On May 2, 2003, the U.S. District Court for the District of Columbia issued its decision in McConnell v. FEC, striking down many key provisions of the law. This report provides a brief overview of the court’s decision and will be updated. The three-judge panel, which was split 2 to 1 on many issues, ordered that its ruling take effect immediately. Since the court has issued its opinion, several appeals have been filed. Under the BCRA expedited review provision, the court’s decision will be reviewed directly by the U.S. Supreme Court. On May 19 the U.S. district court issued a stay to its ruling, which leaves BCRA, as enacted, in effect until the Supreme Court issues a decision

The Nuclear Waste Policy Act of 1982 (NWPA) calls for disposal of spent nuclear fuel in a deep geologic repository that is unlikely to be disturbed for thousands of years. Low-level waste sites are a state responsibility under the Low-Level Radioactive Waste Policy Act of 1980. Pursuant to that act, 10 regional compacts for disposal of low level waste have been approved by Congress. Three commercial low-level waste sites are currently operating, in the states of South Carolina, Utah, and Washington.

In response to the foreign challenge in the global marketplace, the United States Congress has explored ways to stimulate technological advancement in the private sector. The government has supported various efforts to promote cooperative research and development activities among industry, universities, and the federal R&D establishment designed to increase the competitiveness of American industry and to encourage the generation of new products, processes, and services. Among the issues before Congress are whether joint ventures contribute to industrial competitiveness and what role, if any, the government has in facilitating such arrangements.

This Corrective Action Investigation Plan contains the U.S. Department of Energy, National Nuclear Security Administration Nevada Site Office's approach to collect the data necessary to evaluate corrective action alternatives appropriate for the closure of Corrective Action Unit (CAU) 528, Polychlorinated Biphenyls Contamination (PCBs), Nevada Test Site (NTS), Nevada, under the Federal Facility Agreement and Consent Order. Located in the southwestern portion of Area 25 on the NTS in Jackass Flats (adjacent to Test Cell C [TCC]), CAU 528 consists of Corrective Action Site 25-27-03, Polychlorinated Biphenyls Surface Contamination. Test Cell C was built to support the Nuclear Rocket Development Station (operational between 1959 and 1973) activities including conducting ground tests and static firings of nuclear engine reactors. Although CAU 528 was not considered as a direct potential source of PCBs and petroleum contamination, two potential sources of contamination have nevertheless been identified from an unknown source in concentrations that could potentially pose an unacceptable risk to human health and/or the environment. This CAU's close proximity to TCC prompted Shaw to collect surface soil samples, which have indicated the presence of PCBs extending throughout the area to the north, east, south, and even to the edge of the western boundary. Under the federal system in the United States, the states and localities traditionally have held the major responsibility for prevention and control of crime and maintenance of order. For most of the Republic’s history, “police powers” in the broad sense were reserved to the states under the Tenth Amendment to the Constitution. Many still hold that view, but others see a string of court decisions in recent decades as providing the basis for a far more active federal role. Several bills are discussed in this report that address issues related to crime, juvenile justice, and Congress’ evolving role in crime legislation.

A letter report issued by the General Accounting Office with an abstract that begins "Changes in the Department of Defense's (DOD) mission can lead to changes in inventory requirements, which, in turn, determine the size of DOD's inventory. Since 1990, GAO has identified DOD's management of inventory as a high-risk area because levels of inventory were too high and management systems and procedures were ineffective. Furthermore, DOD has attributed readiness problems to parts shortages. In this report, GAO (1) provides information on changes in and make up of the department's inventory and (2) analyzes changes in inventory requirements, focusing on the Navy."

The 108th Congress has acted on a variety of disparate environmental measures; some of these represent proposals or issues that had been under consideration in the 107th Congress and earlier. Environmental issues considered by Congress tend to fall into several major categories: (1) funding issues — whether funding levels are adequate and focused on appropriate priorities; (2) expanding, renewing, or refocusing specific environment programs; (3) environmental issues that are important “subsets” of other major areas of concern, such as energy, defense, or transportation programs; and more recently, (4) terrorism and infrastructure protection in areas such as wastewater and chemical facilities.

The advantages of using of table top x-ray lasers (XRLs) for different applications have been described. Examples of the first successful use of XRLs, the current efforts in applying them and the potential applications where an XRL can be used in future have been discussed. Modeling results showing the possibility of 3-4 times shorter wavelength capillary discharge x-ray lasers and calculated spectrum of Xe capillary EUV source are presented.

Testimony issued by the General Accounting Office with an abstract that begins "Improving the oversight and controlling the costs of major highway and bridge projects is important for the federal government, which often pays 80 percent of these projects' costs. Widespread consensus exists on the need to fund such projects, given the doubling of freight traffic and worsening congestion projected over the next 20 years, yet growing competition for limited federal and state funding dictates that major projects be managed efficiently and cost effectively. The Federal Highway Administration (FHWA) provides funding to the states for highway and bridge projects through the federal-aid highway program. This funding is apportioned to the states, and state departments of transportation choose eligible projects for funding. FHWA provides oversight to varying degrees, and, under the Transportation Equity Act for the 21st Century (TEA-21), FHWA and each state enter into an agreement documenting the types of projects the state will oversee. This report describes the Proposed Legislative Changes Affecting Pharmaceutical Patents on the Hatch-Waxman Act. The Hatch-Waxman Act provides the FDA with certain authorities to offer periods of marketing for a pharmaceutical independent of the rights conferred by patents.

The main source of narrowband impedance in the Advanced Light Source (ALS) are higher order modes (HOMs) of the two main RF and three third harmonic cavities. These HOMs drive longitudinal and transverse coupled bunch instabilities, which are controlled using active beam feedback systems. The dominant longitudinal HOMs in both systems are TM011-like modes with the R/Q factor an order of magnitude higher than all other longitudinal modes. To reduce the growth rates within the range of the longitudinal feedback system (LFB), these modes were tuned away from beam resonances by means of cooling water temperature control (main rf system), and the combination of two tuners (third harmonic system). To improve the reliability of the longitudinal dampening system, we have built and installed E-type HOM dampers for the fundamental and harmonic cavities. We present the design, commissioning and performance of the HOM dampers in this paper.

Testimony issued by the General Accounting Office with an abstract that begins "The Homeland Security Act of 2002, which created the Department of Homeland Security, brought together 22 diverse organizations to help prevent terrorist attacks in the United States, reduce the vulnerability of the United States to terrorist attacks, and minimize damage and assist in recovery from attacks that do occur. To accomplish this mission, the act established specific homeland security responsibilities for the department, which included sharing information among its own entities and with other federal agencies, state and local governments, the private sector, and others. GAO was asked to discuss DHS's information sharing efforts, including (1) the significance of information sharing in fulfilling DHS's responsibilities; (2) GAO's related prior analyses and recommendations for improving the federal government's information sharing efforts; and (3) key management issues DHS should consider in developing and implementing effective information sharing processes and systems."

This report discusses the ongoing congressional interest in the pace of U.S. technological advancement due to its influence on U.S. economic growth, productivity, and international competitiveness. Because technology can contribute to economic growth and productivity increases, congressional interest has focused on how to augment private-sector technological development. Legislative activity over the past decade has created a policy for technology development, albeit an ad hoc one. Because of the lack of consensus on the scope and direction of a national policy, Congress has taken an incremental approach aimed at creating new mechanisms to facilitate technological advancement in particular areas and making changes and improvements as necessary.

Correspondence issued by the General Accounting Office with an abstract that begins "This report provides information on Ground-based Midcourse Defense (GMD) element flight test known as Integrated Flight Test (IFT)-16. This test was planned for the third quarter of fiscal year 2004 but was recently cancelled by the Missile Defense Agency (MDA), the agency within the Department of Defense (DOD) responsible for developing the ballistic missile defense system and its elements. Specifically, GAO was asked to determine the original purpose of IFT-16, how the test differed from IFT-14 and -15, and what new information IFT-16 would have provided had it been conducted."

In recent years conflicting budget priorities and divided political control have accentuated the institutional tensions between the executive and legislative branches inherent in the federal budget process. President Clinton, like his two predecessors, called for an item veto, or possibly expanded impoundment authority, to provide him with greater control over federal spending. This report provides a brief history of impoundment and discusses the debate surrounding the line item veto.

The INTRODUCTION to this paper summarizes the history of the Global Accelerator Network (GAN) concept and the recent workshops that discussed the relationship between GAN and Remote Operations. The set of major TOPICS RAISED AT THE WORKSHOPS are only partially resolved.
