Department of Energy: Further Actions Are Needed to Improve DOE's Ability to Evaluate and Implement the Loan Guarantee Program

A letter report issued by the Government Accountability Office with an abstract that begins "Since the Department of Energy's (DOE) loan guarantee program (LGP) for innovative energy projects was established in Title XVII of the Energy Policy Act of 2005, its scope has expanded both in the types of projects it can support and in the amount of loan guarantee authority available. DOE currently has loan guarantee authority estimated at about $77 billion and is seeking additional authority. As of April 2010, it had issued one loan guarantee for $535 million and made nine conditional commitments. In response to Congress' mandate to review DOE's execution of the LGP, GAO assessed (1) the extent to which DOE has identified what it intends to achieve through the LGP and is positioned to evaluate progress and (2) how DOE has implemented the program for applicants. GAO analyzed relevant legislation, prior GAO work, and DOE guidance and regulations. GAO also interviewed DOE officials, LGP applicants, and trade association representatives."

Correspondence issued by the Government Accountability Office with an abstract that begins "The Defense Manpower Data Center (DMDC) conducts a series of Web-based surveys called Status of Forces surveys, which help enable decision makers within the Department of Defense (DOD) to (1) evaluate existing programs and policies, (2) establish baselines before implementing new programs and policies, and (3) monitor the progress of programs and policies and their effects on the total force. In recent years, we have discussed the results of these surveys in several of our reports. While we have generally found the survey results to be sufficiently reliable for the purposes of our reporting, several of our reports have discussed low response rates and the potential for bias in the survey results. Nonresponse analysis is an established practice in survey research that helps determine whether nonresponse bias (i.e., survey results that do not accurately reflect the population) might occur due to under- or overrepresentation of some respondents' views on survey questions. When nonresponse analysis is performed, survey researchers can use the results to select and adjust the statistical weighting techniques they use that help ensure that survey results accurately reflect the survey population. A letter report issued by the Government Accountability Office with an abstract that begins "Annual revenues into the Assets Forfeiture Fund (AFF) from forfeited assets increased from $500 million in 2003 to $1.8 billion in 2011, in part due to an increase in prosecutions of fraud and financial crimes cases. Expenditures in support of forfeiture activities such as equitable sharing payments to state and local law enforcement agencies and payments to victims also increased over the same 9-year period, growing from $458 million in 2003 to $1.3 billion in 2011. The Department of Justice (DOJ) uses the difference between revenues and expenditures in any year to help cover anticipated expenses in the next fiscal year. Because the AFF uses fund revenues to pay for the expenses associated with forfeiture activities, DOJ carries over funds at the end of each fiscal year to ensure it has sufficient resources to cover expenses that may not be covered by the next year’s revenues. A letter report issued by the Government Accountability Office with an abstract that begins "The Director of National Intelligence (DNI), as Security Executive Agent, has not provided agencies clearly defined policy and procedures to consistently determine if a position requires a security clearance. Executive Order 13467 assigns DNI responsibility for, among other things, developing uniform and consistent policies to determine eligibility for access to classified information, and gives the DNI authority to issue guidance to agency heads to ensure uniformity in processes relating to those determinations. In the absence of this guidance, agencies are using an Office of Personnel Management (OPM) tool that OPM designed to determine the sensitivity and risk levels of civilian positions which, in turn, inform the type of investigation needed. OPM audits, however, found inconsistency in these position designations, and some agencies described problems in implementing OPM’s tool. In an April 2012 audit, OPM reviewed the sensitivity levels of 39 positions in an agency within the Department of Defense (DOD) and reached different conclusions than the agency for 26 of them. NASA Needs to Better Assess Contract Termination Liability Risks and Ensure Consistency in Its Practices

Correspondence issued by the Government Accountability Office with an abstract that begins "The National Aeronautics and Space Administration (NASA) procures most of its goods and services through contracts, and it terminates very few of them. In fiscal year 2010, for example, NASA's procurements, ranging from small contracts for human resources consulting services to multimillion dollar contracts to build and operate spacecraft, totaled approximately $17.4 billion, representing about 83.4 percent of the agency's obligations that year. That same year, it terminated 28 of 16,343 active contracts and orders--a termination rate of about .17 percent. This rate is about the same--less than 0.2 percent--for each of the past 5 fiscal years. NASA contract terminations--the complete or partial cancellation of work under a contract before the contract's period of performance ends--are rare but could become more common in the future. The federal government is facing real fiscal limitations and will have to make difficult choices about upcoming priorities. This reality makes it more important than ever that NASA manage its projects as efficiently and effectively as possible and within its budget. This is a struggle for NASA. Under OLA, the Federal Deposit Insurance Corporation (FDIC) could serve as receiver of a failing financial company instead of the company entering the bankruptcy process. Regulators continue to address a number of issues related to FDIC’s new authority, including how creditors will ensure that they receive no less than they would under a Chapter 7 bankruptcy liquidation; how certain assets and liabilities would be treated in a new company created by FDIC under OLA; and what role the Securities Investor Protection Corporation would play in the resolution of a broker-dealer under OLA. A letter report issued by the Government Accountability Office with an abstract that begins "The Federal Buildings Fund’s (FBF) balance has increased from $56 million in fiscal year 2007 to $2.2 billion in fiscal year 2012 primarily due to the growing difference between the resources provided to the FBF and the General Services Administration’s (GSA) use of these funds as determined through the budgeting and appropriations process. In the last 2 years, Congress has provided fewer resources than requested by the executive branch and generated by the FBF. Office of Management and Budget (OMB) staff and GSA officials stated that if GSA were able to spend all of the funds collected by the FBF each year, these funds would generally be sufficient to fund GSA’s needs. However, GSA, through the annual President’s Budget Request, has sought less obligational authority than the balance available in the fund. While the FBF’s balance has increased, various factors have limited the fund’s income. Specifically, USDA certified 5 of the 18 commodities for which it received petitions. As of April 2012, USDA approved 9,852, or about 90 percent, of the applicants who produced a certified commodity to participate in the program. Testimony issued by the Government Accountability Office with an abstract that begins "We identified four categories of assistance U.S. agencies have provided: (1) counter-IED training and equipment, (2) a counter-IED public awareness campaign, (3) training of border officials, and (4) legal assistance for laws and regulations to counter IEDs and IED precursors. We found that each agency providing counter-IED assistance to Pakistan performs a unique role based on its specialized knowledge and expertise. DHS, for example, takes primary responsibility for border management and customs investigation training. DHS conducts joint regional training and operational exercises for both Pakistani and Afghan border officials, including international border interdiction training and cross-border financial investigation training. DHS also plays a lead role in Program Global Shield to foster cross-border cooperation and initiate complementary border management and customs operations. According to DHS, the main goals of Program Global Shield are (1) to identify and interdict falsely declared explosive precursor chemicals, (2) to initiate investigations of smuggled or illegally diverted IED materials, and (3) to uncover smuggling and procurement networks that foster illicit trade."

Testimony issued by the Government Accountability Office with an abstract that begins "This testimony discusses highlights of GAO's report on the Environmental Protection Agency's (EPA) implementation of requirements for determining whether additional drinking water contaminants warrant regulation. The number of potential drinking water contaminants is vast--as many as tens of thousands of chemicals may be used across the country, and EPA has identified more than 6,000 chemicals that it considers to be the most likely source of human or environmental exposure. The potential health effects of exposure to most of these chemicals, and the extent of their occurrence in drinking water, are unknown. Under 1996 amendments to the Safe Drinking Water Act, every 5 years EPA is to determine for at least five contaminants whether regulation is warranted, considering those that present the greatest public health concern. EPA issued final regulatory determinations in 2003 and 2008 on a total of 20 contaminants, deciding in each case not to regulate. EPA did not recommend any new contaminants for regulation until February 2011, when it reversed its controversial 2008 preliminary decision to not regulate perchlorate, an ingredient in rocket fuel and other products. CMS is responsible for administering the Medicare and Medicaid programs and leading efforts to reduce improper payments of claims for medical treatment, services, and equipment. Improper payments are overpayments or underpayments that should not have been made or were made in an incorrect amount; they may be due to errors, such as the inadvertent submission of duplicate claims for the same service, or misconduct, such as fraud or abuse. The Department of Health and Human Services reported about $70 billion in improper payments in the Medicare and Medicaid programs in fiscal year 2010. Every year, children in the United States die after being physically abused, severely neglected, or otherwise maltreated, frequently at the hands of their parents or others who are entrusted with their care. Infants and toddlers are the most vulnerable to such abuse and neglect. According to estimates by the National Child Abuse and Neglect Data System (NCANDS), 1,770 children in the United States died from physical abuse or other forms of maltreatment in fiscal year 2009. Some experts believe that more children have died from maltreatment than are captured in this estimate and that there are inconsistencies and limitations in the data that states collect and report to NCANDS. In addition, many more children are severely harmed and may nearly die from maltreatment, but NCANDS does not collect data specifically on near-fatalities. The Department of Health and Human Services (HHS) maintains NCANDS, which is a voluntary state data-reporting system. The Dodd-Frank Wall Street Reform and Consumer Protection Act required GAO to examine the movement of former SEC employees to regulated firms and the associated concerns. Engineering the Electronic Band Structure for Multiband Solar Cells

Using the unique features of the electronic band structure of GaNxAs1-x alloys, we have designed, fabricated and tested a multiband photovoltaic device. The device demonstrates an optical activity of three energy bands that absorb, and convert into electrical current, the crucial part of the solar spectrum. The performance of the device and measurements of electroluminescence, quantum efficiency and photomodulated reflectivity are analyzed in terms of the Band Anticrossing model of the electronic structure of highly mismatched alloys. The results demonstrate the feasibility of using highly mismatched alloys to engineer the semiconductor energy band structure for specific device applications.

ASSESSMENT OF THE POTENTIAL FOR HYDROGEN GENERATION DURING GROUTING OPERATIONS IN C-REACTOR DISASSEMBLY BASIN

C-reactor disassembly basin is being prepared for deactivation and decommissioning (D and D). D and D activities will consist primarily of immobilizing contaminated scrap components and structures in a grout-like formulation. The disassembly basin will be the first area of the C-reactor building that will be immobilized. The scrap components contain aluminum alloy materials. Any aluminum will corrode very rapidly when it comes in contact with the very alkaline grout (pH > 13), and as a result would produce hydrogen gas. To address this potential deflagration/explosion hazard, Savannah River National Laboratory (SRNL) reviewed and evaluated existing experimental and analytical studies of this issue to determine if any process constraints are necessary. The risk of accumulation of a flammable mixture of hydrogen above the surface of the water during the injection of grout into the C-reactor disassembly area is low if the assessment of the aluminum surface area is reliable. Conservative calculations estimate that there is insufficient aluminum present in the basin areas to result in significant hydrogen accumulation in this local region. The minimum safety margin (or factor) on a 60% LFL criterion for a local region of the basin (i.e., Horizontal Tube Storage) was greater than 3. Calculations also …
