Federal Employees' Compensation Act: Case Examples Illustrate Vulnerabilities That Could Result in Improper Payments or Overlapping Benefits

A letter report issued by the Government Accountability Office with an abstract that begins "GAO found examples of improper payments and indicators of potential fraud in the Federal Employees' Compensation Act (FECA) program, which could be attributed, in part, to oversight and data-access issues. GAO found examples of claimants' receiving overlapping FECA and unemployment insurance (UI) benefits, which may be allowable under certain circumstances, but could also be erroneous. GAO also found that FECA program requirements allow claimants to receive earnings, and earnings increases, without necessarily resulting in adjustment of FECA compensation. For example, of the 32 FECA case files reviewed, GAO found five instances where an individual's wage-earning capacity (WEC), which is used to determine FECA benefits, was not adjusted even though the individual earned substantially more than the wage that was originally used to calculate the WEC. In addition, two FECA claimants continued to receive privateemployment salaries that were not subject to their WEC calculation. This is because, as currently written, program procedures allow claimants to receive increases in earnings, in certain circumstances, without adjustments to FECA compensation, and current law allows for claimants' earnings from dissimilar concurrent private employment at the time of injury to be exempt …

A letter report issued by the Government Accountability Office with an abstract that begins "The Department of Homeland Security (DHS) and selected components are implementing strategies to fill mission-critical occupations (MCO), which are those occupations most critical to an agency's mission. In 2011, the Office of Diversity and Inclusion (D&I)--which coordinates component recruiting efforts--developed the Coordinated Recruiting and Outreach Strategy (CROS). Through the CROS, D&I intends to better coordinate and link component recruiting and outreach efforts to hiring for DHS mission and workforce needs (for all positions, including MCOs), and to leverage resources as well as reduce recruiting costs, among other things. D&I has begun to implement the CROS through various means, including requiring components to develop their own outreach and recruiting plans that align with the CROS. However, D&I has been limited in its ability to implement some elements of the CROS--such as recruiter training--because of budget constraints, according to D&I officials. The components selected for GAO's review--the National Protection and Programs Directorate, Transportation Security Administration (TSA), U.S. Citizenship and Immigration Services, and U.S. Secret Service (USSS)--have also implemented various strategies to recruit and hire MCOs. The Army's strategy addresses some aspects of cost, technology maturity, security, and readiness, but as implementation is still under way, data for assessing progress are not available at this time. SSA has also experienced an increasing number of beneficiaries who may not have a suitable payee available. In an effort to address this challenge, SSA hosted a webinar to recruit additional payees. However, SSA officials said this effort did not result in the addition of any new payees. SSA also faces challenges ensuring that payees who are selected are suitable for the task. To help address this challenge, SSA implemented a pilot program in its Philadelphia region to screen and bar payee applicants who have been convicted of certain crimes. In 2009, DHS changed the criteria to make the list entirely consequence based--that is, based on the effect of an event on public health and safety, and economic, psychological, and government mission impacts. Subsequent changes introduced specialized criteria for some sectors and assets. A letter report issued by the Government Accountability Office with an abstract that begins "In 2010, states required about 2 percent of all districts to use Individuals with Disabilities Education Act (IDEA) funds for early intervening services to address the overrepresentation of racial and ethnic groups in special education. Based on definitions states individually developed to measure this overrepresentation-- referred to in IDEA as significant disproportionality--356 districts were required to provide services. Half of these districts were clustered in five states and 73 were in Louisiana alone. States have used flexibility provided by Education to develop their own definitions of significant disproportionality and GAO's analysis of 16 selected states found wide variation in definitions. Further, GAO found that the way some states defined overrepresentation made it unlikely that any districts would be identified and thus required to provide early intervening services. Nebraska and Louisiana illustrate differing outcomes that can result from different state definitions. A letter report issued by the Government Accountability Office with an abstract that begins "From 2008 through 2011, the Department of Health and Human Services' Food and Drug Administration (FDA) received 6,307 reports of health problems--adverse event reports (AER)--for dietary supplements; 71 percent came from industry as serious adverse events as required by law, and most of these AERs were linked with supplements containing a combination of ingredients, such as vitamins and minerals or were otherwise not classified within FDA's product categories. However, FDA may not be receiving information on all adverse events because consumers and others may not be voluntarily reporting these events to FDA, although they may be contacting poison centers about some of these events. From 2008 to 2010, these centers received over 1,000 more reports of adverse events linked to dietary supplements than did FDA for the same period. FDA officials said that they are interested in determining whether the poison center data could be useful for their analysis and have held discussions with American Association of Poison Control Centers representatives, but cost is a factor."

Because the Recovery Act directed federal agencies to spend funds quickly and prudently, Labor implemented a number of high-investment green jobs efforts simultaneously. For example, the Bureau is attempting to develop Bureau-wide, or "enterprise," standards, guidance, or tools in areas such as risk management and information technology (IT) investment management to reduce duplicative efforts across the Bureau. Although the Bureau has made progress in these and other areas, if the Bureau is to transform itself to better control costs and deliver an accurate national headcount in 2020, several areas will require continued oversight: cost estimation, integrated long-term planning, and stakeholder involvement. For example, while the Bureau has made progress with long-term planning by implementing some elements of GAO's recommendation that it develop a road map for 2020 planning, it still needs to pull together remaining planning elements, such as milestones for decisions and estimates of cost, into its roadmap."

Testimony issued by the Government Accountability Office with an abstract that begins "The Coast Guard, a component of the Department of Homeland Security (DHS), has made progress in developing its Common Operational Picture (COP) by increasing the information in the COP and increasing user access to this information. The Coast Guard has made progress by adding internal and external data sources that allow for better understanding of anything associated with the global maritime domain that could affect the United States. The COP has made information from these sources available to more COP users and decision makers throughout the Coast Guard. For example, in 2006, the ability to track the location of Coast Guard assets, including small boats and cutters, was added to the COP. This capability--also known as blue force tracking--allows COP users to locate Coast Guard vessels in real time and establish which vessels are in the best position to respond to mission needs. In addition to adding information to the COP, the Coast Guard has also made the information contained in the COP available on more computers and on more systems, which, in turn, has increased the number of users with access to the COP."

Private Pensions: Timely Action Needed to Address Impending Multiemployer Plan Insolvencies

A letter report issued by the Government Accountability Office with an abstract that begins "The most severely distressed multiemployer plans have taken significant steps to address their funding problems and, while most plans expected improved financial health, some did not. A survey conducted by a large actuarial and consulting firm serving multiemployer plans suggests that the large majority of the most severely underfunded plans--those designated as being in critical status--either have increased or will increase employer contributions or reduce participant benefits. In some cases, these measures will have significant effects on employers and participants. For example, several plan representatives stated that contribution increases had damaged some firms' competitive position in the industry, and, in some cases, threatened the viability of such firms. Similarly, reductions in certain benefits--such as early retirement subsidies--may create hardships for some older workers, such as those with physically demanding jobs. Most of the 107 surveyed plans expected to emerge from critical status, but about 25 percent did not and instead seek to delay eventual insolvency."

The study noted that the level of plutonium research necessary to support the nuclear weapons life extension programs is affected by the planned schedule of the life extension programs, the number of pits that will be needed under the programs, and the number of pits that will need to be manufactured versus re-used, all of which have uncertainties. According to the April 2012 study, one option for meeting NNSA's plutonium research needs is to relocate analytical chemistry and materials characterization capabilities among facilities at LANL, which will require upgrades costing roughly $480 million to $820 million. PHMSA requires carriers to report hazardous material incidents, but the reporting form does not specifically capture wetline incidents. PHMSA officials identify wetline incidents through a resource-intensive process of reviewing carrier-reported incident narratives and other information. However, GAO found that the narratives do not always clearly indicate whether an incident is wetline related and that information about the consequences of incidents, including fatalities, is not always accurate. PHMSA has made efforts to improve its data, such as adding quality checks, but this has not affected how wetline incidents are reported, and inaccuracies remain."

Moreover, as of March 31, 2013, U.S. agencies estimated that they had allocated approximately $708 million in non-CARSI funding that supports CARSI goals, but data on disbursements were not readily available.
