Gasoline Prices: New Legislation and Proposals
This report discusses policy options for Congress regarding gas prices. The high price of gasoline was an important consideration during the debate on major energy legislation, which ended August 8 as the President signed the Energy Policy Act of 2005, H.R. 6 (P.L. 109-58). However, prices continued to surge, spiking at the end of August when Hurricane Katrina shut down refining operations in the Gulf of Mexico. The continuing crisis renewed attention to some issues that were dropped or compromised in the debate over P.L. 109-58. A large number of factors combined to put pressure on gasoline prices, including increased world demand for crude oil and U.S. refinery capacity inadequate to supply gasoline to a recovering national economy. The war and continued violence in Iraq added uncertainty and a threat of supply disruption that added pressure particularly to the commodity futures markets.

Border Security: Key Agencies and Their Missions
After the massive reorganization of federal agencies precipitated by the creation of the Department of Homeland Security (DHS), there are now four main federal agencies charged with securing the United States’ borders: the Bureau of Customs and Border Protection (CBP), which patrols the border and conducts immigrations, customs, and agricultural inspections at ports of entry; the Bureau of Immigrations and Customs Enforcement (ICE), which investigates immigrations and customs violations in the interior of the country; the United States Coast Guard, which provides maritime and port security; and the Transportation Security Administration (TSA), which is responsible for securing the nation’s land, rail, and air transportation networks. This report is meant to serve as a primer on the key federal agencies charged with border security; as such it will briefly describe each agency’s role in securing our nation’s borders.

CALFED Bay-Delta Program: Overview of Institutional and Water Use Issues
The California Bay-Delta Program (CALFED) was initiated in 1995 to resolve water resources conflicts in the Sacramento/San Joaquin Rivers Delta and San Francisco Bay (Bay-Delta) in California. The program planning effort focused on developing a plan to address three main problem areas in the Bay-Delta: ecosystem health, water quality, and water supply reliability. CALFED was authorized to receive federal funding from FY1998 to FY2000, and is now being considered for reauthorization.

Dairy Policy Issues
Several dairy issues that were debated during the 108th Congress are expected to continue as issues of interest in the 109th Congress. Separate bills were introduced in the 108th Congress to extend authority for both the Milk Income Loss Contract (MILC) Program and the dairy forward pricing pilot program, and to address dairy producer concerns about the importation of milk protein concentrates.

Endangered Species: Difficult Choices
This report discusses issues debated in the 108th Congress while is considering various proposals to amend the Endangered Species Act of 1973 (ESA). Major issues in recent years have included changing the role of science in decision-making, changing the role of critical habitat, reducing conflicts with Department of Defense activities, incorporating further protection for property owners, and increasing protection of listed species, among others. In addition, many have advocated including significant changes to ESA regulations made during the Clinton Administration in the law itself.

Afghanistan: Narcotics and U.S. Policy
This report describes the structure and development of the narcotics trade in Afghanistan and explores its relevance to Afghan, U.S., and international security interests, including the 9/11 Commission’s recommendation that the United States make a long term commitment to the stability and security of Afghanistan. Enemy Combatant Detainees:
In Rasul v. Bush, a divided Supreme Court declared that “a state of war is not a blank check for the president” and ruled that persons deemed “enemy combatants” have the right to challenge their detention before a judge or other “neutral decision-maker.” This report provides an overview of the CSRT procedures, summarizes court cases related to the detentions and the use of military commissions, and summarizes the Detainee Treatment Act, analyzing how it might affect detainee-related litigation in federal court.
