At the 1994 Summit of the Americas, 34 hemispheric democracies agreed to create a “Free Trade Area of the Americas” (FTAA) no later than 2005. If created, the FTAA would be a $13 trillion market of 34 countries (Cuba is not included) and nearly 800 million people. The population alone would make it the largest free trade area in the world with nearly twice the 450 million population of the now 25-nation European Union. In the nearly ten years following the 1994 summit, Western Hemisphere trade ministers have met eight times to advance the negotiating process. At the last ministerial held from November 17- 20 2003 in Miami, ministers agreed to a declaration that set a September 2004 deadline for the market access talks, created a two-tiered FTAA structure, and reaffirmed countries’ commitment to complete the entire FTAA by January 2005.

The history of omnibus energy legislation in the 108th Congress has been protracted. The House passed the conference version of H.R. 6 on November 18, 2003. On November 21, a cloture motion to limit debate in the Senate on the H.R. 6 conference report failed (57-40). Efforts to bring the bill back to the Senate floor early in the second session were unsuccessful. Some argued that any major changes to the legislation would not be viable because of the careful regional and political compromises that were reached to get a bill out of conference and through the House. The closest consensus was that the cost of the bill had to be reduced.

Concerns over financing federal elections have become a seemingly perennial aspect of our political system, centered on the enduring issues of high campaign costs and reliance on interest groups for needed campaign funds. Growing populations and changing values continue to place increasing demands on water supplies and river systems, resulting in water use and management conflicts throughout the country. Recent conflicts are particularly evident in the West, where the population is expected to increase 30% in the next 20-25 years and where agricultural needs are often in direct conflict with urban needs, as well as with water demand for threatened and endangered species, recreation, and scenic enjoyment.

This report discusses issues debated in the 108th Congress while is considering various proposals to amend the Endangered Species Act of 1973 (ESA). Major issues in recent years have included changing the role of science in decision-making, changing the role of critical habitat, reducing conflicts with Department of Defense activities, incorporating further protection for property owners, and increasing protection of listed species, among others. From a public policy perspective, the goals are to ensure that broadband deployment is timely, that industry competes fairly, and that service is provided to all sectors and geographical locations of American society. The federal government -- through Congress and the Federal Communications Commission (FCC) -- is seeking to ensure fair competition among the players so that broadband will be available and affordable in a timely manner to all Americans who want it. While the FCC's position is not to intervene at this time, some assert that legislation is necessary to ensure fair competition and timely broadband deployment. One proposal would ease certain legal restrictions and requirements, imposed by the Telecommunications Act of 1996, on incumbent telephone companies who provide high speed data (broadband) access. Another proposal would compel cable companies to provide "open access" to competing Internet service providers.

The House passed the bill on August 2, 2001, and the Senate approved its version April 25, 2002.
