A Legal Analysis of Litigation Against Oklahoma Educators and School Districts under the Oklahoma Governmental Tort Claims Act

This dissertation analyzed public court decisions in cases against Oklahoma school districts and their employees involving sovereign immunity claims filed under Oklahoma's Governmental Tort Claims Act. The questions addressed were: (1) How have the Oklahoma courts interpreted the Governmental Tort Claims Act, (Okla. Stat. tit. 51 § 151 et seq.) in litigation against school districts and their employees? (2) What are the limits of immunity protection for Oklahoma school districts and their employees? (3) How has the statute of limitations in Okla. Stat. tit. 51 § 156 and Okla. Stat. tit. 51 § 157 been applied to Oklahoma educators in tort litigation? This dissertation utilized legal research as the methodology to answer the research questions. Chapter II provides a review of existing literature regarding sovereign immunity in the United States. Chapter III is a comprehensive study of Oklahoma sovereign immunity cases filed against Oklahoma school districts and educators under the Governmental Tort Claims Act with regard to negligence, corporal punishment and the statute of limitations. Chapter IV discusses the findings of the analysis of cases in Oklahoma and the amount of protection afforded to Oklahoma school districts and educators.

Letters from Jack and Other Cadavers

My dissertation, Letters from Jack and Other Cadavers, developed out of my interest in using persona, narrative forms, and historical details collected through thorough research to transform personal experience and emotions in my poems. The central series of poems, "Letters from Jack," is written in the voice of Jack the Ripper and set up as a series of poems-as-letters to the police who chased him. The Ripper's sense of self and his motivations are troubled by his search for a muse as the poems become love poems, contrasting the brutality of the historical murders and the atmosphere of late 19th century London with a charismatic speaker not unlike those of Browning's Dramatic Monologues. The dissertation's preface further explores my desire for a level of personal removal while crafting poems in order to temper sentimentality. Drawing on Wallace Stevens's notion that "Sentimentality is failed emotion" and Tony Hoagland's assessment that fear of sentimentality can turn young poets away from narrative forms, I examine my own poems along with those of Scott Cairns, Tim Seibles, and Albert Goldbarth to derive conclusions on the benefits distance, persona, narrative, and detail to downplay excessive emotion and the intrusion of the personal. Living-learning communities and ethnicity: A study on closing the achievement gap at Regional University

This quasi-experimental study examined the impact of living-learning communities on GPA and fall-to-fall retention rates for college freshmen at Regional University (RU). The specific focus of this study was the effect of these communities on students of different ethnic groups and on the potential of these communities to reduce the academic performance gap. RU was a small public university that offered both undergraduate and graduate degree programs. RU required all freshman students to live on campus in living-learning communities beginning with the 2007-2008 academic year. This study utilized the 343 student freshman cohort class of 2008 in the living-learning communities as the treatment group. This treatment group was compared against the 193 student freshman cohort class of 2008 living off campus and against the 643 student freshman cohort class of 2006 living on campus prior to the implementation of living-learning communities. In addition, the statistics were analyzed by ethnicity to examine the impact of these communities on White, Hispanic, African American, and Native American students and their ability to reduce the academic performance gap. Lowell Liebermann's Concerto No. 1 for Piano and Orchestra, Opus 12: An Historical and Analytical Study

Lowell Liebermann, born in New York City in 1961, is one of America's most distinguished living composers. In addition, he often conducts and performs as pianist in his own works. His musical language is unique and unmistakably rooted in the grand tradition of Western music; however, his style combines old and new, simple and complex, emotional and intellectual aspects. It combines tuneful, catchy melodies with a rich harmonic language, all framed by a strong formal design. This study begins with presenting primary information on this concerto excerpted from an interview with Lowell Liebermann. This interview served as a reference for subsequent sections, and a transcript of the interview is appended to the end of this study. In the third chapter, the musical language of the composer is discussed. Chapters four and five constitute the main body of this dissertation. The goal of these two chapters is to understand the basic three-pitch motive of the work, to demonstrate how it operates at various levels, and to see how the raw material corresponds at a larger structure level. It is the author's hope that this study will guide performers to better understand Liebermann's Concerto No. 1 for Piano and Orchestra, Opus 12.

Making the Connection: How Mentors Choose Protégés in Academic Mentoring Relationships

Among other things, mentoring research is concerned with how mentors go about the process of choosing who they should mentor. Even when mentoring relationships are assigned, mentors need to feel that the efforts they are putting forth are worth the time and energy. What protégé attributes best attract the attention of a mentor? What mentor attributes make some protégés more attractive to them than others? This study looks at 3 explanations for mentor-protégé attraction, shedding light on the mental processes that influence why some protégés find it easy to get mentors and why some have a much tougher time finding the right person to mentor them. Practical and theoretical implications of this study are included.

Maleic anhydride grafted polypropylene coatings on steel: Adhesion and wear.

Polymeric coatings are being used in a growing number of applications, contributing to protection against weather conditions and localized corrosion, reducing the friction and erosion wear on the substrate. In this study, various polypropylene (PP) coatings were applied onto steel substrates by compression molding. Chemical modification of PP has been performed to increase its adhesion to metallic surfaces by grafting of maleic anhydride (MAH) onto PP in the presence of dicumyl peroxide (DCP). Influence of different concentrations of MAH and DCP on the properties of resulting materials have been examined. The coated steel samples are characterized by scanning electron microscopy (SEM), shear adhesion testing, FTIR and tribometry. The coatings with 3 wt. % MAH have shown the maximum adhesion strength due to maximum amount of grafting. The wear rates increased with increasing the amount of MAH due to simultaneous increase in un-reacted MAH.

Medical School Admissions Across Socioeconomic Groups: An Analysis Across Race Neutral and Race Sensitive Admissions Cycles

While the relationship between academic variables and admission into medical school has been well documented, the relationship between socioeconomic background and admission has not been extensively examined. In 2001, the Texas Legislature passed HB 1641, which allowed for the use of socioeconomic variables in the admission of graduate and professional school students. Additionally, the Grutter v. Bollinger decision in 2003 removed a prohibition on the use of race or ethnicity in the admission of students in the state of Texas. The study examined the role medical school admissions selectivity as it relates to the socioeconomic background during a race neutral admissions cycle in 2005 and a race sensitive admissions cycle in 2006. The results of data analysis found that in a race neutral admissions cycle socioeconomic background was a significant factor in the admission of applicants to medical school. However, it was not a significant factor for applicants from underrepresented minority groups. The analysis also found that socioeconomic background was a significant factor in the admission of applicants to medical school in a race sensitive admissions cycle as well. Microwave-Assisted Synthesis, Characterization, and Photophysical Properties of New Rhenium(I) Pyrazolyl-Triazine Complexes

The reaction of the chelating ligand 4-[4,6-bis(3,5-dimethyl-1H-pyrazol-1-yl)-1,3,5-triazin-2-yl]-N,N-diethyl-benzenamine, L, with pentacarbonylchlororhenium by conventional heating method produces the complexes fac-[ReL(CO)3Cl2] and fac-[Re2L(CO)6Cl2] in a period of 48 hours. The use of microwaves as the source of heat and the increase in the equivalents of one of the reactants leads to a more selective reaction and also decreases the reaction time to 1 hour. After proper purification, the photophysical properties of fac-[ReL(CO)3Cl] were analyzed. The solid-state photoluminescence analysis showed an emission band at 628 nm independent of temperature. However, in the solution studies, the emission band shifted from 550 nm in frozen media to 610 nm when the matrix became fluid. These results confirm that this complex possess a phenomenon known as rigidochromism.

Modulation of the Coelomic Fluid Protein Profile in the Earthworm, Lumbricus Terrestris, After Exposure to Copper as Copper Sulfate

Proteomic techniques were used to analyze the protein profile of earthworm, Lumbricus terrestris, coelomic fluid collected by either whole body dissection method or the coelomic cavity puncture method. Data demonstrated that collection of coelomic fluid using the coelomic cavity puncture method protocol resulted in a 32% reduction, 377 +/- 4.5 vs 253+/- 19.9 (p=0.0007), in the number of individual proteins. It was determined that the coelomic cavity puncture method yielded a "cleaner" preparation, one less contaminated with extraneous proteins from intestinal tissue, gut contents, and body wall materials. This protocol was used in all later studies. The same proteomic techniques were used to evaluate the effects that exposure to Cu (1.0 μg/cm2) as CuSO4 had on the earthworm coelomic fluid profile. Comparison of protein profile from exposed earthworms demonstrated a significant reduction in the number of proteins expressed (184 ± 2.64 vs 253 ±19.9 p=0.0192) when compared to control organisms. Cu exposure also resulted in a modulation of the protein profile with treated earthworms expressing 47 new proteins that were not identified in unexposed worm coelomic fluid. Music Career Opportunities and Career Compatibility: Interviews with University Music Faculty Members and Professional Musicians

This study used a semistructured interview schedule to identify the music career opportunities available to students who graduate with an undergraduate music degree, and the skills, interests, work values, and personal characteristics that may determine a person's suitability for these music careers. Six university faculty members from each of the 11 NASM-accredited undergraduate music degree fields participated in the study (n = 66). Fourteen professional musicians who were recommended by these faculty members also participated in the study. Concerning the musical and non-musical skills that may determine a person's suitability for a music career, participants consistently noted the importance of performance skills in their respective fields. Participants also consistently cited people skills, and noted that most musicians interact with people on a daily basis, and use people skills to build social networks that may lead to employment. When asked about the interests that may lead someone to a music career, participants commonly cited the importance of good high school ensemble experiences in students' music career decisions. Concerning the rewarding aspects of music careers, many participants noted that they were more rewarded by the ability to support themselves doing what they loved, than by fame or wealth. Musical Arrangements and Questions of Genre: A Study of Liszt's Interpretive Approaches

Through his exceptional creative and performing abilities, Franz Liszt was able to transform compositions of many kinds into unified, intelligible, and pleasing arrangements for piano. Nineteenth-century definitions of "arrangement" and "Klavierauszug," which focus on the process of reworking a composition for a different medium, do not adequately describe Liszt's work in this area. His piano transcriptions of Schubert's songs, Berlioz's Symphonie fantastique and the symphonies of Beethoven are not note-for-note transcriptions; rather, they reinterpret the originals in recasting them as compositions for solo piano. Writing about Liszt's versions of Schubert's songs, a Viennese critic identified as "Carlo" heralded Liszt as the creator of a new genre and declared him to have made Schubert's songs the property of cultured pianists. Moreover, Liszt himself designated his work with Berlioz's Symphonie fantastique and the symphonies of Beethoven "Partitions de piano": literally, piano scores. As is well known, concepts of genre in general create problems for musicologists; musical arrangements add a new dimension of difficulty to the problem. Native American Elements in Piano Repertoire by the Indianist and Present-Day Native American Composers

My paper defines and analyzes the use of Native American elements in classical piano repertoire that has been composed based on Native American tribal melodies, rhythms, and motifs. First, a historical background and survey of scholarly transcriptions of many tribal melodies, in chapter 1, explains the interest generated in American indigenous music by music scholars and composers. Chapter 2 defines and illustrates prominent Native American musical elements. Chapter 3 outlines the timing of seven factors that led to the beginning of a truly American concert idiom, music based on its own indigenous folk material. Chapter 4 analyzes examples of Native American inspired piano repertoire by the "Indianist" composers between 1890-1920 and other composers known primarily as "mainstream" composers. Chapter 5 proves that the interest in Native American elements as compositional material did not die out with the end of the "Indianist" movement around 1920, but has enjoyed a new creative activity in the area called "Classical Native" by current day Native American composers. Networking of North and West Texas Superintendents

This study examined the professional networking of North and West Texas public school superintendents. It looked at how these superintendents professionally network, use professional organizations in networking, and how they extend opportunities beyond the organizations to gain knowledge and information about their demanding and stressful responsibilities. Lastly, it looked at superintendents in the field on whom others rely for knowledge and understanding. Surveys were mailed out to 443 North and West Texas public schools. Only the superintendents from those districts were asked to complete the survey. This limitation was desired to restrict the population to only the superintendents of schools, thus focusing the study on the professional networking of only superintendents. Three hundred sixty (360) superintendents responded to the survey, a return rate of 81.3%. This research concluded that superintendents professionally network by communicating through monthly meetings, organizational conferences or meetings, or email. Their networks are facilitated through communication, contacts, location, longevity, and organizational associations. These organizations provide the superintendent's primary network contact. An Observation of Early Parent-Infant Social Interactions in Relation to the Emergence of Joint Attention in the Natural Environment

Early interactions between parents and infants are thought to be critical of later development. In particular joint attention has been an area of research and investigations. This study sought to measure joint attention behaviors in infants from 5 to 33 weeks of age under naturalistic conditions: in the home with the mother as the interaction partner given no instructions. Videotapes of the infant-parent interactions were observed and data were collected on behaviors related to joint attention. Given observations occur at younger ages than other studies considered, engagement data results indicate increasing trends for 3 of the 5 infants observed while the direction of infant gaze results indicate patterns consistent with descriptions currently in the literature. Parent behavior data indicate high levels of support in engaging infant attention. Furthering an understanding of joint attention by observing at earlier ages in infant development may be useful in informing teaching programs for infants who have not developed joint attention skills.

On Their Own: How Thirty-One Tribal Colleges Address Five Educational Concepts

This qualitative research, specifically a content analysis of 31 tribal colleges' mission statements and curricula, examined how the colleges' curricula aligned with the five educational concepts suggested in the colleges' mission statements. Cajete's (1994) seven foundations to indigenous thinking proved to be a major theoretical framework which provided a worldview for tribal learning. The study concluded that whereas the five educational concepts aligned between mission statements and curricula, the curricula emphasized culture, tribal community, and academic success at a greater level than mission statements indicated. Further, tribal colleges' curricula did not emphasize economic concepts as the mission statements indicated. A particular finding suggests that tribal colleges' are investing in environmental studies programs, thus increasing their intellectual capacity to protect their environmental interests while promoting indigenous thinking and community learning across all academic disciplines. Considerable implications include that an increase of American Indian environmental studies graduates may have a positive impact on environmental justice matters as well as the ability to promote new agricultural technologies. Additional implications include how mainstream universities will adapt to an increase of native students studying the sciences rather than liberal arts.

Optimal design of Dutch auctions with discrete bid levels.

The theory of auction has become an active research area spanning multiple disciplines such as economics, finance, marketing and management science. But a close examination of it reveals that most of the existing studies deal with ascending (i.e., English) auctions in which it is assumed that the bid increments are continuous. There is a clear lack of research on optimal descending (i.e., Dutch) auction design with discrete bid levels. This dissertation aims to fill this void by considering single-unit, open-bid, first price Dutch auctions in which the bid levels are restricted to a finite set of values, the number of bidders may be certain or uncertain, and a secret reserve price may be present or absent. These types of auctions are most attractive for selling products that are perishable (e.g., flowers) or whose value decreases with time (e.g., air flight seats and concert tickets) (Carare and Rothkopf, 2005). I began by conducting a comprehensive survey of the current literature to identify the key dimensions of an auction model. Overgeneral Memory and Posttraumatic Stress Disorder in Adults Exposed to Family Violence

Childhood exposure to familial violence increases risk for adult pathology, namely posttraumatic stress disorder (PTSD) and depression. Primary PTSD symptoms of hyperarousal and avoidance are implicated in overgeneral memory (OGM) theory in prior research. Individuals with trauma history tend to report OGMs, or non-specific autobiographical memories, perhaps to avoid unpleasant arousal elicited by recalling specific events. OGM, PTSD, depression, and arousal were assessed in adults with and without familial violence history. Arousal was measured via galvanic skin response (GSR) during an autobiographical memory task (AMT), requiring memory recall in response to emotionally-valenced cue words. Familial violence history was linked to higher incidence of PTSD symptoms. Childhood psychological violence was predictive of adult PTSD. Rates of depression, OGM, and arousal did not significantly vary by violence history. Significant gender differences were found relating to type of violence exposure and adult functioning. Research limitations, clinical implications, and future research suggestions are discussed.

This dissertation is a performance guide for the euphonium solos Pearls I and Pearls II, written by Roland Szentpali. This performance guide allows performers to better understand the jazz styles within each movement and provides them with a resource for performing these particular pieces as well as other jazz influenced pieces. This performance guide is specific to euphonium repertoire and written for euphonium performers and educators. This is also a resource for a solo work in the repertoire that is performed regularly as well as a new work that will soon be published. A brief history of the development of euphonium repertoire and the influence of jazz is provided. The performance guide analyzes each movement and provides insight to extended techniques, common performance problems, errata, and jazz styles that each movement is based on. The guide also provides several suggestions for interpretation and for performance preparation. Illustrations from the scores have been provided for each example.

A Performer's Analysis of Dominick Argento's Miss Havisham's Wedding Night

Dominick Argento's Miss Havisham's Wedding Night is the least explored of his artistic output. A monodrama in one act for soprano, Miss Havisham's Wedding Night contains some of Argento's most beautiful and challenging music of his compositional output. The purpose of a detailed analysis of the structure and content of Argento's Miss Havisham's Wedding Night is to facilitate the solo vocal performer's interpretation. Argento's setting of Miss Havisham's Wedding Night is unique in that he musically translates the manic psychological state of the literary character. Argento structured the one act opera in such a manner that the music would illuminate the text and the audience might connect with the unstable psychological episodes and outbursts demonstrated by Miss Havisham. To that end, each section and phrase has its own psychological motivation, which in turn demands a varied musical and dramatic interpretation. Utilizing selected scenes from Miss Havisham's Wedding Night, the researcher will analyze Argento's musical manifestation of Dickens's literary work. This research will include an investigation into the manner in which Argento uses the shape of melody and the musical phrase along with the harmonic materials to enhance the text and dramatic content. This quantitative study utilized secondary self-reported data from the 2008 administration of the Cooperative Institutional Research Program (CIRP) Freshman Survey from two Texas public universities to investigate the pre-college demographic, academic, attitude, behavioral, and familial factors that may relate to students' self-reported political identities. The study design was correlational regarding the relationship of the demographic, academic, attitude, behavioral, and familial independent variables to the dependent variable of the students' political identities. ANOVA main effects for the independent variables were calculated, and statistical significance required the p < .05 level. The statistically significant demographic factors were native English-speaking status; enrollment status; citizenship status; religious preference; and race. The statistically significant academic factor was intended major. The statistically significant attitude factors were opinions regarding social issues such as criminal rights; abortion rights; the death penalty; the legalization of marijuana; homosexual relationships and same-sex marriage; racial discrimination; income taxes; affirmative action; military spending and voluntary military service; gun control; the environment; national health care; immigration; personal success; political dissent; and free speech.
