Agricultural Trade Issues in the 107th Congress

The 107th Congress is considering trade issues with implications for the U.S. agricultural sector. Trade in agricultural commodities and food products affects farm income and rural employment, and it also generates economic activity beyond the farm gate. With agricultural export sales the equivalent of one-quarter of farm income, some policymakers view U.S. efforts to develop market opportunities overseas as vital to the sector’s financial health. Decisions taken by the Bush Administration, and actions taken by Congress, thus will affect the outlook for agricultural trade.

Several major dairy policy issues are addressed in the context of the Farm Security and Rural Investment Act of 2002 (P.L. 107- 171, the 2002 farm bill), which was signed into law on May 13, 2002. Included in the enacted 2002 farm bill are a reauthorization of the dairy price support program for an additional 5 ½ years, and new authorization for direct payments to dairy farmers through September 2005, triggered whenever the market price of farm milk falls below a target price level.

Agroterrorism: Options in Congress

Although U.S. intelligence agencies have not identified any terrorist acts targeting agricultural production (i.e., agroterrorism) in the United States to date, the events of September 11, 2001 have awakened the nation to their possibility. Some experts estimate that a single agroterrorist attack using a highly contagious livestock disease could cost between $10 billion and $30 billion to the U.S. economy. This report examines the potential threats to America’s agriculture from a deliberate biological attack, describes the current defense structure and capabilities available to respond to agroterrorism, and analyzes current congressional proposals to address the threat of biological weapons to U.S. agriculture.

The Budget for Fiscal Year 2004

In March, CBO released its report analyzing the President’s policies. CBO’s estimates of the President’s budget, a recasting of the policies using CBO assumptions and budget estimating methods, raise the expected deficit for FY2004 to $338 billion from the OMB estimated $307 billion. The report also included an update to CBO’s January baseline that pushed the deficit for FY2004 to $200 billion from $145 billion. The revisions delay the return-to-a-surplus from FY2007 to FY2008 and reduce the cumulative FY2004-FY2013 surplus from $1,336 billion (January) to $891 billion (March).

The Federal Arbitration Act: Background and Recent Developments

Enacted in 1925, the Federal Arbitration Act (“FAA”) seeks to ensure the validity and enforcement of arbitration agreements in any “maritime transaction or a contract evidencing a transaction involving commerce.” This report provides a brief legislative history of the FAA, as well as a review of selected cases that have interpreted the FAA. The report also discusses bills introduced during the 107th Congress that would amend the FAA for various purposes. Of the nine measures that have been introduced, five bills would amend the FAA to address arbitration and employment disputes. The remaining bills address arbitration in motor vehicle franchise contracts and arbitration and consumer credit contracts.
