This report examines Justice O'Connor's notable opinions on abortion, and explores her role in the development of the undue burden standard, adopted in 1992. Under the new standard, a reviewing court would consider whether an abortion restriction has the effect of imposing an "undue burden" on a woman's right to obtain an abortion.

The dietary supplement industry has long been concerned about international activities that could have a potential impact on supplement trade. As originally proposed, FDA reform legislation contained provisions on mutual agreements and global harmonization that would have applied to most products under FDA jurisdiction. However, Congress explicitly exempted supplements from the final provisions of the Food and Drug Administration Modernization Act of 1997 (P.L. 105-115), which means that these products are not part of on-going trade discussions.

The Exon-Florio National Security Test for Foreign Investment

The proposed acquisition of major operations in six major U.S. ports by Dubai Ports World and of Unocal by the China National Offshore Oil Corporation sparked intense concerns among some Members of Congress and the public and has reignited the debate over what role foreign acquisitions play in U.S. national security. The United States actively promotes internationally the national treatment of foreign firms. Several Members of Congress have introduced various measures during the 2nd Session of the 109th Congress that can be grouped into four major areas: those that deal specifically with the proposed Dubai Ports World acquisition; those that focus more generally on foreign ownership of U.S. ports; those that would amend the CFIUS process; and those that would amend the Exon-Florio process.

There has also been a major change in the top government personnel, with the former Chief Executive, Tung Chee-Hwa, being replaced by Donald Tsang as the new Chief Executive of Hong Kong. The next major the issue to be addressed in Hong Kong is the pace of further democratization and the the extent to which the next elections for the Legislative Counsel will be based on direct elections of all seats or a larger portion thereof.

Wetland Issues (open access)

Wetland Issues

Wetlands, in a wide variety of forms, are found throughout the country. The various values of these areas have been increasingly recognized in recent years, but the remaining acreage has been disappearing rapidly. When European settlers first arrived, total wetland acreage was more than 220 million acres in the lower 48 states, according to estimates by the U.S. Fish and Wildlife Service. By 1980, total wetland acreage was estimated to be 104 million acres. Losses continue, although the rate of loss hasslowed considerably during the past decade. Recent losses have been concentrated in the lower Mississippi River Valley, the upper Midwest, and the Southeast.
