Freedom of Speech and Press: Exceptions to the First Amendment
The First Amendment to the United States Constitution provides that “Congress shall make no law . . . abridging the freedom of speech, or of the press. . . .” This language restricts government both more and less than it would if it were applied literally. It restricts government more in that it applies not only to Congress, but to all branches of the federal government, and to all branches of state and local government. It restricts government less in that it provides no protection to some types of speech and only limited protection to others. This report provides an overview of the major exceptions to the First Amendment — of the ways that the Supreme Court has interpreted the guarantee of freedom of speech and press to provide no protection or only limited protection for some types of speech.

Commemorative Observances: A Chronological List
Historically, national commemorative observances were recommended by Congress through the legislative process. This practice was discontinued by the House of Representatives in January 1995, although the Senate continues to issue sense of the Senate resolutions recommending the establishment of commemoratives. It has now become standard practice for special observances to be designated by a proclamation issued by the President. Afghanistan: Narcotics and U.S. Policy
This report describes the structure and development of the narcotics trade in Afghanistan and explores its relevance to Afghan, U.S., and international security interests, including the 9/11 Commission’s recommendation that the United States make a long term commitment to the stability and security of Afghanistan. The report provides current statistical information on the opium trade, profiles its various participants, explores alleged narco-terrorist linkages, and reviews the U.S. and international policy response since late 2001. How Medicaid Works: Program Basics
Medicaid is a means-tested entitlement program that has been in existence for over 35 years. It provides primary and acute care as well as long-term care to over 40 million Americans at a cost to federal and state governments of approximately $258.2 billion in FY2002. Iraq: U.S. Regime Change Efforts and Post-Saddam Governance
Operation Iraqi Freedom accomplished a long-standing objective, the overthrow and capture of Saddam Hussein, but replacing that regime with a stable, moderate, democratic political structure has run into difficulty. Past U.S. efforts to change the regime failed because of limited U.S. commitment, disorganization of the Iraqi opposition, and the efficiency and ruthlessness of Iraq’s several overlapping security services. Previous U.S. Administrations had ruled out major U.S. military action to change Iraq’s regime, believing such action would be risky and not necessarily justified by the level of Iraq’s lack of compliance on WMD disarmament.

Earmarks and Limitations in Appropriations Bills
An annual appropriations act is generally made up of separate paragraphs, each of which provides funding for specific agencies and programs. Generally, each paragraph corresponds to a unique account and provides appropriations for multiple projects and purposes as a single lump sum. Earmarks and limitations are two devices regularly used in annual appropriations acts to restrict, or more precisely direct, the availability of funds for specific projects or purposes of an account. Sometimes an earmark or a limitation may generate more interest or controversy than the total appropriation.

Survey of Federal Laws and Regulations Mandating Affirmative Action Goals, Set-asides, or Other Preference Based on Race, Gender, or Ethnicity
This report provides a broad but by no means an exhaustive, survey of federal statutes and regulations that specifically refer to race, gender, or ethnicity as factors to be considered in the administration of any federal program. Such measures may include, but are not limited to, goals, timetables, set-asides, and quotas, as those terms are generally (however imperfectly) understood. Based on several searches of LEXIS/NEXIS and WESTLAW legal databases, and a variety of search strategies, the compilation seeks to be as comprehensive as possible. With certain noted exceptions, the report collectively describes those statutes, regulations, or executive orders uncovered by our research which appear, in any manner, to prefer or consider race, gender, or ethnicity as affirmative factors in federal employment, in the allocation of federal contracts, or in granting any federal benefit to individuals or institutions. Several laws and regulations directed to “socially and economically disadvantaged” individuals and institutions are included because, as more fully explained by the report, that term has been defined administratively and by statute to presumptively apply to specific racial and ethnic minorities.
