Charitable Choice, Faith-Based Initiatives, and TANF

The 108th Congress has resumed efforts to pass tax incentives for private giving (S. 476, passed by the Senate on April 9, and H.R. 7, introduced May 7, 2003). However, these bills do not contain provisions intended to promote religious organizations as providers of federally funded social services – charitable choice provisions.. The House voted in 2001 to extend charitable choice rules, which now apply to a limited set of programs, to numerous new programs (H.R. 7 in the 107th Congress), as the President urged, but the Senate refused. However, in an Executive Order, President Bush on December 12, 2002, directed six cabinet-level departments and the Agency for International Development (AID) to bring policies concerning social service programs into line with charitable choice principles set forth in the Order.

On April 10, 2003, the House passed comprehensive energy legislation, H.R. 6 (247- 175). The bill was a composite of four measures – H.R. 39, reported from the House Committee on Resources, H.R. 238, marked up by the House Science Committee, H.R. 1531, reported from Ways and Means, and an unnumbered bill reported out of the Energy and Commerce Committee. Unlike comprehensive energy legislation (H.R. 4) debated in the 107th Congress, H.R. 6 includes a section on electricity which has stirred some controversy. H.R. 6 would provide authorization for exploration and development of the Arctic National Wildlife Refuge (ANWR).

Invoking Cloture in the Senate

This report discuses cloture, which is is the only procedure by which the Senate can vote to set an end to a debate without also rejecting the bill, amendment, conference report, motion, or other matter it has been debating. A Senator can make a nondebatable motion to table an amendment, and if a majority of the Senate votes for that motion, the effect is to reject the amendment. Thus, the motion to table cannot be used to conclude a debate when Senators still wish to speak and to enable the Senate to vote for the proposal it is considering. Only the cloture provisions of Rule XXII achieve this purpose.
