Authorization of the Surface Transportation Board (Board or STB), successor agency to the Interstate Commerce Commission, ended September 30, 1998. The FY2000 budget request is $16 million, $2.6 million of which could be offset by user fees which would become available at the beginning of FY2001. The Senate Commerce Committee scheduled a hearing for March 3, 1999, to consider S. 90, a bill to reauthorize the STB. In its most elemental form, the federal budget is a comprehensive accounting of the government’s spending, revenues, and borrowing. This fact sheet provides a brief overview of the basic terminology and concepts used in the federal budget process.

Budget reconciliation is an optional two-step process Congress may use to assure compliance with the direct spending, revenue, and debt-limit levels set forth in budget resolutions.

Sequestration is the cancellation of budgetary resources for the purpose of enforcing statutory budget limits and pay-as-you-go (PAYGO) requirements. This process is triggered automatically when these statutory limits or PAYGO rules have been violated as a result of legislative actions.

Sequestration--the automatic across-the-board cancellation of budgetary resources for the purpose of enforcing budgetary goals--was first established by the 1985 Balanced Budget and Emergency Deficit Control Act (Title II of P.L. 99-177). Section 254 of this act, as amended, provides a timetable for sequestration actions.

The issue arises occasionally whether it might be desirable to amend the U.S. Constitution to add an environmental provision - such as one declaring an individual right to a clean environment. Some attention was given this issue during the 1970s, when over a dozen states adopted clean environment or other environmentally oriented provisions in their constitutions. Our focus here is solely personal right to a clean environment provisions and the questions they raise. Are they self-executing, or dependent instead on implementing legislation? Do they create private rights of action? If so, on whose behalf, for what remedies, and against what categories of defendants? What is the standard to be enforced, and the level of proof needed to show injury? And so on. All these issues would arise as well were a federal-right-to-a-clean-environment provision to be proposed. In addition, a federal provision would implicate federalism concerns if its scope exceeded that of the Commerce Clause.
