However, as GAO previously reported, the agencies have faced challenges in obtaining sufficient information to manage these contracts and assistance instruments. As part of our third review under the National Defense Authorization Act for Fiscal Year (FY) 2008, as amended, GAO assessed the implementation of the Synchronized Predeployment and Operational Tracker (SPOT) and data reported by the three agencies for Afghanistan and Iraq for FY 2009 and the first half of FY 2010 on the (1) number of contractor and assistance personnel, including those providing security; (2) number of personnel killed or wounded; and (3) number and value of contracts and assistance instruments and extent of competition for new awards. For-Profit Schools: Large Schools and Schools that Specialize in Healthcare Are More Likely to Rely Heavily on Federal Student Aid

A letter report issued by the Government Accountability Office with an abstract that begins "In the 2008-2009 school year, about 2,000 for-profit schools received almost $24 billion in grants and loans provided to students under federal student aid programs. In the early 1990s, Congress was concerned that some for-profit schools receiving federal student aid were recruiting students who were not ready for higher education. Many of these students left school with no new job skills and few employment prospects in their fields of study and many defaulted on their federal student loans. In response, Congress enacted the 85/15 rule in 1992, which required for-profit schools to obtain at least 15 percent of their revenues from sources other than federal student aid. Proponents of the rule believed that for-profit schools offering a quality education should be able to earn a minimum percentage of their revenue from sources other than federal student aid. In 1998, Congress amended this law to create the 90/10 rule, which reduced to 10 percent the proportion of revenues schools must obtain from sources other than federal student aid. GAO was asked to identify barriers to the employment of people with disabilities in the federal workforce and leading practices that could be used to overcome these barriers. On July 20, 2010, GAO convened a forum to identify leading practices that federal agencies could implement within the current legislative context. In preparation for the forum, GAO surveyed a wide range of knowledgeable individuals to identify barriers and leading practices. Forum participants were selected from among respondents (or their representatives) to reflect varying expertise and views concerning the employment of individuals with disabilities. The survey results formed the basis for the initial forum agenda, and were refined by participants to focus on actions they deemed most important. The ban applies to all postsecondary schools, including private for-profit, public, and private nonprofit schools. Congress instituted this incentive compensation ban to eliminate deceptive recruiting practices and to protect federal student aid funds from fraud and abuse. However, we recently found evidence of deceptive or fraudulent recruitment practices at certain postsecondary schools in which school officials misrepresented programs or encouraged students to falsify their financial aid applications to obtain federal student aid. Questions have been raised about whether schools are consistently acting in the best interest of students during the recruitment process, and whether the federal investment in student aid is adequately protected. However, since 2003, NNSA's efforts to produce tritium have been hampered by technical challenges. Funds were made available to states and the District through an increase in the Federal Medical Assistance Percentage (FMAP), the rate at which the federal government matches state expenditures for most Medicaid services. In March 2010, Congress passed the Patient Protection and Affordable Care Act (PPACA), which prohibits states from adopting certain changes to program eligibility in order to receive federal reimbursement, and in August 2010, extended increased FMAP rates through June 2011. GAO was asked to examine issues related to Medicaid funds under the Recovery Act. In 2008, the Robert Wood Johnson Foundation reported that about 25 percent of children with insurance and about 55 percent of uninsured children did not receive a recommended routine checkup within the previous year. According to the Department of Health and Human Services (HHS), children face growing risks from chronic physical conditions such as asthma and obesity and from mental health disorders such as depression, and yet, as we have reported, their access to services may be impeded by a number of barriers, including a lack of health insurance and a lack of convenient transportation to medical appointments. Access to mental health care services may also be impeded by concerns about stigma--negative attitudes and beliefs often associated with receiving such care--which can be a deterrent to seeking these services. After abandoning an earlier, more expensive missile and a joint service effort, the Air Force began producing the Joint Air-to-Surface Standoff Missile (JASSM) in 2001. After that, the program (1) encountered many flight test failures, (2) decided to develop an extended range version, and (3) recognized significant cost growth. The production decision for the JASSM-ER is planned for November 2010. Also, the Secretary of Defense has recently announced a major initiative to restore affordability and productivity in defense spending. This initiative is expected to, among other things, identify savings by conducting needed programs more efficiently. As DOD faces the initial production decision on JASSM-ER, GAO was asked to assess (1) most recent test results, correction of causes of previous flight test failures, and efforts to improve JASSM's reliability; and (2) JASSM cost changes, efforts to control costs, and additional cost risks for the program."

Enforcing IP laws involves many U.S. agencies, making coordination essential. Under the Prioritizing Resources and Organization for Intellectual Property Act of 2008 (PRO-IP Act), Congress required the U.S. Attorney General, through the Department of Justice (DOJ), to devote additional resources and undertake other specific IP efforts. The PRO-IP Act also created the position of the Intellectual Property Enforcement Coordinator (IPEC) to enhance interagency coordination. The act mandates that GAO provide Congress with a report on the efforts of DOJ and the IPEC. This status report addresses DOJ and Office of the IPEC's efforts to implement the act. The report also compares the 2010 Joint Strategic Plan on Intellectual Property Enforcement to the content called for in the PRO-IP Act. A letter report issued by the Government Accountability Office with an abstract that begins "The American Recovery and Reinvestment Act of 2009 (Recovery Act) requires recipients to report, among other things, project descriptions on Recovery.gov, the federal Recovery Act Web site. Within the Department of Homeland Security, the Federal Emergency Management Agency's (FEMA) Grant Programs Directorate administers the Port Security Grant Program (PSGP) to strengthen ports against risks from terrorist attacks. FEMA received and obligated $150 million in Recovery Act PSGP funds in 2009, and, as of September 2010, recipients have drawn down over $10 million. To facilitate recipient reporting, FEMA must consider the need both for transparency and for protection of Sensitive Security Information (SSI), which could be detrimental to transportation security if disclosed. As requested, GAO assessed FEMA's: (1) controls to ensure Recovery Act PSGP staff consistently follow SSI policies, and (2) steps to ensure PSGP recipients have not disclosed SSI on Recovery.gov. GAO reviewed relevant laws, regulations, guidance, and a random sample of PSGP Recovery Act recipient reports available as of February 2010, and interviewed agency officials."

Private Pensions: Changes Needed to Better Protect Multiemployer Pension Benefits

A letter report issued by the Government Accountability Office with an abstract that begins "Thirty years ago Congress enacted protections to ensure that participants in multiemployer pension plans received their promised benefits. These defined benefit plans are created by collective bargaining agreements covering more than one employer. Today, these plans provide pension coverage to over 10.4 million participants in approximately 1,500 multiemployer plans insured by the Pension Benefit Guaranty Corporation (PBGC). In this report, GAO examines (1) the current status of nation's multiemployer plans; (2) steps PBGC takes to monitor the health of these plans; (3) the structure of multiemployer plans in other countries; and (4) statutory and regulatory changes that could help plans provide participants with the benefits they are due. To address these questions, GAO analyzed government and industry data and interviewed government officials, pension experts and plan practitioners in the United States, the Netherlands, Denmark, United Kingdom, and Canada."

A letter report issued by the Government Accountability Office with an abstract that begins "The Department of Homeland Security's (DHS) Secure Border Initiative Network (SBInet) is to place surveillance systems along our nation's borders and provide Border Patrol command centers with the imagery and related tools and information needed to detect breaches and make agent deployment decisions. To deliver SBInet, DHS has relied heavily on its prime contractor. Because of the importance of effective contractor management and oversight to SBInet, GAO was asked to determine the extent to which DHS (1) defined and implemented effective controls for managing and overseeing the prime contractor and (2) effectively monitored the contractor's progress in meeting cost and schedule expectations. To do this, GAO analyzed key program documentation against relevant guidance and best practices, and interviewed program officials."

A letter report issued by the Government Accountability Office with an abstract that begins "Over the last 5 years, Border Patrol has nearly doubled the number of its agents on patrol, constructed hundreds of miles of border fence, and installed surveillance equipment on and near lands managed by the Departments of the Interior and Agriculture along the southwestern border. In so doing, the agency has had to comply with federal land management laws, and some have expressed concern that these laws may limit agents' abilities to detect and apprehend undocumented aliens. GAO was asked to examine (1) key land management laws Border Patrol operates under and how it and land management agencies coordinate their responsibilities under these laws; (2) how Border Patrol operations are affected by these laws; and (3) the extent to which land management agencies collect and use data related to the environmental effects of illegal activities, such as human trafficking and drug smuggling. GAO reviewed key land management laws, interviewed agents-in-charge at 26 Border Patrol stations responsible for patrolling federal southwest borderlands, and interviewed managers of these lands."
