act re-authorization bill; the Senate did not act on that bill.

Report on the issue of specialty worker immigration, with a specific focus on the balancing act between U.S. employer needs and U.S. worker opportunities.

The 105 Congress is once again considering legislation pertaining to temporary alien workers, striving to balance the needs of U.S. employers with opportunities for U.S. workers. The largest category of these temporary alien workers are the H-1B nonimmigrants — professionals who work in specialty occupations. For the first time, the numerical limits on H-1B visas were reached prior to the end of FY1997, and the FY1998 ceiling was reached in May. Employers in “high tech” industries especially are urging Congress to eliminate the ceiling of 65,000, and legislation raising the H-1B ceiling as well as addressing other reforms has passed the Senate (S.1723).

The pending omnibus patent reform bills (S. 507 and H.R. 400) would reorganize the Patent and Trademark Office (PTO) as a government corporation and enact several other patent law reforms including early publication (with exceptions) and patent term restoration. S. 507 consists of six titles; H.R. 400 contains five titles.

It permits a limited number of small businesses and self-employment individuals to establish tax-favored medical savings accounts, increases the tax deduction for health insurance for the self-employed, and amends the Internal Revenue Code to treat private long-term care policies the way health insurance policies and health care expenses are currently treated.

The Energy Policy Act of 1992 (EPACT) increased competition in the electric generating sector by creating new entities that can generate and sell electricity at wholesale without being regulated as utilities under PUHCA. PURPA began to shift more regulatory responsibilities to the federal government, and EPACT continued that shift away from the states by creating new options for utilities and regulators to meet electricity demand.
