The Centers for Medicare & Medicaid Services (CMS) is transitioning claims administration to 19 new entities known as Medicare Administrative Contractors (MAC) and plans to complete the process ahead of October 1, 2011, the date required by law. In 2005, GAO reported that CMS's plan to accelerate the transition could create challenges and was based on estimated costs and savings that were uncertain. In this report GAO examined (1) how CMS has implemented Medicare contracting reform; (2) how CMS assessed the performance of the MACs and what the results of its assessments have been; and (3) what CMS's costs and savings have been for Medicare contracting reform. Although FCC took steps to enhance its ability to control and monitor its network for security threats, weaknesses identified in the commission's deployment of components of the ESN project as of August 2012 resulted in unnecessary risk that sensitive information could be disclosed, modified, or obtained without authorization. This occurred, in part, because FCC did not fully implement key information security activities during the development and deployment of the initial components of the project. While FCC policy is to integrate security risk management into system life-cycle management activities, the commission instead deployed the initial components of the ESN project without, among other things, first selecting and documenting the security controls, assessing the controls, or authorizing the system to operate. As a result of these deficiencies, FCC's information remained at unnecessary risk of inadvertent or deliberate misuse, improper disclosure, or destruction. They are not doing so because they view their role as that of acting as a coordinator for other federal agencies, although they agreed that they could do more to support regional efforts and are positioned to do so. The NCR Strategic Plan helps regional officials identify the capabilities needed to strengthen the region's homeland security efforts and defines the framework for achieving those capabilities. NCR preparedness officials said that they have been working to develop preparedness measures since 2003, but noted that these measures are difficult to link to a measured improvement in regional preparedness. For example, while the region identified more than $25 million in UASI grant projects invested in providing public alerts and warnings, regional officials have not developed a measure to determine the effectiveness of these activities. School Improvement Grants: Early Implementation Under Way, but Reforms Affected by Short Time Frames

A letter report issued by the Government Accountability Office with an abstract that begins "The School Improvement Grants (SIG) program, which was created in 2002, funds reforms in the country's lowest-performing schools with the goal of improving student outcomes, such as standardized test scores and graduation rates. Congress greatly increased SIG program funding from $125 million available in fiscal year 2007--the first year the program was funded--to $3.5 billion in fiscal year 2009 for the 2010-11 school year. Three billion dollars of this amount was provided by the American Recovery and Reinvestment Act of 2009 (Recovery Act). In addition, $546 million was appropriated in both fiscal years 2009 and 2010, and $535 million was appropriated in fiscal year 2011. These funds were provided to states by formula after the Department of Education (Education) approved state SIG grant applications. The funding increases provided by the Recovery Act spurred Education to make substantive changes to the SIG program. Fiscal year 2010 marked the seventh year of implementation of the Improper Payments Information Act of 2002 (IPIA), which requires executive branch agencies to annually review all programs and activities to identify those that are susceptible to significant improper payments, estimate the annual amount of improper payment for such programs and activities, report these estimates, and report on actions taken to reduce any improper payment estimates that exceed $10 million. On July 22, 2010, the Improper Payments Elimination and Recovery Act of 2010 (IPERA) was enacted. IPERA amended IPIA by expanding on the previous requirements for identifying, estimating, and reporting on programs and activities susceptible to significant improper payments and to expand requirements for recovering overpayments across a broad range of federal programs. The Department of Justice (DOJ) Antitrust Division's leniency program offers the possibility that the first individual or company that self-reports cartel activity will avoid criminal conviction and penalties. In 2004, the Antitrust Criminal Penalty Enhancement and Reform Act (ACPERA) was enacted to encourage such reporting. The 2010 reauthorization mandated that GAO study ACPERA's effect. This report addresses (1) the extent that ACPERA affected DOJ's criminal cartel enforcement, (2) the ways ACPERA has reportedly affected private civil actions, and (3) key stakeholder perspectives on rewards and antiretaliatory protection for whistleblowers reporting criminal antitrust violations. GAO analyzed DOJ data on criminal cartel cases (1993-2010) and interviewed DOJ officials. GAO also interviewed a nongeneralizable sample of plaintiffs' and defense attorneys from 17 civil cases and key stakeholders including other antitrust attorneys selected using a snowball sampling technique whereby GAO identified contacts through referrals."

In focusing on this issue, GAO found that data problems continue to hamper federal efforts. GAO examined Federal Real Property Profile (FRPP) data, which is managed by the General Services Administration (GSA) and is to describe the real property under the custody and control of executive branch agencies. GAO identified inconsistencies and inaccuracies at 23 of the 26 locations visited in 2011 and 2012 in key data elements related to the management of excess and underutilized property, including utilization, condition, annual operating costs, and value of the buildings. For example, several buildings that received high scores for condition were in poor condition, with problems including, asbestos, mold, health concerns, radioactivity, and flooding. These findings raised concern that the FRPP is not a useful tool for describing the nature, use, and extent of excess and underutilized federal real property."

To help students finance their education, Congress recently raised the ceiling on the amount individual students can borrow under the federal Stafford Loan program (referred to in legislation as "loan limits"). Congress initially did so for first- and second-year undergraduate students as well as for graduate and professional students in academic year (AY) 2007-08, and subsequently for all qualified undergraduate students receiving unsubsidized Stafford loans in AY 2008-09. While the Office of Management and Budget (OMB) and federal agencies have taken steps to address underperforming IT projects and more effectively manage IT through a number of major initiatives, additional actions are needed. For example, OMB has taken significant steps to enhance the oversight accountability of federal investments by creating the IT Dashboard, an OMB public website which provides detailed information on federal agencies' major investments. However, GAO previously found there were issues with the accuracy and reliability of cost and schedule data in the Dashboard and recommended steps that OMB and agencies should take to improve these data--this is important since the Dashboard currently reports 154 investments totaling almost $10.4 billion being at risk. Also, the Individuals with Disabilities Education Act (IDEA) supports and funds early intervention and special education services for children with disabilities, including deafness and hearing loss. A letter report issued by the Government Accountability Office with an abstract that begins "The reorganization of the Air Force Materiel Command (AFMC) affected reporting chains of command and workforce composition for some offices at Hanscom Air Force Base, but did not change how former components of the Electronic Systems Center (ESC) at Hanscom carry out their acquisition mission. Personnel in functional offices who provide technical services previously reported to the locally-based ESC leadership; they now report directly to senior functional managers at Wright-Patterson Air Force Base, who oversee functional offices across all locations of the new Air Force Life Cycle Management Center (AFLCMC) established by the reorganization. In addition, the reorganization eliminated 131 functional office positions (about 10 percent of Hanscom's civilian positions), which AFMC determined were not directly involved with development, delivery, or sustainment of weapon systems. GAO's analysis of Hanscom's data showed that the eliminated positions included 13 which were unfilled; of personnel in the remaining 118 positions, 15 accepted voluntary-separation agreements, 102 were reassigned at Hanscom Air Force Base, and 1 was removed. The reorganization did not change the mission of directorates that deliver electronic capabilities to customers."

In fact, from 1998 to 2009, women surpassed men in their likelihood of working for an employer that offered a pension plan—largely because the proportion of men covered by a plan declined. Furthermore, as employers have continued to terminate their defined benefit plans and switch to defined contribution plans, the proportion of women who worked for employers that offered a defined contribution plan increased. Women’s higher rates of pension coverage may be due to the fact that they are more likely to work in the public and nonprofit sectors and industries that offer coverage, such as health and education."

Correspondence issued by the Government Accountability Office with an abstract that begins "To help expand health insurance coverage among the 50 million uninsured Americans, the Patient Protection and Affordable Care Act as amended (PPACA) mandates that individuals, subject to certain exceptions, obtain health insurance coverage or pay a financial penalty beginning in 2014--the "individual mandate". At the same time, PPACA generally requires insurers to accept all applicants, regardless of health status, and prohibits insurers from excluding coverage based on any preexisting conditions. An individual mandate such as PPACA requires has been the subject of continued debate. Many health care policy experts have stressed the importance of a mandate in expanding health care coverage and keeping premiums affordable. For example, experts have noted that such a federal requirement may be necessary to prompt many individuals, such as younger, healthier individuals, to obtain coverage they otherwise would forego--particularly once they are guaranteed access to that coverage later when they may need it. They suggest that bringing these younger, healthier individuals into the insurance market is necessary to avoid adverse selection, whereby disproportionately less healthy individuals who need health care services enroll in coverage, leading to higher premiums that further discourage healthy individuals …

Video Marketplace: Competition Is Evolving, and Government Reporting Should Be Reevaluated

A letter report issued by the Government Accountability Office with an abstract that begins "Since GAO reported on competition in 2005, competition among video content producers is little changed, while competition among distributors has increased. According to data cited by the Federal Communications Commission (FCC), seven companies' broadcast and cable networks accounted for about 95 percent of all television viewing hours in the United States. Further, ownership of broadcast and cable networks changed little from 2005 through 2012. Alternatively, the introduction of video service provided by telephone companies, such as Verizon's FiOS service, has brought additional competition to video distribution. At year-end 2010, roughly 1 in 3 households could choose among 4 or more subscription video distributors: typically a cable company, 2 satellite companies, and a telephone company. With technological advances, companies are increasingly distributing video online. Online video distributors (OVD) are developing a variety of business models, including free and subscription-based services. However, online viewing and revenues represent a small portion of overall media viewing hours and revenue."

Credit Cards: Marketing to College Students Appears to Have Declined

A letter report issued by the Government Accountability Office with an abstract that begins "Trends associated with college affinity card agreements include fewer agreements and cardholders and declining payments, according to data GAO analyzed from the Board of Governors of the Federal Reserve System (Federal Reserve) and the Bureau of Consumer Financial Protection (CFPB). The number of affinity card agreements declined from 1,045 in 2009 to 617 in 2012 (41 percent). More than 70 percent of the agreements in 2012 were with institutions of higher education or alumni organizations, and one issuer—FIA Card Services, a subsidiary of Bank of America—had 67 percent of all agreements. Affinity card issuers paid $50.4 million to all organizations in 2012, 40 percent less than in 2009. In most cases, payments were based on numbers of cardholders and the amount spent on the cards. The card agreements covered contractual obligations related to such things as marketing practices, target populations, use of the organization's logo or trademark, terms of payment, and, in some cases, service standards."

Unemployed Older Workers: Many Experience Challenges Regaining Employment and Face Reduced Retirement Security

A letter report issued by the Government Accountability Office with an abstract that begins "As with many other demographic groups, older workers’ unemployment overall and long-term unemployment rates have increased dramatically since the recession began in 2007. In December 2011, the unemployment rate for older workers was 6.0 percent, up from 3.1 at the start of the recession, but down from its peak of 7.6 percent in February 2010. In particular, long-term unemployment rose substantially, and at a greater rate for older than younger workers. By 2011, 55 percent of unemployed older workers had been actively seeking a job for more than half a year (27 weeks or more). Meanwhile, the long-term trend of rising labor force participation rates among older workers has continued, with the recession possibly amplifying this trend."
