HIV/AIDS International Programs: Appropriations, FY2003-FY2005
The Administration's FY2005 request for international HIV/AIDS, tuberculosis, and malaria programs totals about $2.8 billion, as compared with $2.4 billion appropriated for FY2004. The FY2005 request includes a large increase for the bilateral Global AIDS Initiative, headquartered at the Department of State, while the request for the Global Fund to Fight AIDS, Tuberculosis, and Malaria is $200 million, compared with $546.7 million appropriated in FY2004.

Terrorism: Some Legal Restrictions on Military Assistance to Domestic Authorities Following a Terrorist Attack
The Constitution empowers the President to act as Commander in Chief of the armed forces and to see to the execution of federal law; it gives Congress the authority to make federal law including laws for the regulation of the armed forces. The Posse Comitatus Act prohibits the use of the armed forces to perform civilian governmental tasks unless explicitly authorized to do so. There are statutory exceptions to ensure continued enforcement of state and federal law, to provide disaster assistance, and to provide technical support for law enforcement. There are constitutional impediments to the use of the military to nationalize an industry, to try civilians, and to compel state officials to perform federally-imposed duties.

Older Workers: Employment and Retirement Trends
As the members of the “baby boom” generation — people born between 1946 and 1964— approach retirement, the demographic profile of the U.S. workforce will undergo a substantial shift: a large number of older workers will be joined by relatively few new entrants to the labor force. According to the U.S. Bureau of the Census, while the number of people between the ages of 55 and 64 will grow by about 11 million between 2005 and 2025, the number of people who are 25 to 54 years old will grow by only 5 million. This trend could affect economic growth because labor force participation begins to fall after age 55. In 2004, 91% of men ages 25 to 54 and 75% of women in this age group participated in the labor force. In contrast, just 69% of men ages 55 to 64 and 56% of women ages 55 to 64 were either working or looking for work in 2004.

The Stock Market's Response to Dramatic Historical Events
The events of September 11, 2001, have caused speculation that the U.S. stock market may crash when trading resumes. History, however, suggests that there is no uniform pattern in which bad news is followed by a stock market plunge. This report presents data on the stock market response to four episodes: Pearl Harbor, the Kennedy assassination, the October 1987 stock market crash, and the Asian financial crisis of 1997. There is, of course, no guarantee that the market will behave now or in the future as it did then.

Disaster Unemployment Assistance (DUA)
The Disaster Unemployment Assistance (DUA) program provides monetary assistance to individuals unemployed as a direct result of a major disaster and who are not eligible for regular Unemployment Compensation (UC) benefits. DUA is funded through the Federal Emergency Management Agency (FEMA). DUA is administered by the Department of Labor (DOL) through each state’s UC agency. In the 109th Congress, P.L. 109-176 was signed into law on March 6, 2006, extending the duration of DUA benefits from 26 to 39 weeks for victims of the Hurricane Katrina and Rita disasters.

Hurricane Katrina: The Response by the Internal Revenue Service
After Hurricane Katrina, the Internal Revenue Service (IRS) announced several tax relief measures to aid affected individuals and businesses. They cover a range of subjects, from postponing deadlines for paying taxes and filing returns for individuals, employee benefit plans and tax-exempt bond issuers, to waiving penalties for certain fuel excise taxes. This report summarizes these measures and discusses the statutory authority for the IRS’s actions.

Bankruptcy Relief and Natural Disaster Victims
In the wake of Hurricane Katrina, many have questioned whether implementing the new procedures of the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA), P.L. 109-8, scheduled to go into effect on October 17, 2005, should be delayed. This report considers whether bankruptcy law in general, and the BAPCPA in particular, may present unique challenges to financial recovery for those whose life, livelihood, and/or home have been damaged or destroyed.

Farm Commodity Programs: Base Acreage and Planting Flexibility
This report discusses two policy issues that have arisen regarding planting flexibility on base acres, particularly restrictions on growing fruits and vegetables as an alternative crop. First, some Midwestern producers felt penalized because their history of growing fruits and vegetables reduced their soybean bases under the 2002 farm bill. H.R. 2045 and S. 1038 would allow certain fruits and vegetables to be grown without penalizing any future recalculation of base, while reducing a farm’s subsidy payments for one year. S. 194 would allow chicory to be grown on base acres. Second, a World Trade Organization (WTO) dispute settlement panel found that the restriction on planting fruits and vegetables made direct and counter-cyclical payments ineligible to be a nondistorting payment (green box) for international trade purposes.

Defense: FY2007 Authorization and Appropriations
A conference agreement on the FY2007 defense authorization bill, H.R. 5122/S. 2766, is expected soon, and could be voted on in the House as early as September 15. Key issues in the conference have included whether to promote the head of the National Guard to four-star rank and whether to approve multiyear procurement of the F-22 fighter aircraft. On June 22, the Senate passed on its version of the FY2007 defense authorization, S. 2766. The Senate rejected two amendments on Iraq policy, one by Senator Kerry calling for withdrawal of most forces by July 1, 2007, and another by Senator Levin calling for a phased reduction of troops to begin this year. The House passed its version of the authorization, H.R. 5122, on May 11. The House bill authorizes $513 billion for national defense, equal to the request. The Senate bill authorizes $517.7 billion.
