In the United States, the general rule, which derives from common law, is that each side in a legal proceeding pays for its own attorney. There are many exceptions, however, in which federal courts, and occasionally federal agencies, may order the losing party to pay the attorneys’ fees of the prevailing party. The major common law exception authorizes federal courts (not agencies) to order a losing party that acts in bad faith to pay the prevailing party’s fees. This report discusses the Equal Access to Justice Act (EAJA), which makes the United States liable for attorneys’ fees of up to $125 per hour in many court cases and administrative proceedings that it loses (and some that it wins) and fails to prove that its position was substantially justified.

This report describes the various death benefits from the Department of Defense, Department of Veterans Affairs (VA), and Social Security available to certain survivors of members of the Armed Forces who die on active duty.

This report discusses the recent controversy that has arisen regarding U.S. treatment of enemy combatants and terrorist suspects detained in Iraq, Afghanistan, and other locations, and whether such treatment complies with U.S. statutes and treaties such as the U.N. Convention Against Torture and Other Forms of Cruel and Inhuman or Degrading Treatment or Punishment (CAT). Congress recently approved additional guidelines concerning the treatment of detainees. The Department of Defense, Emergency Supplemental Appropriations to Address Hurricanes in the Gulf of Mexico, and Pandemic Influenza Act, 2006 (P.L. 109- 148), and the National Defense Authorization Act for FY2006 (P.L. 109-163) contain identical provisions that (1) require Department of Defense (DOD) personnel to employ United States Army Field Manual guidelines while interrogating detainees, and (2) prohibit the “cruel, inhuman and degrading treatment or punishment of persons under the detention, custody, or control of the United States Government.” These provisions, added to the defense appropriations and authorization bills via amendments introduced by Senator John McCain, have popularly been referred to as “the McCain amendment.” This report discusses the McCain amendment, as modified and subsequently enacted into law.

Instead of a single comprehensive federal wetland protection law, multiple laws provide varying levels of protection in different forms: the permit program authorized in §404 in the Clean Water Act; programs for agricultural wetlands; laws that protect specific sites; and laws that protect wetlands which perform certain functions. Many protection advocates view these laws and their implementation as inadequate or uncoordinated. Others, who advocate the rights of property owners and development interests, by contrast, characterize these efforts, especially the §404 permit program, as too intrusive. Numerous state and local wetland programs add to the complexity of the protection effort.

Facilities handling large amounts of potentially hazardous chemical (i.e., chemical facilities) might be of interest to terrorists, either as targets for direct attacks meant to release chemicals into the community or as a source of chemicals for use elsewhere. For any individual facility, the risk is very small, but the risks may be increasing -- with potentially severe consequences for human health and the environment. Congress might choose to rely on existing efforts in the public and private sectors to improve chemical site security over time. Alternatively, Congress could expand existing environmental planning requirements for chemical facilities to require consideration of terrorism. Congress might also enact legislation to reduce risks, either by "hardening" defenses against terrorists or by requiring industries to consider use of safer chemicals, procedures, or processes.

This report reviews the status of energy efficiency and renewable energy legislation introduced during the 109th Congress. Action in the second session has focused on appropriations bills; the first session focused on omnibus energy policy bill H.R. 6 and several appropriations bills. this report describes several major pieces of legislation, including the Energy Policy Act of 2005 and the Transportation Equity Act. For each bill listed in this report, a brief description and a summary of action are given, including references to committee hearings and reports. Also, a selected list of hearings on renewable energy is included.

Several sections of the USA PATRIOT Act and one section of the Intelligence Reform and Terrorism Prevention Act of 2004 were originally scheduled to expire on December 31, 2005. In July 2005, both Houses approved USA PATRIOT reauthorization acts, H.R. 3199 and S. 1389, and the conference committee filed a report, H.Rept. 109-333. A separate bill, the USA PATRIOT Act Additional Reauthorizing Amendments Act of 2006 (S. 2271), provided civil liberties safeguards not included in the conference report. Both H.R. 3199 and S. 2271 were signed into law (P.L. 109-177 and P.L. 109-178) by the President on March 9, 2006.

The House passed its version of the FY2007 defense authorization bill, H.R. 5122, on May 11. The bill authorizes $513 billion for national defense, including $50 billion in emergency funding for operations in Iraq and elsewhere in the first months of the fiscal year. The Senate Armed Services Committee marked up its version of the bill, S. 2766, on May 4. It also authorizes $513 billion, including emergency funding. Senate floor action appears likely in June. House subcommittee markup of the defense appropriations bill is tentatively scheduled for June 7.

This report is an overview of the major training activities and facilities of the federal departments and agencies that provide counter-terrorism training. It identifies some of the issues associated with the training, including the possible duplication of federal counter-terrorism training programs; determination of Department of Homeland Security counterterrorism training priorities; and possible redundancy and coordination of DHS counter-terrorism training programs.

This report discusses Iraqi Oil in the post-Saddam period. Iraq’s potential oil wealth remains largely unrealized. Substantial proven reserves exist, and there are likely more resources awaiting discovery. But oil production has been slow to fully recover and many obstacles stand in the way of achieving a stable export flow.

The powerful earthquake struck northern Pakistan and India damaged the homes of as many as three million people, forcing many of them to search for alternative means of shelter. The full extent of the destruction remains unknown because government authorities and relief organizations continue to have difficulty accessing some remote locations. As of the date of this report, the United States government (USG) has pledged $410 million toward the relief effort, almost all of it to assisting Pakistan, which remains a key U.S. ally in the war against terror. So far, about 35% of this pledge has been committed. Some aid agencies are saying that the country needs a great deal more aid than it is getting, and warn that the economic impact of the disaster will surpass $5.2 billion. This burden may contribute toward long-term instability in an area perceived to be of critical importance to the United States in the war on terror.
