Combating Nuclear Smuggling: DHS's Phase 3 Test Report on Advanced Portal Monitors Does Not Fully Disclose the Limitations of the Test Results

A letter report issued by the Government Accountability Office with an abstract that begins "The Department of Homeland Security's (DHS) Domestic Nuclear Detection Office (DNDO) is responsible for addressing the threat of nuclear smuggling. Radiation detection portal monitors are part of the U.S. defense against such threats. In 2007, Congress required that funds for new advanced spectroscopic portal (ASP) monitors could not be spent until the Secretary of DHS certified that these machines represented a significant increase in operational effectiveness over currently deployed portal monitors. In addition to other tests, DNDO conducted the Phase 3 tests on ASPs to identify areas in which the ASPs needed improvement. GAO was asked to assess (1) the degree to which the Phase 3 test report accurately depicts the test results and (2) the appropriateness of using the Phase 3 test results to determine whether ASPs represent a significant improvement over current radiation detection equipment. GAO also agreed to provide its observations on special tests conducted by Sandia National Laboratories (SNL)."

Correspondence issued by the Government Accountability Office with an abstract that begins "To help Medicare beneficiaries manage the rising cost of prescription drugs, Congress passed the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (MMA), which established the outpatient prescription drug benefit known as Medicare Part D. The benefit was first available in January 2006, and that year it provided federally subsidized prescription drug coverage for nearly 28 million beneficiaries at a cost of $47.4 billion--almost 12 percent of total Medicare spending. The Centers for Medicare & Medicaid Services (CMS), part of the Department of Health and Human Services (HHS), manages and oversees the Part D program. Part D sponsors--entities that enter into contracts with Medicare--administer the benefit and compete for beneficiary enrollment. To provide coverage, the sponsors often enter into contractual relationships with pharmacy benefit managers (PBM), drug manufacturers, and retail pharmacies, among others. The Part D program relies on sponsors to generate prescription drug savings, in part through their ability to negotiate price concessions, such as rebates and discounts, with these entities. Digital Television Transition: Majority of Broadcasters Are Prepared for the DTV Transition, but Some Technical and Coordination Issues Remain

A letter report issued by the Government Accountability Office with an abstract that begins "The Digital Television Transition and Public Safety Act of 2005, requires all full-power television stations in the United States to cease analog broadcasting by February 17, 2009, known as the digital television (DTV) transition. Prior to the transition date, the television broadcast industry must take a series of actions to ensure that over-the-air programming will continue to be available to television households once the transition is complete. For example, broadcast stations must obtain, install, and test the necessary equipment needed to finalize their digital facilities, and some stations will need to coordinate the movement of channels on the day the analog signal ceases transmission. This requested report examines (1) the status of broadcast stations in transitioning to digital, (2) the extent to which broadcast stations are encountering issues, and (3) the actions the Federal Communications Commission (FCC) has taken to guide broadcasters in the digital transition. To address these issues, GAO conducted a Web-based survey of full-power television broadcast stations. Since 1990 DOE contract management has been on GAO's list of programs at high risk for fraud, waste, abuse, and mismanagement. In 2003 DOE's Office of Science (Science) unveiled its 20-year plan to acquire and upgrade potentially costly research facilities. In light of DOE's history and the potential cost of this ambitious plan, GAO was asked to examine Science's project management performance. GAO determined (1) the extent to which Science has managed its projects within cost and schedule targets, (2) the factors affecting project management performance, and (3) challenges that may affect Science's future performance. Many of these aging tanks have already leaked waste into the soil. Meanwhile, DOE's planned process for emptying the tanks and treating the waste--mixing it with molten glass and solidifying it in canisters for storage--has experienced delays, lengthening the time the tanks will store waste and intensifying concerns about the tanks' viability during a long cleanup process. This report addresses (1) the condition, contents, and long-term viability of Hanford's underground tanks; (2) DOE's strategy for managing the tanks; and (3) the extent to which DOE has weighed the risks and benefits of its tank management strategy against the growing costs of that strategy. One such tool is Section 311 of the USA PATRIOT Act of 2001, which authorizes the Secretary of the Treasury (Treasury) to prohibit U.S. financial institutions from maintaining certain accounts for foreign banks if they involve foreign jurisdictions or institutions found to be of primary money laundering concern. To make this finding, Treasury examines several factors and generally issues a proposed rule announcing its intent to apply Section 311 restrictions. A letter report issued by the Government Accountability Office with an abstract that begins "After a 1975 fire at the Browns Ferry nuclear plant in Alabama threatened the unit's ability to shut down safely, the Nuclear Regulatory Commission (NRC) issued prescriptive fire safety rules for commercial nuclear units. However, nuclear units with different designs and different ages have had difficulty meeting these rules and have sought exemptions to them. In 2004, NRC began to encourage the nation's 104 nuclear units to transition to a less prescriptive, risk-informed approach that will analyze the fire risks of individual nuclear units. GAO was asked to examine (1) the number and causes of fire incidents at nuclear units since 1995, (2) compliance with NRC fire safety regulations, and (3) the transition to the new approach. GAO visited 10 of the 65 nuclear sites nationwide, reviewed NRC reports and related documentation about fire events at nuclear units, and interviewed NRC and industry officials to examine compliance with existing fire protection rules and the transition to the new approach."

Correspondence issued by the Government Accountability Office with an abstract that begins "Improving collaboration and health resource sharing between the Department of Veterans Affairs (VA) and the Department of Defense (DOD) has been the focus of numerous efforts by Congress and the executive branch for more than two decades. In 1982, Congress passed the Veterans' Administration and Department of Defense Health Resources Sharing and Emergency Operations Act (Sharing Act), which authorized VA and DOD health care facilities to partner and enter into sharing agreements to buy, sell, and barter medical and support services. Since then, Congress has passed additional legislation to continue to promote VA and DOD health resource sharing. However, in previous work we have pointed out continuing barriers to such efforts, including incompatible computer systems that affect the exchange of patient health information, inconsistent reimbursement and budgeting policies, and burdensome processes for approving agreements between the departments. On May 28, 2001, the President established the 15-member President's Task Force to Improve Health Care Delivery for Our Nation's Veterans. Because ensuring compliance is a challenge, in part because offenders may move frequently, policy makers are considering a role for motor vehicle agencies. In response to section 636 of the Adam Walsh Child Protection and Safety Act of 2006 (the Walsh Act) and as discussed with congressional committees, this report identifies (1) the various driver's license-related processes that states are using to encourage registration or provide additional monitoring of convicted sex offenders; (2) the level of modifications to states' information technology (IT) capabilities that would be needed, and the key cost factors involved, if a federal law were to require the screening of individuals against the respective state's sex offender registry and the Federal Bureau of Investigation's (FBI) National Sex Offender Registry before issuing a driver's license; and (3) other factors that could affect successful implementation of this type of screening program. Aboveground Oil Storage Tanks: More Complete Facility Data Could Improve Implementation of EPA's Spill Prevention Program

A letter report issued by the Government Accountability Office with an abstract that begins "Oil leaks from aboveground tanks have contaminated soil and water, threatening human health and wildlife. To prevent damage from oil spills, the Environmental Protection Agency (EPA) issued the Spill Prevention, Control, and Countermeasure (SPCC) rule in 1973. EPA's 10 regions inspect oil storage facilities to ensure compliance with the rule. EPA estimates that about 571,000 facilities are subject to this rule. Some states also regulate oil storage tanks. GAO determined (1) how EPA regions implement the SPCC program, (2) the data EPA has to implement and evaluate the program, and (3) whether some states' tank programs suggest ways for EPA to improve its program. GAO surveyed all 10 EPA regions and interviewed officials in EPA and six states selected on the basis of experts' recommendations, among other criteria."

This is GAO's first report in response to the Act's requirement for GAO to annually (1) determine the extent to which lobbyists can demonstrate compliance with the Act by providing support for information on their registrations and reports, (2) describe challenges identified by lobbyists to complying with the Act, and (3) identify the process for referring cases to the Department of Justice and the resources and authorities available to effectively enforce the Act. GAO reviewed a random sample of 100 reports filed by lobbyists during the first quarter of calendar year 2008. This methodology allowed GAO to generalize to the population of 17,801 reports filed. A letter report issued by the Government Accountability Office with an abstract that begins "The federal government is the nation's single largest energy consumer, spending approximately $17 billion in fiscal year 2007. A number of statutes and executive orders have established and revised goals directing agencies to reduce energy consumption and greenhouse gas emissions--such as carbon dioxide, which results from combustion of fossil fuels and natural processes, among other things--and increase renewable energy use. GAO was asked to determine the extent to which (1) federal agencies met energy efficiency, greenhouse gas emission, and renewable energy goals in fiscal year 2007; (2) federal agencies have made progress in each of these areas in the recent past; and (3) six selected agencies are poised to meet energy goals into the future. For this review, GAO, among other things, conducted site visits for six agencies and reviewed the Department of Energy's (DOE) annual reports to Congress on federal energy management."

A letter report issued by the Government Accountability Office with an abstract that begins "The Department of Defense (DOD) relies on a global network of DOD and non-DOD infrastructure so critical that its unavailability could have a debilitating effect on DOD's ability to project, support, and sustain its forces and operations worldwide. DOD established the Defense Critical Infrastructure Program (DCIP) to assure the availability of mission-critical infrastructure. GAO was asked to evaluate the extent to which DOD has (1) incorporated aspects of DCIP into its exercises in the Transportation Defense Sector and (2) developed DCIP training standards departmentwide and made installation personnel aware of existing DCIP expertise. GAO examined a nonprojectable sample of 46 critical assets representing the four military services, five combatant commands, and selected installations within five defense sectors. GAO reviewed relevant DOD DCIP guidance and documents and interviewed cognizant officials regarding DCIP exercises, training, and awareness."
