Detention of American Citizens as Enemy Combatants

This report provides background information regarding the cases of two U.S. citizens deemed “enemy combatants,” Yaser Esam Hamdi, who has been returned to Saudi Arabia, and Jose Padilla, who remains in military custody. The report addresses the constitutional and statutory sources that arguably provide authority for the detention of enemy combatants, as well as those that may prevent the exercise of that power with respect to U.S. citizens. The report concludes that historically, even during declared wars, additional statutory authority has been seen as necessary to validate the detention of citizens not members of any armed forces, casting in some doubt the argument that the power to detain is necessarily implied by an authorization to use force. Finally, the report briefly analyzes the Detention of Enemy Combatants Act, H.R. 1029, which would authorize the President to detain U.S. citizens and residents who are determined to be “enemy combatants” in certain circumstances.

Floor Procedure in the House of Representatives: A Brief Overview

The House considers bills and resolutions on the floor under several different sets of procedures governing the time for debate and the opportunities for amendment. Some procedures allow 40 or 60 minutes for debate; others permit debate to continue until a majority of Members vote to end it. Some procedures prohibit most or all floor amendments; others allow Members to offer any amendments that meet the requirements of the House’s rules and precedents. Notwithstanding these differences, the rules, precedents, and practices of the House generally are designed to permit the majority to work its will in a timely manner. This report provides a brief overview of this procedure.

Campaign Finance Reform: A Legal Analysis of Issue and Express Advocacy

Issue advocacy communications have become increasingly popular over the federal election cycles. Often these advertisements could be interpreted to favor or disfavor certain candidates, while also serving to inform the public about a policy issue. However, unlike communications that expressly advocate the election or defeat of a clearly identified candidate, the Supreme Court has ruled that issue ads are constitutionally protected First Amendment speech and cannot be regulated in any manner. According to most lower court rulings, only speech containing express words of advocacy of election or defeat, also known as “express advocacy” or “magic words” can be regulated as election-related communications and therefore be subject to the requirements of the Federal Election Campaign Act (FECA). Unlike express advocacy communications, therefore, issue ads may be paid for with funds unregulated by federal law, i.e., soft money

Energy Policy: Setting the Stage for the Current Debate

The Bush Administration issued its plan for a national energy policy on May 16, 2001. The plan was controversial, characterized by some as leaner on conservation and renewables than Democratic proposals, and predisposed to trade off environmental considerations to increase supply. Comprehensive energy legislation was introduced in the Senate by both parties by late March (S. 388, S. 389, S. 596, S. 597). Bills reported by several House committees (H.R. 2436, H.R. 2460, H.R. 2511, and H.R. 2587) were combined in a single bill, H.R. 4, passed by the House, August 1, 2001. The House version of H.R. 4 would require a 5 billion gallon reduction in light-duty truck and SUV fuel consumption and would open the Arctic National Wildlife Refuge (ANWR) to leasing.
