The primary focus of this issue brief is legislative action in the 108th Congress with respect to abortion. However, discussion of those legislative proposals necessarily involves a brief discussion of the leading U.S. Supreme Court decisions concerning a woman’s right to choose whether to terminate her pregnancy. Omnibus energy legislation (H.R. 4) that is now in conference would expand energy tax incentives significantly. The House passed the bill on August 2, 2001, and the Senate approved its version April 25, 2002. Several energy tax issues are addressed in these bills: 1) tax incentives to increase the supply of oil and gas, and the demand for coal; 2) energy tax issues relating to energy conservation and energy efficiency; 3) energy tax issues relating to alternative fuels; 4) selected issues relating to electricity restructuring; and 5) expiring energy tax provisions.

Energy Policy: The Continuing Debate and Omnibus Energy Legislation

The history of omnibus energy legislation in the 108th Congress has been protracted. The House passed the conference version of H.R. 6 on November 18, 2003. On November 21, a cloture motion to limit debate in the Senate on the H.R. 6 conference report failed (57-40). Efforts to bring the bill back to the Senate floor early in the second session were unsuccessful. Some argued that any major changes to the legislation would not be viable because of the careful regional and political compromises that were reached to get a bill out of conference and through the House. The closest consensus was that the cost of the bill had to be reduced.

The early discussion focused primarily on California, but with the release of the Administration’s energy policy recommendations in May 2001 and subsequent congressional action, attention shifted to issues more national in scope.

Key water quality issues that may face the 107th Congress include: actions to implement existing provisions of the Clean Water Act (CWA), whether additional steps are necessary to achieve overall goals of the Act, and the appropriate federal role in guiding and paying for clean water activities. Legislative prospects for comprehensively amending the Act have for some time stalled over whether and exactly how to change the law. If clean water issues receive attention in the 107th Congress, consideration of specific issues will depend in part on the CWA policy agenda of the new Bush Administration and on priorities of the key committees that have major jurisdiction over the Act.

This report surveys several of the DRM bills that were introduced in the 107th Congress and those that are pending in the 108th Congress. Generally, the bills are directed at two separate goals. One goal is to increase access to digitally-protected media for lawful purposes. The other attempts to thwart digital piracy and would do so by enhancing civil and criminal sanctions for digital (and traditional) copyright infringement and educating the public about the rights of copyright holders.
