Low-Income and Minority Serving Institutions: Sustained Attention Needed to Improve Education's Oversight of Grant Programs

Testimony issued by the Government Accountability Office with an abstract that begins "Higher education has become more accessible than ever before, although students from some demographic groups still face challenges in attending college. To help improve access to higher education for minority and low-income students, Titles III and V of the Higher Education Act, as amended, provide grants to strengthen and support institutions that enroll large proportions of these students. GAO was asked to testify on the Department of Education's (Education) oversight of institutions receiving Title III or V grants and progress Education has made in monitoring the financial and programmatic performance of Title III and V grantees. GAO's testimony is based primarily on its recent report, Low-Income and Minority Serving Institutions: Management Attention to Long-standing Concerns Needed to Improve Education's Oversight of Grant Programs (GAO-09-309, August 2009) and updated information provided by Education. In that report, GAO recommended that Education, among other things, (1) develop a comprehensive, risk-based approach to target monitoring and technical assistance; (2) ensure staff training needs are fully met; (3) disseminate information about implementation challenges and successful projects; and (4) develop appropriate feedback mechanisms. Testimony issued by the Government Accountability Office with an abstract that begins "To assist law enforcement agencies in their efforts to combat money laundering, terrorist financing, and other financial crimes, the Bank Secrecy Act (BSA) requires financial institutions to file suspicious activity reports (SAR) to inform the federal government of transactions related to possible violations of law or regulation. Depository institutions have been concerned about the resources required to file SARs and the extent to which SARs are used. The Subcommittee asked GAO to discuss our February 2009 report on suspicious activity reporting. Specifically, this testimony discusses (1) factors affecting the number of SARs filed, (2) actions agencies have taken to improve the usefulness of SARs, (3) federal agencies' use of SARs, and (4) the effectiveness of the process used to revise SAR forms. As a form of intellectual property, sound recordings are protected by copyright law. The copyright holder (e.g., a record company or performer) may use a license to grant third parties permission to use sound recordings, in return for compensation and compliance with other conditions of the license. Congress established a statutory copyright regime, including a statutory license, which among other things, avoids the potential problems associated with thousands of music service providers seeking licenses from many copyright holders. Under this regime, a party may invoke a statutory license to allow it to use sound recordings under certain conditions and according to specific requirements, in exchange for payment of a set royalty amount. Since 1976, the Copyright Royalty Tribunal, Copyright Arbitration Royalty Panels, and Copyright Royalty Judges have been responsible, successively, for recommending or setting rates, terms, and conditions for statutory licenses. To identify the mobility tools needed for force projection, the Department of Defense (DOD) has conducted several studies, including the fifth and most recent--the Mobility Capabilities and Requirements Study 2016 (MCRS-16). DOD issued the report in February 2010. The intent of the MCRS-16 was to provide senior leaders with a detailed understanding of the range of mobility capabilities needed for possible future strategic environments and help them make investment decisions regarding mobility systems. Correspondence issued by the Government Accountability Office with an abstract that begins "On September 6, 2008, the Federal Housing Finance Agency (FHFA) placed the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac) into conservatorships. FHFA took this step after concern developed that the deteriorating financial condition of the two government-sponsored enterprises (GSE), which had about $5.4 trillion in combined financial obligations, threatened the stability of financial markets. Since then, the Department of the Treasury (Treasury) has provided financial support to Fannie Mae and Freddie Mac (the enterprises) to help stabilize their financial condition and help ensure their ability to continue to support housing finance. As of September 2010, Treasury had provided about $150 billion in capital contributions to support the enterprises, and the Congressional Budget Office has estimated that the total cost to taxpayers could be nearly $400 billion over a 10-year period. In recent months, Congress and the administration have been considering a variety of proposals to reform the enterprises in order to help ensure their safety and soundness and the effectiveness of the U.S. housing finance system. The Foundation was formed in 1979 under the Congressional Award Act and is a private, nonprofit, tax-exempt organization under section 501(c)(3) of the Internal Revenue Code. It was established to promote initiative, achievement, and excellence among young people in the areas of public service, personal development, physical fitness, and expedition. During fiscal year 2009, there were approximately 27,700 participants registered in the Foundation's award program. The Deepwater Horizon was leased by BP America Production Company (BP) as part of the Macondo project. 152 days later, on September 19, 2010, BP confirmed the completion of cementing operations to prevent further oil from spilling from the Macondo Prospect well to which the Deepwater Horizon was attached when it exploded. In announcing the results of this review, the President reaffirmed the core strategic goal of disrupting, dismantling, and eventually defeating extremists in Afghanistan and Pakistan and preventing them from threatening the United States and its allies in the future. To meet this goal, the President announced his decision to rapidly deploy an additional 30,000 U.S. troops to Afghanistan. These industries provide jobs for a range of skilled workers, including songwriters, producers, engineers and technicians, and radio announcers, among others. At the same time, recording studios and radio stations allow musicians, vocalists, and performers to share their talents with listeners across the nation. Through their work, the recording and broadcast radio industries contribute to the everyday American experience by creating and delivering music to people in their homes, cars, and workplaces. Beyond providing a popular form of entertainment, the recording and broadcast radio industries have helped music become a prominent feature of American culture. Music, like other forms of creative art, is protected by copyright law. Congress is considering legislation that would expand copyright protection for sound recordings. However, some borrowers have limited or no credit histories, and lenders are unable to determine their creditworthiness using this traditional method. For these nontraditional borrowers, lenders may assess creditworthiness through alternative means, including the compilation of performance on rental payments; utility, phone, and cable television bills; and insurance or tuition payments. While some lenders have developed statistical scoring methods to determine borrowers' creditworthiness based on these data, others rely on the judgment of their staff to make determinations on a case-by-case basis, according to Department of Housing and Urban Development (HUD) officials. HUD permits lenders that originate mortgages insured by HUD's Federal Housing Administration (FHA) to establish a borrower's credit history through alternative means and has provided guidance to FHA lenders for evaluating these nontraditional credit histories. GAO's review of the use of Recovery Act funding in Mississippi this year included the Weatherization Assistance Program. Surface coal mining in the mountainous areas of Appalachia--a process often referred to as mountaintop mining--has generated opposition in recent years because of its impact on landscapes, streams, ecosystems, and communities. In mountaintop mining, before the underlying coal can be extracted, the land is cleared of forest and other vegetation. Explosives or other techniques are then used to break up the overlying solid rock, creating dislodged earth, rock, and other materials known as "spoil." Some or most of the spoil is placed back on the mined-out area; however, spoil that cannot be safely placed back is often placed as "fill" in adjacent valleys or hollows. In some cases, this fill buries the headwaters of streams. Activities associated with surface coal mining are regulated under both the Surface Mining Control and Reclamation Act (SMCRA) and the Clean Water Act (CWA).3 SMCRA requires mine operators to obtain a permit before they begin mining. Use of the Railroad Retirement Board Occupational Disability Program across the Rail Industry

Correspondence issued by the Government Accountability Office with an abstract that begins "We recently reported that Long Island Rail Road (LIRR) workers applied for U.S. Railroad Retirement Board (RRB) occupational disability benefits at a rate 12 times higher than workers from the other commuter railroads covered under the Railroad Retirement Act. RRB provides an occupational disability benefit to eligible workers whose physical or mental impairments prevent them from performing their specific railroad jobs. For example, a railroad engineer who cannot frequently climb, bend, or reach, as required by the job, may be found occupationally disabled. On March 18, 2009, Congress asked us to conduct a systematic review of RRB's occupational disability program. Per our discussions following the release of our September 2009 report on LIRR and commuter rail workers' experience with the program, Congress refined its request. It told us that its primary interest was quickly determining whether unusual patterns in claims like those exhibited at LIRR exist elsewhere across the rail industry, including class I, II, and III railroads. Correspondence issued by the Government Accountability Office with an abstract that begins "The Department of Justice (DOJ) awards an array of law enforcement and criminal justice grants to states, localities, and private and not-for-profit organizations to help prevent crime in their communities. From fiscal years 2008 through 2009, DOJ's Office of Justice Programs (OJP) awarded over 7,900 grants totaling over $4.2 billion. Some DOJ grant programs emphasize the prevention of crime and juvenile delinquency, and in some instances, DOJ's grant funds have been used, in part, to support recreational activities for youth involving various sports programs and field trips. In addition, DOJ grant recipients, such as a state's department of juvenile justice services, may provide grant funds to a subgrantee, like the Boys and Girls Club of America, to carry out various activities, such as mentoring or antigang initiatives, within the overall parameters of the grant program. However, no DOJ grant programs are designed to fund recreational activities exclusively.
