Colombia: Conditions and U.S. Policy Options

With the civil conflict in Colombia worsening, in many analysts’ perception, some policymakers are again questioning the wisdom and scope of U.S. policy and assistance toward that country. This is the context for debate over future U.S. policy toward Colombia, in particular whether the current levels of U.S. assistance are sufficient, and whether U.S. assistance to the Colombia military is desirable. This report first discusses U.S. interests in Colombia. It then provides information on Colombia’s current conflict, with sections on the guerrillas, the paramilitaries, and President Pastrana’s efforts to deal with the conflict through the peace process, and the reform and rehabilitation of the Colombian military. The last section discusses possible policy options.

The Law of the Sea Convention and U.S. Policy

On October 7, 1994, President Clinton transmitted to the Senate the 1982 United Nations Convention on the Law of the Sea and the 1994 Agreement relating to the Implementation of Part XI of the United Nations Convention. The package was referred to the Senate Committee on Foreign Relations. On November 16, 1994, the U.N. Law of the Sea Convention entered into force but without accession by the United States. The 1994 Agreement entered into force on July 28, 1996, again without U.S. ratification.

The Clinton Administration took several actions to increase protection at designated marine sites, referred to as marine reserves or marine protected areas (MPAs). The idea of protecting marine areas has been discussed for many years, but has not been applied extensively in the marine environment. While the meaning of this might seem obvious -- that Social Security is not to be considered as part of the federal budget -- many people are confused by the continued use of aggregate budget figures that include Social Security's receipts and expenditures.

The entry into force, on January 1, 1994, of the North American Free Trade Agreement (NAFTA) has eliminated the advantage that the beneficiaries of the Caribbean Basin Economic Recovery Act (CBERA) and related provisions of the Caribbean Basin Initiative (CBI) had enjoyed in trade with the United States relative to Mexico, and gave Mexico an increasingly significant competitive edge over the CBERA countries. The scheduled further implementation of the NAFTA would have resulted in a substantial advantage to Mexico over the CBERA countries and vitiate in part the purpose of the CBERA.

The Supreme Court Addresses Corps of Engineers Jurisdiction Over "Isolated Waters": The SWANCC Decision

On January 9, 2001, the Supreme Court handed down Solid Waste Agency of Northern Cook County (SWANCC) v. U.S. Army Corps of Engineers. At issue in SWANCC was the scope of Clean Water Act section 404, which requires permits for the discharge of dredged or fill materials into "navigable waters," defined by the Act as "waters of the United States." Section 404 is the charter for the federal wetlands permitting program.
