Endangered Species: Difficult Choices
This report discusses issues debated in the 107th Congress while is considering various proposals to amend the Endangered Species Act of 1973 (ESA). Major issues in recent years have included changing the role of science in decision-making, changing the role of critical habitat, reducing conflicts with Department of Defense activities, incorporating further protection for property owners, and increasing protection of listed species, among others. Army Aviation: The RAH-66 Comanche Helicopter Issue
Although it has been a high priority Army program, a number of factors have complicated the RAH-66 Comanche program. Since its inception, the program has been restructured several times–postponing the initial operational capability (IOC) and increasing overall program costs. Presently, there is debate within the Army regarding whether the program should be reduced significantly to make funds available to pursue other modernization priorities.

Campaign Finance: Constitutional and Legal Issues of Soft Money
Soft money is a major issue in the campaign finance reform debate because these generally unregulated funds are perceived as resulting from a loophole in the Federal Election Campaign Act (FECA). Generally, soft money is funds that are raised and spent according to applicable state laws, which FECA prohibits from being spent directly on federal elections, but that may have an indirect influence on federal elections. This Issue Brief discusses three major types of soft money: political party soft money, corporate and labor union soft money, and soft money used for issue advocacy communications.

Campaign Finance: Constitutional and Legal Issues of Soft Money
Prior to enactment of the Bipartisan Campaign Reform Act of 2002 (BCRA), P.L. 107-155, the term “soft money” generally referred to unregulated funds, perceived as resulting from loopholes in the Federal Election Campaign Act (FECA), 2 U.S.C. §§ 431 et seq. Generally, the intent of BCRA, (effective Nov. 6, 2002), which amends FECA, is to restrict the raising and spending of soft money. This Issue Brief discusses constitutional and legal issues surrounding two major types of soft money that BCRA regulates: political party soft money and soft money used for issue advocacy communications. Corporate and labor union soft money, which FECA exempts from regulation and is not addressed by BCRA, is also discussed.

Clean Air Act Issues in the 107th Congress
In the 107th Congress, the most prominent air quality issue has been whether state and federal regulations designed to protect air quality are having a negative impact on energy production, and, if so, whether legislation should be enacted to reform such regulations. The early discussion focused primarily on California, but with the release of the Administration’s energy policy recommendations in May 2001 and subsequent congressional action, attention shifted to issues more national in scope.

China-U.S. Trade Issues
U.S.-China economic ties have expanded substantially over the past several years. China is now the third largest U.S. trading partner, its second largest source of imports, and its fourth largest export market. However, U.S.-China commercial ties have been strained by a number of issues, including a surging U.S. trade deficit with China, China's refusal to float its currency, and failure to fully comply with its World Trade Organization (WTO) commitments, especially its failure to provide protection for U.S. intellectual property rights (IPR). Immigration: Adjustment to Permanent Residence Status under Section 245(i)
Under § 245 of the Immigration and Nationality Act, an alien in the U.S. who, on the basis of family relationship or job skills, becomes eligible for permanent resident status may adjust to that status in the United States without having to go abroad to obtain an immigrant visa. Historically, only those aliens who were here legally (e.g., as a student or a temporary skilled worker) could adjust status under § 245. In 1994, however, Congress enacted § 245(i). That provision, which was set to expire on September 30, 1997, allowed illegal aliens in the U.S. to adjust status under § 245 once they, because of family relationships or job skills, became eligible for permanent the residency provided they paid a surcharge fee.

Critical Infrastructures: Background, Policy, and Implementation
The nation’s health, wealth, and security rely on the production and distribution of certain goods and services. The array of physical assets, processes and organizations across which these goods and services move are called critical infrastructures (e.g. electricity, the power plants that generate it, and the electric grid upon which it is distributed). Computers and communications, themselves critical infrastructures, are increasingly tying these infrastructures together. This report aims to address the concern that this reliance on computers and computer networks raises the vulnerability of the nation’s critical infrastructures to “cyber” attacks.
