Environmental Protection Issues in the 108th Congress

The 108th Congress has acted on a variety of disparate environmental measures; some of these represent proposals or issues that had been under consideration in the 107th Congress and earlier. Environmental issues considered by Congress tend to fall into several major categories: (1) funding issues — whether funding levels are adequate and focused on appropriate priorities; (2) expanding, renewing, or refocusing specific environment programs; (3) environmental issues that are important “subsets” of other major areas of concern, such as energy, defense, or transportation programs; and more recently, (4) terrorism and infrastructure protection in areas such as wastewater and chemical facilities.

Campaign Activity by Churches: Legal Analysis of Houses of Worship Free Speech Restoration Act, H.R. 235 (108th Congress)

Churches and other Internal Revenue Code (IRC) Section 501(c)(3) tax-exempt organizations can lose their tax-exempt status if they participate in a political campaign. The Houses of Worship Free Speech Restoration Act, H.R. 235 (108th Congress) would permit churches to engage in limited types of political campaign activity, in unlimited amounts, without jeopardizing their tax-exempt status. This report provides an overview of current tax and campaign finance law relevant to this legislation, a discussion of how H.R. 235 (108th Congress) would amend current law, and a comparison of H.R. 235 (108th Congress) to H.R. 2357 (107th Congress).

The Electoral College: Reform Proposals in the 108th Congress

American voters elect the President and Vice President of the United States under a complex arrangement of constitutional provisions, federal and state laws, and political party practices known as the electoral college system. Despite occasional close elections, this system has delivered uncontested results in 46 of 50 elections since adoption of the 12th Amendment, effective in 1804. Throughout this period, nevertheless, it has been the subject of persistent criticism and many reform proposals. Related measures fall into two basic categories: those that would eliminate the electoral college and substitute direct popular election of the President and Vice President, and those that would retain the existing system in some form and correct perceived defects.
