Department of Homeland Security: Billions Invested in Major Programs Lack Appropriate Oversight

A letter report issued by the Government Accountability Office with an abstract that begins "In fiscal year 2007, the Department of Homeland Security (DHS) obligated about $12 billion for acquisitions to support homeland security missions. DHS's major investments include Coast Guard ships and aircraft; border surveillance and screening equipment; nuclear detection equipment; and systems to track finances and human resources. In part to provide insight into the cost, schedule, and performance of these acquisitions, DHS established an investment review process in 2003. However, concerns have been raised about how well the process has been implemented--particularly for large investments. GAO was asked to (1) evaluate DHS's implementation of the investment review process, and (2) assess DHS's integration of the investment review and budget processes to ensure major investments fulfill mission needs. GAO reviewed relevant documents, including those for 57 DHS major investments (investments with a value of at least $50 million)--48 of which required department-level review through the second quarter of fiscal year 2008; and interviewed DHS headquarters and component officials."

A letter report issued by the Government Accountability Office with an abstract that begins "Many U.S. corporations operate globally and have foreign subsidiaries. The subsidiaries may be created, for example, to take advantage of sales opportunities or favorable labor conditions. In some cases they may be used to reduce taxes. GAO was asked to update its 2004 report on large federal contractors with subsidiaries in countries sometimes called tax havens because of low taxes and a general lack of transparency. In response, GAO determined how many of the 100 largest publicly traded U.S. corporations and the 100 largest publicly traded U.S. federal contractors have subsidiaries in jurisdictions listed as tax havens or financial privacy jurisdictions. GAO (1) combined three lists of such jurisdictions created by governmental, international, and academic sources and (2) identified large publicly traded U.S. corporations and federal contractors and the locations of their subsidiaries using the Fortune 500 list, a federal contracting Web site, and a Securities and Exchange Commission (SEC) database."

The Department of Defense (Defense), through its Combined Security Transition Command-Afghanistan (CSTC-A), directs U.S. efforts to develop the Afghan National Army (ANA) and, in conjunction with the Department of State (State), the Afghan National Police (ANP). To follow up on recommendations from GAO's 2005 report on the ANSF, GAO analyzed the extent to which U.S. plans for the ANSF contain criteria we recommended. GAO also examined progress made and challenges faced in developing the ANA and ANP. To address these objectives, GAO reviewed Defense, State, and contractor documents and met with cognizant officials. A letter report issued by the Government Accountability Office with an abstract that begins "The Voting Rights Act of 1965, as amended, contains, among other things, provisions designed to protect the voting rights of U.S. citizens of certain ethnic groups whose command of the English language may be limited. The Department of Justice (DOJ) enforces these provisions, and the Election Assistance Commission (EAC) serves as a national clearinghouse for election information and procedures. The Fannie Lou Hamer, Rosa Parks, and Coretta Scott King Voting Rights Act Reauthorization and Amendments Act of 2006 mandated that GAO study the implementation of bilingual voting under Section 203 of the act. This report discusses (1) the ways that selected jurisdictions covered under Section 203 of the Voting Rights Act have provided bilingual voting assistance as of the November 2006 general election and any subsequent elections through June 2007, and the challenges they reportedly faced in providing such assistance; and (2) the perceived usefulness of this bilingual voting assistance, and the extent to which the selected jurisdictions evaluated the usefulness of such assistance to language minority voters. Correspondence issued by the Government Accountability Office with an abstract that begins "The Expeditionary Fire Support System (EFSS)--which consists of two kinds of motorized vehicles, a 120-mm mortar, an ammunition trailer, and fire direction equipment--is being developed to meet the United States Marine Corps' need for a weapon system that can be carried inside the MV-22 Osprey to support assault operations. The Marine Corps Operational Test and Evaluation Activity (MCOTEA), the independent test agency for the Marines, conducted initial operational testing and evaluation of the EFSS from May to July 2007, and reported in September 2007, among other things, that it experienced several safety, performance, reliability, and mechanical problems. We briefed Congress on these and other issues related to the EFSS in September 2007. Subsequently, at congressional request, the Marine Corps delayed full-rate production of the EFSS until after GAO reported on the system. In December 2007, we issued our report, which described the system's safety, performance, reliability, and mechanical problems. Correspondence issued by the Government Accountability Office with an abstract that begins "The Environmental Protection Agency (EPA) estimates that one in four Americans lives within 3 miles of a hazardous waste site. To clean up these highly contaminated sites, the Congress established the Superfund program under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) in 1980. EPA, the principal agency responsible for administering the Superfund program, has since identified more than 47,000 hazardous waste sites potentially requiring cleanup actions and has placed some of the most seriously contaminated sites on its National Priorities List (NPL). Through the end of fiscal year 2007, EPA had classified 1,569 sites as NPL sites. Cleanup efforts at NPL sites are typically expensive and can take many years. There are two basic types of cleanup actions: (1) removal actions--generally short-term or emergency cleanups to mitigate threats--and (2) remedial actions--generally long-term cleanup activities. Among other efforts, EPA may respond to and provide technical support for emergency actions, collect and analyze site data, and design and construct remedies, or oversee the work of others. A letter report issued by the Government Accountability Office with an abstract that begins "Following the 1998 embassy bombings, the Department of State (State) determined that more than 85 percent of diplomatic facilities did not meet security standards and were vulnerable to terrorist attacks. State's Bureau of Overseas Buildings Operations (OBO) has undertaken a program to replace or upgrade the security of these facilities. As of 2007, OBO had constructed more than 50 new embassies and moved nearly 15,000 staff to safer facilities. However, most remaining facilities will not be replaced in the near term. To address these facilities, OBO has obligated about $140 million per year for its Compound Security Upgrade Program (CSUP). GAO was asked to (1) describe the process that OBO follows to prioritize and plan CSUP projects, including stakeholder involvement; (2) determine the extent to which CSUP projects met contracted cost and time frames and whether OBO has procedures to ensure security upgrades are installed; and (3) assess whether State's CSUP efforts have enhanced posts' abilities to comply with State's physical security standards. Over the past 10 years, the number of deployed UN personnel increased from about 41,000 peacekeepers and civilian staff to about 109,000 in 2008. In this report on the UN's capacity to deploy further operations, GAO was asked to examine (1) the evolution of UN peacekeeping operations in the past 10 years; (2) the likely characteristics of a potential new peacekeeping operation, given this evolution; (3) the challenges, if any, the UN would face deploying this operation; and (4) U.S. efforts to support and report on UN peacekeeping. Correspondence issued by the Government Accountability Office with an abstract that begins "Since the September 11, 2001 attacks on the World Trade Center and the Pentagon, the United States has launched several military operations that have dramatically increased the operations tempo of the military services and required the large-scale mobilization of reservists. These factors have particularly affected the active Army, Army Reserve, and Army National Guard, which have shouldered the bulk of the personnel burden associated with ongoing operations in Iraq. A 2007 Congressional Research Service report notes that many observers have expressed concern that these factors might lead to lower recruiting and retention rates, thereby jeopardizing the vitality of today's all-volunteer military. Additionally, in 2004 the Army began its modular force transformation to restructure itself from a division-based force to a more agile and responsive modular brigade-based force--an undertaking it considers to be the most extensive reorganization of its force since World War II. The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (Bankruptcy Reform Act) required the federal judiciary's Administrative Office of the U.S. Courts (AOUSC) to collect and report certain additional bankruptcy statistics and required the U.S. Trustee Program, which oversees bankruptcy case administration, to develop uniform final reports that provide certain specified data about each case. GAO was asked to examine the (1) availability and accessibility of data from the personal bankruptcy system and (2) potential benefits and limitations of the new data requirements of the Bankruptcy Reform Act in addressing these issues. A letter report issued by the Government Accountability Office with an abstract that begins "International policies to address climate change have largely relied on market-based programs; for example, under the European Union's Emissions Trading Scheme (ETS) phase I (2005 to 2007) carbon dioxide emissions reductions were sought by setting a cap on each member state's allowable emissions and distributing tradable allowances to covered entities, such as power plants. Beginning operation in 2002, the Kyoto Protocol's Clean Development Mechanism (CDM) has relied on offsets, allowing certain industrialized nations to pay for emission reduction projects in developing countries--where the cost of abatement may be less expensive--in addition to reducing emissions within their borders. Legislative proposals to limit greenhouse gas emissions are under consideration in the United States. In this context, GAO was asked to examine the effects of and lessons learned from (1) the ETS phase I and (2) the CDM. GAO worked with the National Academy of Sciences to identify experts in market-based programs and gathered their opinions through a questionnaire, interviewed stakeholders, and reviewed available information."

Slowing the growth of entitlements is an essential part of the solution to these challenges. GAO was asked to identify useful insights from the entitlement reform processes in other countries. Specifically, GAO was asked to analyze (1) other countries' major efforts to reform entitlement programs, (2) the pressure(s) that led countries to undertake the reforms, (3) how reform proposals were developed, and (4) to what extent enacted reforms built in triggers requiring future actions under certain conditions; and where such trigger mechanisms did not exist, whether some adjustments nonetheless occurred. GAO conducted a literature review focusing on developed, high-income Organisation for Economic Co-Operation and Development (OECD) countries facing similar fiscal challenges. To gain a more in-depth understanding of reform process, GAO selected three efforts for further study: Sweden's pension reform in 1998, Germany's pension reform in 2004, and the Netherlands' disability reform in 2005. EPA's civil and criminal enforcement programs work with the Department of Justice (DOJ), and in some cases states, to take legal actions to bring polluters into compliance with federal laws. While civil enforcement actions require polluters to pay penalties and take other corrective actions, criminal enforcement actions also may include imprisonment. EPA's enforcement office sets national priorities to focus resources on significant environmental risks and non-compliance patterns; prepares nationally significant civil and criminal cases for legal action by DOJ; uses 10 regional offices to implement civil enforcement actions on a day-to-day basis; and pursues criminal violations of environmental laws through its criminal enforcement office. The size and scope of UN peacekeeping has significantly increased over the past several years and the UN has pursued management reforms to strengthen its capacity to support operations. GAO was asked to examine (1) the status of the current restructuring and strengthening of peacekeeping management including procurement for the field, (2) the status of reforms to address previously identified problems with peacekeeping procurement, and (3) the UN Logistics Base's support of peacekeeping operations. GAO reviewed relevant UN documents; conducted structured interviews with chief procurement officers at 20 peacekeeping missions; and interviewed UN and U.S. officials. State agreed with the report and commented that it would draw upon some of the report findings in its discussion with the United Nations. The UN agreed with GAO's assessment of the status of reforms and provided technical comments, which are addressed in the report as appropriate."

Correspondence issued by the Government Accountability Office with an abstract that begins "In July 2006, the former Commander of North American Aerospace Defense Command (NORAD) and United States Northern Command (USNORTHCOM) announced plans to relocate certain functions from Cheyenne Mountain to create an integrated command center in Building 2 at Peterson Air Force Base (AFB), Colorado. In May 2007, we reported that NORAD and USNORTHCOM had not analyzed the anticipated operational effects--both positive and negative--of the relocation, and that the Department of Defense (DOD) could not discern the full costs or security implications of the move until ongoing security assessments had been completed and a protection level designated for the integrated command center. We suggested that Congress should consider restricting DOD's authority to fund the relocation until all security analyses were complete, the full costs for the move were determined, and DOD provided Congress with an analysis of the operational effects of the proposed realignments. Testimony issued by the Government Accountability Office with an abstract that begins "In April 2007, GAO reported that 96 percent of the greenhouse gas emissions from the Capitol Hill Complex facilities--managed by the Architect of the Capitol (AOC)--resulted from electricity use throughout the complex and combustion of fossil fuels in the Capitol Power Plant. The report concluded that AOC and other legislative branch agencies could benefit from conducting energy audits to identify projects that would reduce greenhouse gas emissions. GAO also recommended that AOC and the other agencies establish a schedule for conducting these audits and implement selected projects as part of an overall plan that considers cost-effectiveness, the extent to which the projects reduce emissions, and funding options. AOC and the other agencies agreed with our recommendations. This statement focuses on (1) the status of AOC's efforts to implement the recommendations in our April 2007 report and (2) opportunities for the Senate to decrease greenhouse gas emissions and associated environmental impacts. The Federal Emergency Management Agency's (FEMA) Public Assistance (PA) grant program is a key tool for providing funds to support recovery, including rebuilding public schools, roads, and utilities. GAO was asked to examine the amount of PA grants FEMA has provided for rebuilding the Gulf Coast; challenges in the day-to-day operation of the PA program; and human capital challenges; as well as actions taken to address them. Toward this end, GAO reviewed relevant laws, PA regulations and procedures, and analyzed data from FEMA's National Emergency Management Information System. GAO also interviewed federal officials from FEMA and the Department of Homeland Security's (DHS) Office of the Federal Coordinator for Gulf Coast Rebuilding as well as more than 60 officials from state government and eight localities in Louisiana and Mississippi."

Correspondence issued by the Government Accountability Office with an abstract that begins "In January 2007, the Secretary of Defense announced an initiative to expand the Army from a total of 1,037,000 to 1,112,000 active and reserve soldiers by fiscal year 2013--an increase of 74,200 military personnel--in order to meet increasing strategic demands and to help reduce stress on the force. This planned expansion includes building six additional active modular brigade combat teams and additional modular support units, which will require a substantial increase in funding for personnel, equipment, and infrastructure. Currently, the Army estimates this expansion may require about $70 billion in increased funding through fiscal year 2013 and a significant amount in annual funding thereafter to sustain the expanded Army. The President's fiscal year 2008 budget request contained $7.7 billion for Department of the Army funding related to the Grow the Force initiative. During the course of our review of Army modularity as required by the John Warner National Defense Authorization Act for Fiscal Year 2007, we analyzed the $70.2 billion Grow the Force initiative funding plan. Correspondence issued by the Government Accountability Office with an abstract that begins "In September 2005, the Base Realignment and Closure Commission (BRAC) recommended closing Cannon Air Force Base, New Mexico, unless a new mission for the base could be identified by December 31, 2009. In June 2006, the Department of Defense (DOD) announced that Air Force Special Operations Command (AFSOC) would establish a new mission at Cannon Air Force Base and the command would take ownership of the base on October 1, 2007. As a result, Cannon Air Force Base will remain open. While DOD has satisfied the intent of the recommendation by finding a new mission for the base, this BRAC recommendation was unusual because it contained a contingency clause. Therefore, we reviewed DOD's implementation of this recommendation under the authority of the Comptroller General to conduct evaluations on his own initiative. This report (1) describes the factors underpinning the decision to house AFSOC at Cannon Air Force Base and (2) provides information on the cost estimate and timeline for the movement of personnel to establish the AFSOC mission."

Air Traffic Control: FAA Uses Earned Value Techniques to Help Manage Information Technology Acquisitions, but Needs to Clarify Policy and Strengthen Oversight

A letter report issued by the Government Accountability Office with an abstract that begins "In fiscal year 2008, the Federal Aviation Administration (FAA) plans to spend over $2 billion on information technology (IT) investments--many of which support FAA's air traffic control modernization. To more effectively manage such investments, in 2005 the Office of Management and Budget required agencies to use earned value management (EVM). EVM is a project management approach that, if implemented appropriately, provides objective reports of project status, produces early warning signs of impending schedule delays and cost overruns, and provides unbiased estimates of a program's total costs. Among other objectives, GAO was asked to assess FAA's policies for implementing EVM on its IT investments, evaluate whether the agency is adequately using these techniques to manage key IT acquisitions, and assess the agency's efforts to oversee EVM compliance. To do so, GAO compared agency policies with best practices, performed four case studies, and interviewed key FAA officials."
