Since the Deepwater Horizon oil spill began on April 20, 2010, Congress has given much attention to the compensatory liability provisions of the Oil Pollution Act and, to a lesser extent, those of the Jones Act and the Death on the High Seas Act. However, federal laws possibly relevant to the oil spill also impose civil and criminal money penalties, which may reach dollar amounts in connection with the Gulf spill greater than those for compensatory liability. This report summarizes selected federal civil and criminal penalty provisions that may be found violated in connection with the Gulf spill and related worker fatalities.

Organized Retail Crime

This report provides an overview of organized retail crime rings, their operations, and goods targeted. It then examines the domestic impact of organized retail crime (ORC) in the arenas of the economy, public health and safety, and domestic security. The report also outlines current efforts by retailers, resale markets, and the federal government to combat ORC. It then analyzes various policy issues that the 111th Congress may wish to consider, including whether current federal resources provided for the investigation of ORC are adequate, whether to amend the U.S. Code to criminalize ORC, and whether to regulate resale marketplaces that may be utilized as fences for criminals to sell stolen goods.

World Trade Organization (WTO): Issues in the Debate on Continued U.S. Participation

Following World War II, the United States led efforts to establish an open and nondiscriminatory trading system with the expressed goal of raising the economic well-being of all countries and bolstering world peace. These efforts culminated in the creation of the General Agreement on Tariffs and Trade (GATT) in 1948, a provisional agreement on tariffs and trade rules that governed world trade for 47 years. The World Trade Organization (WTO) succeeded the GATT in 1995 and today serves as a permanent body that administers the rules and agreements negotiated and signed by 153 participating parties, as well as a forum for dispute settlement and negotiations. The purpose of this report is to analyze some of the main issues in any debate on U.S. participation in the WTO and to address some of the criticisms leveled at the organization. Academic studies indicate that the United States benefits from broad reductions in trade barriers worldwide, but some workers and industries might not share in those gains. Decisions in the WTO are made by member governments, which determine their negotiating positions, file dispute challenges, and implement their decisions. Debarment and Suspension of Government Contractors: An Overview of the Law Including Recently Enacted and Proposed Amendments

As a general rule, government agencies contract with the lowest qualified responsible bidder or offeror. Debarment and suspension are among the techniques that government agencies use to ensure that they contract with only "responsible" bidders or offerors because they allow the government to exclude contractors from receiving government contracts. This report focuses upon exclusions on procurement grounds.2 It surveys the authorities requiring or allowing federal agencies to debar or suspend contractors, due process and other protections for contractors, and recently enacted and proposed amendments to the laws governing debarment and suspension.

The Navy's proposed FY2012 budget requests funding for the procurement of four LCSs. Current issues for Congress concerning the LCS program include changes or potential changes to the composition of LCS mission modules announced by the Navy in January 2011, the combat survivability of the LCS, and hull cracking on LCS-1.
