The Budget for Fiscal Year 2004

In March, CBO released its report analyzing the President’s policies. CBO’s estimates of the President’s budget, a recasting of the policies using CBO assumptions and budget estimating methods, raise the expected deficit for FY2004 to $338 billion from the OMB estimated $307 billion. The report also included an update to CBO’s January baseline that pushed the deficit for FY2004 to $200 billion from $145 billion. The revisions delay the return-to-a-surplus from FY2007 to FY2008 and reduce the cumulative FY2004-FY2013 surplus from $1,336 billion (January) to $891 billion (March).

Economic Development Administration: Overview and Issues

The Economic Development Administration (EDA), targeted for elimination or major “reinvention” early in the 104th Congress, gained a new lease on life in the waning days of the 105th. Having been kept alive via appropriations bills since its last authorizing legislation expired in 1982, P.L. 105-393 reauthorized the EDA and its programs for 5 years. On October 27, Congress approved a conference agreement recommending $286.7 million for EDAP and $28 million for S&E, for a totalFY2001 appropriation of$411.9 million for EDA. It became part of the Consolidated Appropriations Act (H.R. 4942, P.L. 106-553) signed into law on December 21, 2000.

On March 27, 2002 the Department of Health and Human Services (HHS) published its proposed changes to the medical privacy regulations issued by the Clinton Administration under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). HHS is accepting comments on the proposed changes until April 26, 2002. This report provides an overview of the final rule for “Standards for the Privacy of Individually Identifiable Health Information” ( “privacy rule”) that went into effect on April 14, 2001, and an overview of the Bush Administration’s proposed changes to the privacy regulation.

Article 98 Agreements and Sanctions on U.S. Foreign Aid to Latin America

This report discusses the so-called “Article 98 agreements”. The article contains a provision that the Bush Administration has sought bilateral agreements worldwide to exempt U.S. citizens from ICC prosecution. In 2002, Congress passed the American Servicemembers’ Protection Act or ASPA (P.L. 107-206, title II), which prohibits military assistance to countries that are party to the ICC and that do not have Article 98 agreements. Some Members of Congress and Bush Administration officials have expressed concerns about the unintended effects of these sanctions on U.S. relations with Latin America. Policymakers are considering some options to mitigate these effects without undermining ASPA or diplomatic efforts to secure Article 98 agreements.
