Guidance issued by the Government Accountability Office with an abstract that begins "This report supersedes GAO-03-232SP, GAO's Agency Protocols. This document contains the updated protocols that govern the U.S. Government Accountability Office's (GAO) work with executive branch agencies. The protocols provide clearly defined and transparent policies and practices on how GAO interacts with agencies in performing its work. GAO supports the Congress in meeting its constitutional responsibilities and strives to help improve the performance and ensure the accountability of the federal government for the benefit of the American people. Although our primary client is the Congress and we must maintain our independence from the entities that are the subject of our work, we seek to continue constructive working relationships with the executive branch. In all cases, we seek to conduct our work in a professional, objective, fact-based, nonpartisan, and nonideological manner, in order to help improve government."

Internal Revenue Service: Challenges Remain in Combating Abusive Tax Shelters

Testimony issued by the General Accounting Office with an abstract that begins "Recent scandals involving corporations, company executives, and accounting, law, and investment banking firms heightened awareness of abusive tax shelters and highlighted the importance of the Department of the Treasury and the Internal Revenue Service (IRS) addressing them. During 1999, Treasury issued a report indicating that abusive shelters were a large and growing problem, involving billions of dollars of tax reductions. Treasury was concerned that abusive shelters could ultimately undermine the integrity of the voluntary compliance tax system. GAO's statement today is based on work done at the request of the Chairman and the Ranking Minority Member of the Senate Committee on Finance to examine IRS's strategy for dealing with abusive tax shelters. In reporting on abusive shelters, GAO is describing (1) their nature and scope; (2) IRS's strategy and enforcement mechanisms to combat them and the performance goals and measures IRS uses to track its major effort in that area; and (3) the decision-making process IRS used and the plans it has to devote more resources to addressing abusive shelters."

Foreign Affairs: Agencies Have Improved the Intercountry Adoption Process, but Further Enhancements Are Needed

A letter report issued by the Government Accountability Office with an abstract that begins "U.S. intercountry adoptions nearly tripled from more than 8,000 to more than 22,000 between fiscal years 1994 and 2004. While the Department of State (State) and U.S. Citizenship and Immigration Services (USCIS) manage the process, factors ranging from corruption to inadequate legal frameworks in foreign countries could lead to abuses such as the abduction of children. GAO (1) describes the U.S. intercountry adoption process, (2) assesses the U.S. government's efforts to manage the intercountry adoption process, (3) assesses U.S. efforts to strengthen safeguards and mitigate against the potential for fraudulent adoptions, and (4) describes the Hague Convention (Convention) and the statuses of U.S. and top sending countries' implementation of the Convention."

Social Security Reform: Other Countries' Experiences Provide Lessons for the United States

A letter report issued by the Government Accountability Office with an abstract that begins "Many countries, including the United States, are grappling with demographic change and its effect on their national pension systems. With rising longevity and declining birthrates, the number of workers for each retiree is falling in most developed countries, straining the finances of national pension programs, particularly where contributions from current workers fund payments to current beneficiaries--known as a pay-as-you-go (PAYG) system. Although demographic and economic challenges are less severe in the United States than in many other developed countries, projections show that the Social Security program faces a long-term financing problem. Because some countries have already undertaken national pension reform efforts to address demographic changes similar to those occurring in the United States, we may draw lessons from their experiences. The current and preceding Chairmen of the Subcommittee on Social Security of the House Committee on Ways and Means asked GAO to study lessons to be learned from other countries' experiences reforming national pension systems. Private Pensions: Sponsors of 10 Underfunded Plans Paid Executives Approximately $350 Million in Compensation Shortly Before Termination

A letter report issued by the Government Accountability Office with an abstract that begins "When sponsors terminate underfunded plans during bankruptcy, it can deplete resources of the Pension Benefit Guaranty Corporation (PBGC), which protects the pensions of almost 44 million American workers and retirees who participate in over 29,000 defined benefit pension plans. In 2009, PBGC reported an estimated deficit of over $30 billion. GAO was asked to determine what pay and other compensation executives received in the years preceding their company's termination of an underfunded defined benefit pension plan. To identify case study examples GAO analyzed a listing of the 1,246 underfunded plans that were terminated from 1999 to 2008 and selected public companies with large unfunded liabilities, large unfunded liabilities per participant, and a large number of plan participants. GAO reviewed documents provided by companies and executives, and interviewed PBGC and company officials. GAO also reviewed Securities and Exchange Commission (SEC) filings and PBGC documents disclosing plan underfunding at the time of termination and missed contributions. Executive compensation figures may be understated because some company executives could not be located, did not respond to document requests, declined interviews, and did not give GAO access to their tax records."

Many issues cut across more than one agency and their actions are not well coordinated. Moreover, agencies face a range of barriers when they attempt to work collaboratively. This report identifies key practices that can help enhance and sustain agency collaboration. GAO also considered how the Government Performance and Results Act (GPRA) and the Office of Management and Budget (OMB) address collaboration among agencies. To illustrate these practices, we selected the Healthy People, wildland fire management, and Departments of Veterans Affairs and Defense's health resource sharing collaborations."

IRS and Terrorist-Related Information Sharing

Correspondence issued by the General Accounting Office with an abstract that begins "Events preceding and following the attacks of September 11, 2001, spotlighted ineffective information sharing, particularly related to intelligence and law enforcement activities, as a serious weakness. Poor information sharing hinders effectively identifying vulnerabilities and coordinating efforts to detect attacks. GAO monitored the Internal Revenue Service's (IRS) efforts to enhance the security of the tax filing process, to study how terrorist-related threat information is shared with IRS. The Federal Bureau of Investigation (FBI) uses task forces and electronic means to share terrorist-related threat information with the Treasury Inspector General for Tax Administration (TIGTA). More specifically, it shares information through its involvement with TIGTA and others in Joint Terrorism Task Forces and through electronic arrangements such as the National Threat Warning System. For its part, TIGTA uses formal communications to disseminate threat information to IRS. TIGTA and IRS officials were satisfied with the FBI's and TIGTA's information-sharing procedures, respectively."

Correspondence issued by the Government Accountability Office with an abstract that begins "This report responds to certain requirements of the Haitian Refugee Immigration Fairness Act (HRIFA) of 1998 that authorized certain Haitian nationals and their dependents to apply to adjust their status to lawful permanent residence. Section 902(k) of the act requires the Comptroller General to report every 6 months on the number of Haitian nationals who have applied and been approved to adjust their status to lawful permanent residence. The reports are to contain a breakdown of the number of Haitians who applied and the number who were approved as asylum applicants, parolees, children without parents, orphaned children, or abandoned children; or as the eligible dependents of these applicants, including spouses, children, and unmarried sons or daughters. Reports are to be provided until all applications have been finally adjudicated. This is our thirteenth report."

Clean Air Act: New Source Review Revisions Could Affect Utility Enforcement Cases and Public Access to Emissions Data

A letter report issued by the General Accounting Office with an abstract that begins "Recent Environmental Protection Agency (EPA) revisions to the New Source Review (NSR) program--a key component of the federal government's plan to limit harmful industrial emissions--have been under scrutiny by the Congress, environmental groups, state and local air quality agencies, the courts, and several industry groups. The revisions more explicitly define when companies can modify their facilities without needing to obtain an NSR permit or install costly pollution controls, as NSR requires. GAO was asked to determine (1) whether EPA and the Department of Justice (DOJ) assessed the potential impact of the revisions on the ongoing enforcement cases against coal-fired utilities and, if so, what the assessments indicated; and (2) what effect, if any, the revisions might have on public access to information about facility changes and their resulting emissions."

Testimony issued by the Government Accountability Office with an abstract that begins "The decennial census is a constitutionally mandated activity that produces data used to apportion congressional seats, redraw congressional districts, and help allocate billions of dollars in federal assistance. A complete and accurate master address file (MAF), along with precise maps--the U.S. Census Bureau's (Bureau) mapping system is called Topologically Integrated Geographic Encoding and Referencing (TIGER)--are the building blocks of a successful census. If the Bureau's address list and maps are inaccurate, people can be missed, counted more than once, or included in the wrong location. This testimony discusses the Bureau's readiness for the 2010 Census and covers: (1) the Bureau's progress in building an accurate address list; and (2) an update of the Bureau's information technology (IT) system used to extract information from its MAF/TIGER? database. Our review included observations at 20 early opening local census offices in hard-to-count areas. The testimony is based on previously issued and ongoing work."

Correspondence issued by the Government Accountability Office with an abstract that begins "The U.S. government annually sponsors thousands of conferences, symposiums, seminars, and other policy-related forums that involve individuals and organizations from outside the U.S. government. These forums present opportunities for U.S. and foreign audiences to discuss public policy issues and are designed to advance U.S. government interests. For example, some forums are intended to educate participants about official U.S. government positions and policies on issues of public concern, such as the war in Iraq, development of alternative energy sources, human trafficking, and protection of endangered species. Other forums serve as venues for soliciting input on policy issues from the public and from selected external experts, including academics, scientists, journalists, and representatives of nongovernmental organizations. Congress requested information on these forums, noting that official U.S. representation at the forums is important for ensuring that they achieve their objectives. This letter provides information on forums sponsored by the Departments of State, Defense, Energy, and Interior from 2001 through 2004.
