Disaster Relief and Response: FY2003 Supplemental Appropriations
On July 7, 2003, President Bush submitted a second supplemental appropriations request to Congress for FY2003. The request seeks $1.889 billion for three disaster relief activities: $289 million for wildfire suppression and rehabilitation carried out by the Departments of Agriculture and the Interior, $1.550 billion for disaster relief administered by the Department of Homeland Security (DHS), and $50 million for the investigation and recovery associated with the Space Shuttle Columbia disaster. For the most part, Members of Congress evince support for the disaster relief funding request; however, some debate has occurred on other funding sought, notably funding for AmeriCorps grants.

In the 108th Congress, debate over energy efficiency programs has focused on budget, oil, natural gas, and electricity issues, and provisions in the omnibus energy policy bill, S. 2095, H.R. 6, and S. 14/S. 1149. The Bush Administration’s FY2005 budget request for the Department of Energy’s (DOE’s) Energy Efficiency Program sought $875.9 million, including $543.9 for R&D and $332.0 million for grants. In the first session, the omnibus energy bill (H.R. 6) had several significant tax and regulatory measures for energy efficiency. It did not pass the Senate due to concerns about cost and an MTBE “safe harbor” provision.

Energy Tax Policy
Omnibus energy legislation (H.R. 4) that is now in conference would expand energy tax incentives significantly. The House passed the bill on August 2, 2001, and the Senate approved its version April 25, 2002. Several energy tax issues are addressed in these bills: 1) tax incentives to increase the supply of oil and gas, and the demand for coal; 2) energy tax issues relating to energy conservation and energy efficiency; 3) energy tax issues relating to alternative fuels; 4) selected issues relating to electricity restructuring; and 5) expiring energy tax provisions.

Energy Policy: The Continuing Debate
On July 31, 2003, the Senate, facing obstacles to passage of its comprehensive energy bill (S. 14), substituted the energy legislation the Senate had passed and sent to conference in the 107th Congress. Principals are sorting out the implications of this unanticipated development; there are identical or similar provisions in both S. 14 and the substitute measure that the Senate passed as H.R. 6, but there are also significant differences.

Automobile and Light Truck Fuel Economy: The CAFE Standards
One of the least controversial provisions of the Energy Policy and Conservation Act of 1975 (P.L. 94-163) established corporate average fuel economy (CAFE) standards for new passenger cars. This report presents a brief background and analysis regarding the price of crude oil that brought into sharp focus the fuel inefficiency of U.S. automobiles. The report also discusses the previous issues and the most recent developments regarding CAFE.

Energy: Useful Facts and Numbers
Energy supplies and prices are a major economic factor in the United States, and energy markets are volatile and unpredictable. For both these reasons, energy policy is of frequent interest to the Congress. This report presents a statistical view of the supply and consumption of various forms of energy. Clean Air Act Issues in the 108th Congress
Clean air issues were discussed at length in the 107th Congress, but legislation was not enacted, leaving the same issues for possible consideration in the 108th. The most prominent air quality issues discussed in this report are; the controversy over EPA’s proposed changes to the New Source Review (NSR) requirements, Clear Skies / Multi-Pollutant Legislation, gasoline additive MTBE, Conformity of Transportation Plans and SIPs Deadlines for Achieving the Ozone Air Quality Standard.

Clean Water Act Issues in the 108th Congress
In this report several other Clean Water Act issues are likely to receive congressional attention, through oversight hearings and possibly in legislative proposals. Among the topics of interest is whether and how the Administration will revise the current program for restoration of pollution-impaired waters (the Total Maximum Daily Load, or TMDL program), in view of controversy over regulatory changes made during the Clinton Administration and continuing disagreement among states, cities, industry, and environmental advocates about program effectiveness and efficiency.

Clean Water Act Issues in the 108th Congress
The Clean Water Act Issues has again received attention in the 108th Congress. At issue is how the federal government will assist states and cities in meeting needs to rebuild, repair, and upgrade wastewater treatment plants, especially in light of capital costs which are projected to be as much as $390 billion over the next two decades. In October 2004, the Senate Environment and Public Works Committee reported legislation to authorize $20 billion in funding for clean water infrastructure (S. 2550), while in July 2003, a House Transportation and Infrastructure subcommittee also approved a water infrastructure financing bill (H.R. 1560). Still, prospects for further action during the 108th Congress are uncertain.
