Crime and Forfeiture: The Innocent Third Party

Forfeiture has survived through time in American law, and since 1984, the use of forfeiture statutes to divest felons of their spoils has increased substantially. This report reviews the case law which raises the issue concerning many relative to whether some civil forfeiture proceedings constitute punishment which may violate the Eighth Amendment's excessive fines clause.

Monopoly and Monopolization - Fundamental But Separate Concepts in U.S. Antitrust Law

This report illustrates the difference between the concepts of “monopoly” and “monopolization” by touching on the monopoly/monopolization thinking in the Antitrust Division of the Department of Justice (DoJ) and the Federal Trade Commission (FTC), as illustrated in (1) statements on merger enforcement made by recent antitrust enforcement officials (generally indicative of the agencies’ concerns about competitive conditions and the effect of various market transactions), (2) the 1992 Horizontal Merger Guidelines 2 and (3) some observations on the Government actions against the Microsoft and Intel Corporations.

EPA's Tier 2 Proposal for Stricter Vehicle Emission Standards: A Fact Sheet

The Clean Air Act Amendments of 1990 established "Tier 1" standards to limit tailpipe emissions from new motor vehicles, and the Environmental Protection Agency (EPA) is required to determine if more stringent requirements are needed to attain or maintain National Ambient Air Quality Standards. EPA also must assess the availability and cost-effectiveness of technologies necessary to control emissions. In a report submitted to Congress in August 1998, EPA concluded that tougher standards are necessary and that essential technologies are available and cost-effective

Farm and Food Support Under USDA's Section 32 Program

This report discusses "Section 32", which is a permanent appropriation that since 1935 has earmarked the equivalent of 30% of annual customs receipts to support the farm sector through a variety of activities. Today, most of this sizeable appropriation (now about $5.7 billion per year) is simply transferred directly into the U.S. Department of Agriculture's (USDA's) child nutrition account to fund school feeding and other programs.

This report discusses the actions undertaken as a direct result of this act, additional pollution reduction enforcement measures pursued by the EPA, and actions undertaken by states to reduce offending emissions not in compliance with these measures.

Campaign Financing: Highlights and Chronology of Current Federal Law

Current law governing financial activity of campaigns for federal office is based on two principal statutes: the Federal Election Campaign Act (FECA) of 1971, as amended in 1974, 1976, and 1979, and the Revenue Act of 1971. These laws were enacted to remedy widely perceived shortcomings of existing law, the Corrupt Practices Act of 1925, and in response to reports of campaign finance abuses over the years, culminating in the 1972-1974 Watergate scandal. This report provides a summary of major provisions of federal law and a chronology of key legislative and judicial actions.

The Coastal Nonpoint Pollution Program: Status and Legislative Issues (open access)

The Coastal Nonpoint Pollution Program: Status and Legislative Issues

In 1990, Congress enacted legislation requiring coastal states and territories to develop programs to help address the problem of nonpoint source pollution in coastal waters, which are especially threatened by pressures of population growth, development, and pollution. The coastal nonpoint pollution program is unique because it expressly links federal and state coastal zone management and water quality programs. Coastal states are now implementing these requirements. Congress has not changed the program since its enactment, but legislative activity in the 106th Congress is possible. One issue receiving attention is whether to integrate the coastal nonpoint pollution program with the activities under the Coastal Zone Management Act.

Accident Prevention under the Clean Air Act Section 112(r): Risk Management Planning by Propane Users and Internet Access to Worst-Case Accident Scenarios

This report briefly describes two issues associated with EPA implementation of risk management planning requirements in the Clean Air Act Section 112(r): whether dealers and distributors of propane and other flammable fuels should be covered by the law, and whether electronic access to off-site consequence analyses (OCA), and especially worst-case analyses, should be restricted to avoid misuse by terrorists or criminals. These issues are addressed by S. 880, as reported, and H.R. 1301 in the 106th Congress. The statutory requrrements and EPA implementation to date also are described. Covered facilities must submit risk management plans by June 21, 1999. This product will be updated when events warrant. For information on the status of legislation, see CRS Issue Brief lB10004, Clean Air Act Issues in the 106th Congress.

The D.C. Circuit Remands the Ozone and Particulate Matter Clean-Air Standards: (open access)

The D.C. Circuit Remands the Ozone and Particulate Matter Clean-Air Standards:

On May 14, 1999, in American Trucking Ass'ns v. EPA, a U.S. court of Appeals ruled that deficiencies in EPA's promulgation of new primary and secondary air quality standards required that they be remanded to the agency for further consideration. The decision is controversial, in part because the two-judge majority opinion relied principally on a long-moribund legal doctrine known as the nondelegation doctrine. The decision, if it survives appeal, will thus have implications for all delegations of congressional authority to agencies. In addition, its holding that the revised ozone ambient standard cannot be enforced has sparkled debate. By itself, however, the decision is unlikely to have major short-term effects on the ozone and particulate matter control programs
