Campaign Finance Reform: A Legal Analysis of Issue and Express Advocacy

Issue advocacy communications have become increasingly popular in recent federal election cycles. These advertisements are often interpreted to favor or disfavor certain candidates, while also serving to inform the public about a policy issue. However, unlike communications that expressly advocate the election or defeat of a clearly identified candidate, the Supreme Court has determined that issue ads are constitutionally protected First Amendment speech that cannot be regulated in any manner. According to most lower court rulings, only speech containing express words of advocacy of election or defeat, also known as "express advocacy" or "magic words" can be regulated and therefore be subject to the requirements of the Federal Election Campaign Act (FECA). Unlike express advocacy communications, therefore, issue ads may be paid for with funds unregulated by federal law, i.e., soft money.

The shrinkage in U.S. family cash welfare rolls has slowed to a near halt, although national numbers still are 50% below those of August, 1996, when Congress created the time-limited and work-conditioned block grant program of Temporary Assistance for Needy Families (TANF). Under TANF, the nature of the caseload has changed. The share of recipients who combine welfare and work has risen sharply (from 11% to 26%).

A Free Trade Area of the Americas: Status of Negotiations and Major Policy Issues

In 1994, 34 Western Hemisphere nations met at the first Summit of the Americas, envisioning a plan for a Free Trade Area of the Americas (FTAA) by January 2005. Nine years later, the third draft text of the agreement was presented at the Miami trade ministerial held November 20-21, 2003. Deep differences remain unresolved, however, and, as reflected in the Ministerial Declaration, have taken the FTAA in a new direction. It calls for a two-tier framework comprising a set of “common rights and obligations” for all countries, augmented by voluntary plurilateral arrangements with country benefits related to commitments. A follow-up meeting in Puebla, Mexico was unable to clarify the details of this arrangement and negotiations will continue in late April 2004, when it is hoped that specific commitments will be defined. This report provides background and analysis for Congress on the proposed FTAA and will be updated.
