The Congressional Budget Act of 1974 created a process that Congress uses each year to establish and enforce the parameters for budgetary legislation. This report summarizes points of order under the Congressional Budget Act of 1974, as amended, as well as related points of order established in the budget resolutions adopted by Congress in 2007 and 2008, the Rules of the House for the 110th Congress, and the Budget Enforcement Act of 1990. In addition, it describes how points of order are applied and the processes used for their waiver in the House and Senate.

The Defense Production Act (DPA) was created at the outset of the Korean War to ensure the availability of the nation's industrial resources to meet the national security needs of the United States by granting the President powers to ensure the supply and timely delivery of products, materials, and services to military and civilian agencies. The DPA codifies a robust legal authority given the president to force industry to give priority to national security production and is the statutory underpinning of governmental review of foreign investment in U.S. companies. Since its enactment in 1950, the DPA has been time-limited, undergoing periodic amendment and reauthorization. In 2003, Congress reauthorized the DPA through September 30, 2008.

No firms have been sanctioned under the Iran Sanctions Act (ISA), and a GAO study in December 2007 said that the effects of ISA and other U.S. sanctions on Iran's economy are "difficult to determine." However, with Iran under increasing U.N. and other diplomatic pressure, many foreign firms now seem hesitant to finalize investment deals with Iran. In the 110th Congress, several bills, including the House-passed H.R. 1400 would add ISA provisions.

The National Aeronautics and Space Administration (NASA) estimates that without a servicing mission to replace key components, the Hubble Space Telescope will cease scientific operations in 2008. In January 2004, then-NASA Administrator Sean O'Keefe announced that the space shuttle would no longer be used to service Hubble. Hubble supporters criticized this as a result of President Bush's new Vision for Space Exploration; said supporters sought to reverse the decision and proceed with a shuttle servicing mission. In October 2006, NASA approved a shuttle mission to service Hubble. That mission is now scheduled for October 8, 2008.

The central government's limited writ and perceived corruption are helping sustain a Taliban insurgency and painting President Hamid Karzai as a weak leader. However, ethnic disputes have been confined to political debate and competition, enabling Karzai to focus on reversing the security deterioration and on his re-election bid in the fall of 2009. The Kurdish-inhabited region of northern Iraq is relatively peaceful and prospering economically, but the Iraqi Kurds' political autonomy and political strength in post- Saddam Iraq is causing friction with Arab leaders in Iraq, Turkey, and Iran. However, an overall reduction in violence in Iraq, coupled with continued U.S. political influence over the Kurds, is likely to prevent a destabilizing escalation of the Iraqi Kurd-Arab disputes. In its FY2007, FY2008, and FY2009 budget submissions, the Department of Defense (DOD) proposed increases in Tricare enrollment fees, deductibles, and pharmacy co-payments for retired beneficiaries not yet eligible for Medicare. In passing the FY2009 National Defense Authorization Act, Congress included measures establishing demonstration projects intended to find ways to contain costs through increased use of preventive care services by TRICARE beneficiaries. The scope of these measures are limited. Defense health care spending will likely remain an issue for the DOD in the next Administration, and Congress can anticipate being asked to consider new proposals to constrain costs.

Bisphenol A (BPA) is used to produce certain types of plastic. Containers made of these plastics may expose people to small amounts of BPA in food and water. Some animal experiments have found that fetal and infant development may be harmed by small amounts of BPA, but scientists disagree about the value of the animal studies for predicting harmful effects in people. This report discusses this issue and relevant legislation, as well as inquiries into studies currently underway to determine the true harm inherent in BPA and the degree to which people are regularly exposed to BPA.

Since the invasion of Iraq in 2003, the average price of fuels purchased for military operations in Iraq has steadily increased. The disparity between the higher price of fuel supplied to the United States Central Command compared to Iraq's civilian population has been a point of contention. Several factors contribute to the disparity, including the different types of fuel used by the military compared to Iraqi civilians, the Iraqi government's price subsidies, and the level pricing that the DOD's Defense Logistics Agency charges for military customers around the world. The Iraqi government has been pressured to reduce its fuel subsidy and black market fuel prices remain higher than the official subsidized price.

In response to ongoing financial turmoil that began in the subprime mortgage-backed securities market, the federal government has intervened with private corporations on a large scale and in an ad hoc manner three times from the beginning of 2008 through September 19, 2008. These interventions have prompted questions regarding the taxpayer costs and the sources of funding. The federal government may or may not end up seeing a positive fiscal contribution from the recent interventions. The results of previous government financial interventions are summarized in this report.

The increased presence of foreign students in graduate science and engineering programs and in the scientific workforce has been and continues to be of concern to some in the scientific community. Enrollment of U.S. citizens in graduate science and engineering programs has not kept pace with that of foreign students in those programs. Many in the scientific community maintain that in order to compete with countries that are rapidly expanding their scientific and technological capabilities, the country needs to bring to the United States those whose skills will benefit society and will enable us to compete in the new-technology based global economy. This report analyzes this issue in detail and includes discussion of related legislation.

The FY2008 Consolidated Appropriations Act (P.L. 110-161) maintains SSBG funding at $1.7 billion and maintains states' authority to transfer up to 10% of their Temporary Assistance for Needy Families (TANF) block grants to the SSBG. The $1.7 billion in regular funds mirrors funding included in both the FY2007 and FY2006 laws, but exceeds the $1.2 billion that the President proposed for FY2008, and most recently, for FY2009. The FY2009 budget also includes a proposal to eliminate the SSBG in FY2010. This report provides SSBG background information and tracks relevant legislation and appropriations measures.

This document provides a U.S.-centric chronology of the international policy negotiations to address climate change. It covers the United Nations Framework Convention on Climate Change in 1992, the Kyoto Protocol in 1997, the Marrakesh Accords of 2001, and the Bali Action Plan of 2007 that mandates the current negotiations toward a new agreement by the end of 2009 on commitments for the period beyond 2012. Today's negotiations under the Bali Action Plan focus on four elements: mitigation of greenhouse gas emissions; adaptation to impacts of climate change; financial assistance to low income countries; and technology development and transfer. For U.S. legislators, important issues include the compatibility of any international agreement with U.S. domestic policies and laws; the adequacy of appropriations, fiscal measures and programs to achieve any commitments under the agreement; and the desirable form of the agreement and related requirements for potential Senate ratification and federal implementing legislation.
