Awards of Attorneys' Fees by Federal Courts and Federal Agencies

In the United States, the general rule, which derives from common law, is that each side in a legal proceeding pays for its own attorney. There are many exceptions, however, in which federal courts, and occasionally federal agencies, may order the losing party to pay the attorneys’ fees of the prevailing party. The major common law exception authorizes federal courts (not agencies) to order a losing party that acts in bad faith to pay the prevailing party’s fees. This report discusses the Equal Access to Justice Act (EAJA), which makes the United States liable for attorneys’ fees of up to $125 per hour in many court cases and administrative proceedings that it loses (and some that it wins) and fails to prove that its position was substantially justified.

Certification of Completion of Level-2 Milestone 464: Complete Phase 1 Integration of Site-Wide Global Parallel File System (SWGPFS)

There has been substantial development of the Lustre parallel filesystem prior to the configuration described below for this milestone. The initial Lustre filesystems that were deployed were directly connected to the cluster interconnect, i.e. Quadrics Elan3. That is, the clients (OSSes) and Meta-data Servers (MDS) were all directly connected to the cluster's internal high speed interconnect. This configuration serves a single cluster very well, but does not provide sharing of the filesystem among clusters. LLNL funded the development of high-efficiency ''portals router'' code by CFS (the company that develops Lustre) to enable us to move the Lustre servers to a GigE-connected network configuration, thus making it possible to connect to the servers from several clusters. With portals routing available, here is what changes: (1) another storage-only cluster is deployed to front the Lustre storage devices (these become the Lustre OSSes and MDS), (2) this ''Lustre cluster'' is attached via GigE connections to a large GigE switch/router cloud, (3) a small number of compute-cluster nodes are designated as ''gateway'' or ''portal router'' nodes, and (4) the portals router nodes are GigE-connected to the switch/router cloud. Dsdp5 User Guide - Software for Semidefinite Programming.

DSDP implements the dual-scaling algorithm for semidefinite programming. The source code of this interior-point solver, written entirely in ANSI C, is freely available. The solver can be used as a subroutine library, as a function within the Matlab environment, or as an executable that reads and writes to files. Initiated in 1997, DSDP has developed into an efficient and robust general-purpose solver for semidefinite programming. Although the solver is written with semidefinite programming in mind, it can also be used for linear programming and other constraint cones. The features of DSDP include the following: a robust algorithm with a convergence proof and polynomially bounded complexity under mild assumptions on the data, primal and dual solutions, feasible solutions when they exist or approximate certificates of infeasibility, initial points that can be feasible or infeasible, relatively low memory requirements for an interior-point method, sparse and low-rank data structures, extensibility that allows applications to customize the solver and improve its performance, a subroutine library that enables it to be linked to larger applications, scalable performance for large problems on parallel architectures, and a well-documented interface and examples of its use. Enhanced Energetic Stability and Optical Activity of Symmetry-Reduced C60

Since its discovery in 1985, the celebrated geodesic cage structure of the C{sub 60} molecule has been recognized: a truncated icosahedron in which all sixty vertices are equivalent and has the full I{sub h} symmetry, making it thus far the most spherical of all known molecules. Inherent in this high symmetry is an intricate network of electron-phonon coupling, evident in phonon progressions and vibronic peak broadening, and resulting in structural distortions of neutral C{sub 60} in the presence of solvent. Within the I{sub h} symmetry group of this molecule, of the forty-six distinct vibrational frequencies only ten are Raman-active and four are IR-active (in the first order), while the remaining 32 modes are optically silent. Symmetry-reduced structures of C{sub 60} would activate some of these silent modes, which could then be amenable to experimental verification such as in resonance Raman scattering. Here, quantum chemical calculations within density functional theory establish for the first times (1) lower-symmetry, energetically more stable structures for C{sub 60}, the lowest of which is of D{sub 3d} symmetry, and with a new assignment of the ground state as the {sup 1}A{sub 1g} state, (2) the activation of some IR and Raman I{sub h} silent modes: the …

Establishment of an Industry-Driven Consortium Focused on Improving the Production Performance of Domestic Stripper Wells

The Pennsylvania State University, under contract to the U.S. Department of Energy, National Energy Technology Laboratory will establish, promote, and manage a national industry-driven Stripper Well Consortium (SWC) that will be focused on improving the production performance of domestic petroleum and/or natural gas stripper wells. The consortium creates a partnership with the U.S. petroleum and natural gas industries and trade associations, state funding agencies, academia, and the National Energy Technology Laboratory. This report serves as the sixth quarterly technical progress report for the SWC. Key activities for this reporting period included: (1) Organized and hosted two technology transfer meetings; (2) Collaborated with the Pennsylvania Oil and Gas Association (POGAM) to host a Natural Gas Outlook conference in Pittsburgh, PA; (3) Provided a SWC presentation at the Interstate Oil and Gas Compact Commission (IOGCC) meeting in Jackson Hole, WY; and (4) Completed and released a stripper well industry documentary entitled: ''Independent Oil: Rediscovering America's Forgotten Wells''.
