Mountaintop Mining: Background on Current Controversies

Mountaintop removal mining involves removing the top of a mountain in order to recover the coal seams contained there. This practice occurs in several Appalachian states. It creates an immense quantity of excess spoil (dirt and rock that previously composed the mountaintop), which is typically placed in valley fills on the sides of the former mountains, burying streams that flow through the valleys. Critics say that, as a result of valley fills, stream water quality and the aquatic and wildlife habitat that streams support are destroyed by tons of rocks and dirt. The mining industry argues that mountaintop mining is essential to conducting surface coal mining in the Appalachian region and that surface coal mining would not be economic or feasible there if producers were restricted from using valleys for the disposal of mining overburden. Mountaintop mining is regulated under several laws, including the Clean Water Act. This report provides background on current controversies, regulatory requirements, and legal challenges to Clean Water Act regulation of mountaintop mining. Congressional attention to these issues also is discussed.

Baseline Budget Projections: A Discussion of Issues

Between January 2001 and January 2005, the Congressional Budget Office (CBO) reduced its 10-year baseline projection for the period 2002-2011 from a peak surplus of $5.6 trillion to a deficit of $2.6 trillion for three reasons. First, about one third of the reduction is due to technical revisions CBO made to its projections (e.g., to account for the smaller than predicted growth in tax revenues). Second, the recession both reduced revenues and raised outlays automatically. This factor accounts for less than one-tenth of the 10-year decline, and is only significant in 2002 and 2003. Finally, about 60% of the reduction was due to policy changes, the largest of which was tax cuts, and the second largest of which was increased military outlays. Even without a recession or technical revisions, policy changes alone would have pushed the budget into deficit from 2003 to 2005.

Drug Control: International Policy and Approaches

Over the past decade, worldwide production of illicit drugs has risen dramatically: opium and marijuana production has roughly doubled and coca production tripled. Street prices of cocaine and heroin have fallen significantly in the past 20 years, reflecting increased availability. Despite apparent national political resolve to deal with the drug problem, inherent contradictions regularly appear between U.S. anti-drug policy and other national policy goals and concerns. The mix of competing domestic and international pressures and priorities has produced an ongoing series of disputes within and between the legislative and executive branches concerning U.S. international drug policy. One contentious issue has been the Congressionally-mandated certification process, an instrument designed to induce specified drug-exporting countries to prioritize or pay more attention to the fight against narcotics businesses.

A strengthened version of the Code would be one of the control mechanisms that would remain should the EU lift the embargo on arms exports to China. This report also gives information on recent EU arms exports authorized for China. It further summarizes U.S. concerns regarding the lifting of the arms embargo, and notes the prospective timing of EU action on the embargo issue.
