"Don't Ask, Don't Tell": A Legal Analysis

In recent years, several Members of Congress have expressed interest in amending "Don't Ask, Don't Tell," (DADT) a legislation that requires those of homosexual orientation in the military to keep quiet about their orientation in order to maintain "morale, good order and discipline, and unit cohesion." At least two bills that would repeal the law and replace it with a policy of nondiscrimination on the basis of sexual orientation - H.R. 1283 and S. 3065 - have been introduced in the 111th Congress. Unauthorized Alien Students, Higher Education, and In-State Tuition Rates: A Legal Analysis

Currently, federal law prohibits states from granting unauthorized aliens certain postsecondary educational benefits on the basis of state residence, unless equal benefits are made available to all U.S. citizens. This prohibition is commonly understood to apply to the granting of "in-state" residency status for tuition purposes. In the 110th Congress, several bills that would amend this federal law have been introduced. Meanwhile, some states have passed laws aimed at making unauthorized state residents eligible for in-state tuition without violating this provision. This report provides a legal overview of cases involving immigrant access to higher education, as well as an analysis of the legality of state laws that make in-state tuition rates available to illegal immigrants.

This report discusses the nature of the shortage; federal actions undertaken so far to address it; current and potential sources of helium-3 and options for increasing the supply; current and projected uses of helium-3 and options for reducing the demand; and options for allocating the supply if it continues to fall short of demand.

The United States and Russia signed a new strategic arms reduction treaty - known as New START - on April 8, 2010. This treaty is designed to replace the 1991 Strategic Arms Reductions Treaty (START), which expired, after 15 years of implementation, on December 5, 2009. This report provides an overview of New START, including a comparison to the original START Treaty, the belief of the Obama Administration and outside analysts that New START will enhance U.S. national security, and the criticisms of those who say that New START (and, indeed, the entire issue of U.S.-Russian arms control) is a distraction from more important items on the nonproliferation agenda.

Prompt global strike (PGS) would allow the United States to strike targets anywhere on earth with conventional weapons in as little as an hour. This report provides an overview of the rationale for the PGS mission and the possible deployment of conventional warheads on long-range ballistic missiles in support of this mission. It then reviews the Air Force and Navy efforts to develop these systems. It summarizes congressional reaction to these proposals, then provides a more detailed account of the issues raised by these concepts and programs.
