Compendium of Precedents Involving Evidentiary Rulings and Applications of Evidentiary Principles from Selected Impeachment Trials

At the present time, there are no binding rules of evidence or set of evidentiary principles to be applied in Senate impeachment trials. Rather, recourse is taken to the evidentiary rules and principles applicable in contemporaneous court proceedings and to precedents from past impeachment trial to provide guidance for Senate Impeachment Trial Committees or for the full Senate on evidentiary questions which arise in the impeachment context. This report compiles evidentiary precedents from the Senate impeachment trials of Judges Harry E. Claiborne, Halsted Ritter, Harold Louderback, and Charles Swayne. The evidentiary rulings and principles gleaned from this examination are arranged in subject matter categories, and within those categories, in reverse chronological order by trial.

Molten-caustic-leaching (Gravimelt) system integration project. Quarterly report, April--June 1989

Operation of the Gravimelt Integrated Test Circuit for desulfurization and demineralization of coal has been completed. A 48-test process matrix was performed over 750 hours of operational time resulting in production of 3,000 pounds of treated coal suitable for further test and evaluation. Optimization testing was performed resulting in product coal containing 0.4 percent sulfur (0.6 lbs SO{sub 2}/MMBtu) and 0.15 percent ash with more than 85 percent organic sulfur removal, 95 percent SO{sub 2} reduction from ROM coal and 91 percent SO{sub 2} reduction from precleaned process feed. This report contains all of the product sulfur, ash, volatiles and heat content data obtained to date.

Basis for in-situ geomechanical testing at the Yucca Mountain site

This report presents an analysis of the in-situ geomechanical testing needs for the Exploratory Shaft (ES) test facility at the Yucca Mountain site in Nevada. The testing needs are derived from 10CFR60 regulations and simple thermomechanical canister- and room-scale numerical studies. The testing approach suggested is based on an ``iterative`` procedure of full-scale testing combined with numerical and empirical modeling. The testing suggested is based heavily on demonstration of excavation and thermal loading of full-scale repository excavations. Numerical and/or empirical models are compared to the full-scale response, allowing for adjustment of the model and evaluation of confidence in their predictive ability. Additional testing may be specified if confidence in prediction of the rock mass response is low. It is suggested that extensive drifting be conducted within the proposed repository area, including exploration of the bounding Drill Hole Wash and Imbricate fault structures, as well as the Ghost Dance fault. This approach is opposed to an a priori statistical specification of a number of ``point`` tests which attempt to measure a given property at a specific location. 40 refs., 49 figs., 6 tabs.

Program status 3. quarter -- FY 1989: Fusion technology development

The cold support concept for the ARIES TF coil design was developed further. This concept not only works for aspect ratio 6 and 4.5 machines, but it also works for ITER. Beryllium was added to the two blanket concepts to improve energy multiplication and reduce COE. During the quarter a US-Japan steering committee meeting was held to discuss the US-Japan ICRH tube tests. They reviewed and approved the proposed X2242 ICRH tube improvements. Ed Cheng attended IAEA meeting on the International Fusion Evaluated Nuclear Data Library (FENDL). The first version of FENDL should be ready for use by mid-1990. Exposure of 12 well-characterized graphite tiles in the divertor region of DIII-D continues. Work has been initiated on the laser ellipsometry technique to be used for in situ on-line measurement of erosion and redeposition in the DIII-D divertor. A Neutron Interaction materials (NIM) report has been drafted compiling published and unpublished data on manganese-stabilized austenitic steels. These steels are being considered for the ITER.

An evaluation of the suitability of laser-induced fluorescence for measurements of fission-product iodine sorptivity in the MHTGR [modular high-temperature gas-cooled reactor]

Experiments and calculations indicate that laser-induced fluorescence (LIF) lacks the sensitivity needed for sorptivity measurements of I{sub 2} or other molecular species at partial pressures below 10{sup {minus}11} atm. Although the technique may have sufficient sensitivity for measurements of atomic species, the species of interest are, in all likelihood, not atomic. Methods of measurement which would allow the determination of species are proposed. 9 refs., 6 figs.

The mutagenic potential of bis 2-chloroethyl sulfide (HD} a bifunctional sulfur mustard was evaluated in the standard plate incorporation version and the preincubation modification of the Salmonella/microsomal assay with tester strains TA97, TA98, TA100 and TA102, with and without 59 activation. HD-induced point mutations in strain TA102 and frameshift mutations in TA97 but showed little or no mutagenicity against strains TA98 and TA100. Extensive HD-induced cell killing was observed with the excision repair deficient strains (TA100, TA98 and TA97) but not with strain TA102, which is wild-activation by Aroc1or induced rat liver microsomes (S9).

The mutagenic potential of lewisite was evaluated in the standard plate incorporation method and by the preincubation modification of the Ames Salmonella/microsomal assay with tester strains TA97, TA98, TAlOO and TA102. All strains were tested with activation (20 and 50 {micro}l/ plate) and without activation. The lewisite was screened initially for toxicity with TA98 over a range of concentrations from 0.01 to 250 {micro}g of material per plate. However, concentrations selected for mutagenicity testing were adjusted to a range of 0.001 to 5 {micro}g/plate because of the sensitivity of tester strain TA102, which exhibited cytotoxicity at 0.01 ug/plate. No mutagenic response was exhibited by any of the strains in either method used. All other tester strains showed evidence of cytoxicity (reduction in mutagen response or sparse background lawn) at 5.0 {micro}g/plate or lower.

Toxicology Studies on Lewisite and Sulfur Mustard Agents: Two-Generation Reproduction Study of Lewisite in Rats Final Report

Occupational health standards have not been established for Lewisite [bis(2-chlorethyl)arsine], a potent toxic vesicant which reacts with the sulfhydryl groups of proteins through its arsenic group. The purposes of this study were to determine the reproductive consequences and dose~response of continuing Lewisite exposure of parental males and females and their offspring in a 42-week two-generation study. Solutions of Lewisite were prepared for administration by diluting the neat agent with sesame oil. Rats were administered Lewisite (0, 0.10, 0.25 or 0.60 mg/kg/day for 5 days a week) via intragastric intubation prior to mating, during mating and after mating until the birth of their offspring. The dams continued to receive Lewisite during lactation. At weaning, male and female offspring of each group were selected to continue on the study; rece1v1ng Lewisite during adolescence, mating and throughout gestation. Again, the dams continued to receive Lewisite until weaning of the offspring. Lewisite had no adverse effect on reproduction performance, fertility or reproductive organ weights of male or female rats through two consecutive generations. No adverse effect to offspring were attributed to Lewisite exposure. Minor changes in growth was the only maternal effect observed. Lewisite exposure of parental rats caused no gross or microscopic lesions …
