Dairy Policy Issues

Many dairy farmer groups are concerned that imports of milk protein concentrates (MPCs) are displacing domestic dairy ingredients and thus depressing farm milk prices. S.560 and H.R. 1160 would impose tariff rate quotas on certain MPCs, and S. 40 would prohibit the use of dry MPC in domestic cheese production. Dairy processor groups are opposed to these bills. A dairy producer group challenged the Customs Service classification of MPCs, but Customs ruled that current classifications are correct.

Country-of-Origin Labeling for Foods

Federal law requires most imports, including many food items, to bear labels informing the “ultimate purchaser” of their country of origin. Meats, produce, and several other raw agricultural products generally have been exempt. The omnibus farm law (P.L. 107-171) signed on May 13, 2002, contains a requirement that many retailers provide, starting on September 30, 2004, country-of-origin labeling (COOL) on fresh fruits and vegetables, red meats, seafood, and peanuts. The program is voluntary until then. USDA on October 8, 2002, issued guidelines for the voluntary labeling program.

The International Wine Market: Description and Selected Issues

This report discusses the global trade in wine, which has increased rapidly during the past 25 years, steadily rising from under $1 billion in 1977 to over $7 billion in 2001. Reports of health benefits and rising global incomes have spurred increasing demand for wine, particularly in mid- to upper-income countries. In 2001, the United States was the world’s leading importer, just ahead of the European Union (EU). Together, they accounted for over 60% of global imports.

"Digital Rights" and Fair Use in Copyright Law

This report examines judicial case law which has considered the doctrine of fair use in relation to the First Amendment, the Digital Millennium Copyright Act, and as a means of protecting private, noncommercial use of digital music and film by consumers. It concludes that when the potential to infringe is great, as it almost always will be in a digital environment, the courts have not been willing to expand fair use to encompass subsidiary uses such as time shifting, space shifting, or personal noncommercial use.

House procedures to elect an officer during a Congress differ from those followed at the start of a Congress. A resolution to elect a replacement officer to fill a vacancy during a Congress is privileged and debatable under the hour rule. By statute, the Speaker has authority to appoint a temporary replacement officer, and in some cases, temporary appointments have continued in effect for the remainder of a Congress. This report describes the consultative process that ultimately led to Father Coughlin’s temporary appointment, and related parliamentary issues concerning the selection of House officers.

East Central Europe: Status of International Criminal Court (ICC) Exemption Agreements and U.S. Military Assistance

In a broad effort to obtain U.S. exemptions from International Criminal Court (ICC) jurisdiction, the Bush Administration has sought to conclude bilateral agreements worldwide that would prohibit the transfer of U.S. citizens to the ICC. The European Union has strongly promoted the ICC and is opposed to the U.S.- proposed agreements. This report addresses twelve countries of east central Europe affected by the U.S. and European policies – Albania, Bosnia-Herzegovina, Bulgaria, Croatia, Estonia, Latvia, Lithuania, the former Yugoslav Republic of Macedonia, Romania, Serbia and Montenegro, Slovakia, and Slovenia – and the status of their varied approaches to the transatlantic disagreement over the ICC.

The Bill Emerson Humanitarian Trust: Background and Current Issues

The Bill Emerson Humanitarian Trust is becoming a critical component of the U.S. response to humanitarian food emergencies in Africa, Iraq, and elsewhere. The Trust, as presently constituted, was enacted in the 1998 Africa Seeds of Hope Act (P.L. 105- 385). It replaced the Food Security Commodity Reserve established in 1996 and its predecessor the Food Security Wheat Reserve of 1980. This report discusses the administration’s proposals to reduce food aid’s reliance on surplus commodities and anticipated demand for emergency food aid have focused renewed attention on the Emerson Trust, which has been used four times in FY2002 and FY2003 to meet unanticipated food needs in Africa and Iraq.
