Crime Control: The Federal Response (open access)

Crime Control: The Federal Response

Under the federal system in the United States, the states and localities traditionally have held the major responsibility for prevention and control of crime and maintenance of order. For most of the Republicā€™s history, ā€œpolice powersā€ in the broad sense were reserved to the states under the Tenth Amendment to the Constitution. Many still hold that view, but others see a string of court decisions in recent decades as providing the basis for a far more active federal role. Several bills are discussed in this report that address issues related to crime, juvenile justice, and Congressā€™ evolving role in crime legislation.

Cybercrime: The Council of Europe Convention

Forty-three countries, including the United States, have signed the Council of Europeā€™s Convention on Cybercrime of November 2001. The U.S. Senate ratified the Convention on August 3, 2006. The Convention seeks to better combat cybercrime by harmonizing national laws, improving investigative abilities, and boosting international cooperation. Supporters argue that the Convention will enhance deterrence, while critics counter it will have little effect without participation by countries in which cybercriminals operate freely. Others warn it will endanger privacy and civil liberties.

Border Security: Inspections Practices, Policies, and Issues

Some argue that this reorganization of border inspections has been long needed and is resulting in a more streamlined and efficient set of procedures at the border with a clear, single, chain of command. Others warn that the different types of inspections are quite complex in their own right and that the reorganization is exacerbating the conflicting priorities at the border, ultimately resulting in many more people and goods being sent to secondary inspections. This report, which will not be updated, discusses a range of legal, administrative, and policy issues that are emerging with the implementation of the unified border inspections.
