Adequacy and Equity: How the Texas Supreme Court's Perceptions Have Changed Over the Past 50 Years

The purpose of this study identifies state court cases involving public school finance specifically related to adequacy and equity in funding. Results address how state court cases have challenged the constitutionality of school finance in the United States, including Texas, over the last 50 years. The study further shows how the decisions from previous cases have influenced the Supreme Court of Texas decision in the Texas Taxpayer & Student Fairness litigation.

Age Friendly Cities: The Bureaucratic Responsiveness Effects on Age Friendly Policy Adoption

Challenging a long-held attachment to the medical model, this research develops a cultural model placing local governments at the center of policy making and refocusing policy attention on mobility, housing, the built environment and services. To examine the phenomenon of age friendly policy adoption by cities and the magnitude of adoption, a 21-question web-based survey was administered to a sample of 1,050 cities from the U.S. Census having a population over 10,000 and having at least 14% of their population aged 65 years and over. The goal of the questionnaire was to help identify what kind of policy objectives cities establish to facilitate the opportunity for older adults to live healthy and independent lives in their communities as they age. Multiple linear and ordinal regression models examined the likelihood of policy action by cities and provide evidence as to why some cities support more age friendly policy actions than others. Evidence illustrates theoretical advancement providing support for a cultural model of aging. The cultural model includes multiple factors including bureaucratic responsiveness reflected in the management values of the administration. An Analysis of Litigation against Kansas Educators and School Districts under the Kansas Tort Claims Act

This dissertation examines the significance of the Kansas Tort Claims Act of 1979 on state of Kansas court decisions in litigation against Kansas school districts and their employees. Through providing a historical perspective of the adoption and abolishment of the doctrine of sovereign immunity in the United States, which subsequently led to the enactment of the Federal Tort Claims Act, and ultimately led to the Kansas Tort Claims Act, the researcher analyzes pertinent case law and scholarly commentary pertaining to school negligence litigation. The goal of the analysis is to answer the following research question: How have Kansas state courts interpreted the Kansas Tort Claims Act in litigation against state school districts and their employees? Although the KTCA provides citizens with a vehicle for redress against governmental entities by virtue of tort claims, the KTCA also provides immunities from liability for governmental entities and their employees under exceptions to the KTCA. Most notably, the discretionary function exception and the recreational use exception are two exceptions to liability applied in a significant number of tort cases against Kansas school districts and employees. Assessing Rainfall Interception by Urban Tree Canopies in Denton, Texas

Rainfall interception is one mechanism by which tree canopies can reduce surface runoff in urban areas. The objectives of this research were to: 1) quantify rainfall interception by urban tree canopies, and 2) determine the influence of vegetation and microenvironmental factors on rainfall interception rates. In the city of Denton, Texas, 30 mature post oak (Quercus stellata) and blackjack oak (Quercus marilandica) trees were selected for study. Trees were assigned to one of three categories: clusters of trees on greenspace (CG), isolated trees on greenspace (IG), and isolated trees surrounded by pavement (IP). Throughfall (the volume of water that travels through the canopy and reaches the soil surface) collectors were placed beneath these trees and rainfall collectors were placed in nearby open areas. Throughfall and rainfall were collected daily from 19 March to 4 July. Interception was calculated as the difference between throughfall and gross rainfall. Over the study period, there were 27 days with measurable rainfall; daily rainfall ranged from 1-51 mm. Over the sampling period, rainfall interception for individual trees ranged from -10% to 49%, indicating high spatial variability in interception. Becoming Successful in Education: Beating the Odds, Despite a Background Entrenched in Poverty

The purpose of this study was to investigate the impact of three relationships on academic achievement in mathematics in students of poverty. The three factors that were examined included: teacher-student relationships, parent-student relationships and peer- student relationships. The driving question for the research was as follows: Do external factors such as teacher-student relationships, parent-student relationships and peer-student relationships lead to academic success for students of poverty? The study employed a non-experimental, quantitative approach and utilized longitudinal data from a national database High School Longitudinal Study (HSLS) used a sample of 944 public and private high schools across the USA. A total 0f 28,240 were represented in the survey. Of these 28,240 students, 2641 were used in this study as identified by parental income below the poverty threshold. The outcome of the study indicated that there was little or no correlation between the three relationships and mathematics achievement (academic success). Correlations between the dependent variable (math achievement) and the independent variables even though some were statistically significant their weights had no concrete significance. The study recommends that several initiatives can be instated in schools to support and enhance academic achievement in students of poverty.

Bodies of Evidence: A Qualitative Analysis of the Lived Experiences of Female Central American and Mexican Asylum Seekers in Dallas

This work addresses the experiences of female asylum seekers from Central and Mexico currently living in Dallas, TX. The main purpose is to analyze how these women engage in the gendered processes of both migrating to and accessing legal resources and protection within the United States. As the women move through male-dominated spaces in their home country, the borderlands, and the asylum court they must challenge the patriarchal institutions that attempt to silence their narratives and criminalize their bodies. Their physical wounds become evidence in the courtroom, while outside of the courtroom their movements are monitored and tracked through multiple mechanisms of state control: ankle monitors, detention centers, ICE check-ins. They face intersectional discrimination as they are targeted as both women and immigrants. However, these female asylum seekers are not victims. They constantly display agency as they represent themselves in court, find solace in their faith, and form community with each other.

The Civic Roles of Neighborhood Associations in Seoul, Korea: Implications for Urban Governance

This dissertation answers three research questions: "What differences and similarities exist among neighborhood associations in the United States, Japan, and Seoul, South Korea?," "What are the civic roles of neighborhood associations in apartment complexes in Seoul, South Korea?," and "What factors promote neighborhood associations to play civic roles in urban governance?" To answer the first question, this research analyzes the purposes, governance structures, roles, and legal substance of neighborhood associations by reviewing previous studies, public and legal documents, court cases in the U.S., and by conducting interviews. To answer the second and the third questions, a 2016 survey, "Understanding the Roles of Neighborhood Associations in Urban Governance" was conducted with 154 representatives of neighborhood associations in Seoul. Social capital theory, government failure theory, and third party government theory were used to create hypotheses that test proposed relationships about neighborhood interactions, community characteristics, and the civic roles played by neighborhood associations. The findings show that neighborhood associations have adopted several roles including service provider, partner in public service delivery for local government, and advocate for residents in urban governance. Community College Student Retention and Completion based on Financial Expenditures and Hispanic-Serving Status

Despite declining community college funding being allocated increasingly on the basis of student success, U.S. community college student retention and completion rates over the past decade have either remained steady or decreased, especially for Latino students. Using descriptive statistics and multiple regression models with secondary data procured from the Integrated Postsecondary Education Data System (IPEDS), I analyzed student success rates—full time student retention and completion rates—based on community college financial allocations and Hispanic-serving institution (HSI) status. To equitably analyze community colleges in the sample (n = 909), I separated them into four groups based on institutional size as defined by the Carnegie Classification. Descriptive results indicated that instructional divisions spent an average of 43% of the college's total allocated budget—often more than three times the allocated budget of any other division. Regression results indicated that instructional expenditures had the most consistent impact on student success regardless of college size and that scholarship expenditures and academic support expenditures generally had a negative impact on student retention and completion rates. Regarding Latino student success in particular, findings indicated that the manner in which colleges allocated their funds impacted only small and medium-sized community colleges. Determinants of Corporate Governance Choices: Evidence from Listed Foreign Firms on U.S. Stock Exchanges

This study analyzes corporate governance practices of foreign (non-U.S.) issuers listed on the New York Stock Exchange (NYSE) and Nasdaq. Specifically, I examine the extent to which these foreign issuers voluntarily comply with U.S. stock exchange corporate governance requirements applicable to domestic issuers. My sample consists of 201 foreign companies primarily domiciled in Brazil, China, Israel, and the United Kingdom. I find that 151 (75 per cent) of the sample firms do not elect to comply with any of the U.S. corporate governance requirements. Logistic regression analysis generally supports the hypotheses that conformance with U.S. GAAP and percentage of managerial ownership are positively associated, and that percentage ownership by major shareholders is negatively associated with foreign firms electing to comply with U.S. corporate governance rules. This evidence is relevant for regulators and investors.

Don't Frack With Denton chronicles the ground-breaking movement to ban hydraulic fracturing in the city of Denton, Texas by combining observational location shooting with extensive sit-down interviews and carefully negotiated subject-filmmaker relationships to create a safe and comfortable space for thoughtful reflection and criticism of a complex social movement who's activities span several years and many individuals. The result is a long-form documentary that is unapologetically in solidarity with this movement's goals while simultaneously maintaining enough editorial independence and critical distance to allow the activists themselves to honestly evaluate their decision-making, tactics and interpersonal relationships in ways that will provide insight and instruction to similar movements around the country and the world.

Effects of Bring Your Own Device Initiatives Related to Instructional Planning and the Classroom Environment in Two Texas High Schools

This study was an examination of 20 North Texas high school teachers' perceptions about the effects of bring your own device (BYOD) initiatives on instructional planning and classroom environment. The BYOD initiative at two high school campuses was studied through a qualitative approach, i.e. a collective case study. Data were collected through interviews, classroom observations, and reviews of participants' lesson planning documents. The findings indicated teachers had to plan for inequitable technology access, technology support, effective classroom management, and relevant content to support student learning effectively. Teachers participated in professional development focused on planning for student devices, effective use of instructional technology, and classroom management during this type of instruction. Results revealed that, during instruction that included students' devices, teachers believed student engagement and content retention were greater. Observation data also indicated that students were more engaged in the instruction. The interviews and classroom observations indicated that students assumed a more active role in their learning during these lessons, and teachers facilitated and provided more support as needed. Effective planning and classroom management were identified as key components in the success of this type of initiative. The Effects of Resilience and Self-Compassion on Symptoms of Stress and Growth Resulting from Combat Exposure in Service Members

The current study examined the impact of resilience and self-compassion on the relationship between combat exposure and psychological outcomes, specifically post-traumatic stress and post-traumatic growth. Service members and veterans with combat exposure (N = 143) completed an online survey, through which they were administered a Background Questionnaire, the Combat Exposure Scale, the PTSD Checklist for DSM-5, the Posttraumatic Growth Inventory, the Connor-Davidson Resilience Scale, and the Self-Compassion Scale. Results of a path analysis revealed a positive direct effect of combat exposure on post-traumatic stress symptoms and post-traumatic growth and a negative direct effect of self-compassion on post-traumatic stress symptoms. Furthermore, self-compassion moderated the relationship between combat exposure and post-traumatic growth. Implications of these findings and future directions for research are discussed.

Evolution and Devolution of Inpatient Psychiatric Services: From Asylums to Marketing Madness and Their Impact on Adults and Older Adults with Severe Mental Illness

I examined the factors that led to the rise and fall of psychiatric hospitals and its impact on two select groups of individuals: adults and older adults with severe mental illness. To explore the reasons behind these fluctuations, the State of Texas was used as a case study. Additionally, the fluctuations occurred for different reasons in public vs. for-profit investor-owned psychiatric hospitals. Using an investor-owned psychiatric hospital organization as a case study, I investigated the differences in factors that influenced the growth and/or demise in public vs. investor-owned psychiatric hospitals. Evolution and devolution of psychiatric hospitals was assessed during select time periods: 1700 to1930, 1940 to1970, 1980 to 2000, and 2000 to present. Time period selections were relevant to the important drivers of the span of time that influenced the psychiatric hospitals. Historical review and trend analysis was used to identify the total number of psychiatric hospitals and/or total number of psychiatric hospital beds and psychiatric hospitals by type. Examining Help-Seeking Intentions of Chinese Individuals: A Path Analysis

Utilizing the theory of planned behavior, I examined the variables that affect Chinese individuals' help-seeking intention. A total of 251 Chinese individuals participated in this study. Results showed that the variables in the theory of planned behavior accounted for 16% of the variance in help-seeking intention. Specifically, attitude (r = .22, p < .001) and perceived behavioral control (r = .22, p < .001) were found to be significant predictors of help-seeking intention. Based on these results, mental health professionals can design outreach interventions, such as psychoeducational programs, to improve Chinese individuals' help-seeking attitude and perceived behavioral control in an attempt to increase mental health service utilization. Additionally, counselors can discuss with clients' their attitude and perceived behavioral control regarding seeking counseling in an attempt to assist clients in being committed to the counseling process.

Impact of the Clery Act: An Examination of the Relationship between Clery Act Data and Recruitment at Private Colleges and Universities

The problem this study addressed is the relationship between Clery Act crime data and student recruitment at private colleges and universities. For this quantitative study, I used secondary data from the Department of Education and the Delta Cost Project (2013) to conduct ordinary least squares regression analyses to determine the predictive ability of institutional characteristics, specifically the total number of crime incidents reported in compliance with the Clery Act, on the variance in number of applications and applicant yield rate at private four-year institutions in the United States. Findings showed that the total number of reported incidents was a significant positive predictor of the total number of applications. Conversely, findings also showed that the total number of incidents had a significant negative impact on institutional yield rates. An implication of this study is that although crime statistics required by the Clery Act may not serve as variables used in the student application process, they are part of numerous variables used in the student's decision to enroll at a particular school. The findings highlight the importance of prioritizing and investing in safety and security measures designed to reduce rates of crime; especially for private, enrollment-driven institutions of higher education.

In Defense of Wilderness: A Documentation of the Social and Cultural Aspects of the Boundary Waters Canoe Area (BWCA)

My thesis research provides an alternative argument for the protection of the wilderness that extends far beyond that of the purely biological and instead looks at wilderness for the intrinsic value, focusing on the social and cultural aspects. Through an ethnographic approach, I uncovered the how, why, and in what context people connect with wilderness and how people lean on these experiences. Through analysis of the interviews and data that was collected, I was able to identify tangible and intangible values associated with wilderness exploration and understand how these social and cultural aspects manifest themselves in people's day-to-day lives.

The Lived Experiences of African American Community College Achievers in Developmental Education

Developmental education courses are typically defined as courses offered at postsecondary institutions below college level instruction. More than 60% of community college students are deemed non-college ready and required to enroll in non-credit bearing developmental education courses. Research shows that developmental education can be either a bridge or barrier to degree attainment for racial/ethnic minority students, particularly African Americans, who require developmental education more than any other racial/ethnic groups. The purpose of this study was to explore the lived experiences of African American community college achievers who were required to enroll in two or more developmental education courses. Achievers were defined as students who passed all developmental education courses and were enrolled in their final college gateway course at the time of the interviews. Utilizing a phenomenological approach and anti-deficit framework, 15 semi-structured interviews were conducted to capture the essence of how African American achievers described, interpreted, and understood their journeys from developmental education to becoming college ready to completing college level courses. Twelve participants were female and three were male, ranging from 20 to 52 years old. Results revealed seven major themes. Miranda Comprehension and Reasoning: An Investigation of Miranda Abilities in Adult Inpatients

Nearly 700,000 suspects with mental disorders are arrested and Mirandized each year. The current study systematically examined the effects of cognitive deficits and psychological symptoms on both Miranda comprehension and reasoning. The current sample was comprised of 85 adult psychiatric inpatients recruited from University Behavioral Health (UBH), a private psychiatric hospital in North Texas. Unexpectedly, most inpatients demonstrated pervasive deficits in their immediate recall of a representative Miranda warning, omitting approximately four-fifths of its content. In addition, the majority of inpatients evidenced damaging errors in their reasoning about waiver decisions. As a result, 64.7% waived and subsequently confessed after only a 3-5 minute interrogation. Interestingly, impaired verbal ability but not the severity of their symptoms predicted greater deficits in Miranda comprehension.

"On the Precipice in the Dark": Maryland in the Secession Crisis, 1860-1861

This dissertation is a study of the State of Maryland in the secession crisis of 1860-1861. Previous historians have emphasized economic, political, societal, and geographical considerations as the reasons Maryland remained loyal to the Union. However, not adequately considered is the manner in which Maryland understood and reacted to the secession of the Lower South. Historians have tended to portray Maryland's inaction as inevitable and reasonable. This study offers another reason for Maryland's inaction by placing the state in time and space, following where the sources lead, and allowing for contingency. No one in Maryland could have known that their state would not secede in 1860-61. Seeing the crisis through their eyes is instructive. It becomes clear that Maryland was a state on the brink of secession, but its resentment, suspicion, and anger toward the Lower South isolated it from the larger secession movement. Marylanders regarded the Lower South's rush to separate as precipitous, dangerous, and coercive to the Old Line State. A focus on a single state like Maryland allows a deeper, richer understanding of the dynamics, forces, and characteristics of the secession movement and the federal government's response to it. A Panel Analysis of Institutional Finances of Medical Residencies at Non-University-Based Independent M.D. Granting Medical Schools in the United States

Traditionally, medical residency positions have been primarily funded by the federal government. However, due to declining governmental funding support over time, medical schools have resorted to fund these programs through other means such as clinical fees and payments for services. This change has affected the number and types of residencies available to medical school graduates. The purpose of this study was to measure how the availability of fiscal resources shape mission-related outputs, particularly medical residency positions at medical schools. Using academic capitalism as the theoretical framework provided a lens through which to examine how federal policies have shaped the availability and funding of medical residencies today at the institutional level. This concept has been studied in traditional colleges and universities and how they balance mission and money, but less so in the context of medical schools. This study used a fixed effect panel analysis to study the impact of selected variables over a 10-year period on financing of medical residencies. Findings included that tuition revenues, paid for by undergraduate medical students, are increasingly funding medical residency positions.
