The Public Utility Holding Company Act of 1935 (PUHCA) and the Federal Power Act (FPA) were enacted to eliminate unfair practices and other abuses by electricity and gas holding companies by requiring federal control and regulation of interstate public utility holding companies. Comprehensive energy legislation has passed the House and Senate. The House passed H.R. 6 on April 11, 2003. On July 31, 2003, the Senate suspended debate on S. 14, inserted the text of H.R. 4 (107th Congress) as a substitute, and passed H.R. 6. A conference agreement was reached November 17, 2003, and passed by the House the next day. H.R. 6 includes an electricity title that would, in part, repeal PUHCA, would prospectively repeal the mandatory purchase requirement under PURPA, and would create an electric reliability organization. On June 15, 2004, H.R. 4503, a comprehensive energy policy bill, passed the House.

On July 31, 2003, the Senate, facing obstacles to passage of its comprehensive energy bill (S. 14), substituted the energy legislation the Senate had passed and sent to conference in the 107th Congress. Principals are sorting out the implications of this unanticipated development; there are identical or similar provisions in both S. 14 and the substitute measure that the Senate passed as H.R. 6, but there are also significant differences.

On April 10, 2003, the House passed comprehensive energy legislation, H.R. 6 (247- 175). The bill was a composite of four measures – H.R. 39, reported from the House Committee on Resources, H.R. 238, marked up by the House Science Committee, H.R. 1531, reported from Ways and Means, and an unnumbered bill reported out of the Energy and Commerce Committee. Unlike comprehensive energy legislation (H.R. 4) debated in the 107th Congress, H.R. 6 includes a section on electricity which has stirred some controversy. H.R. 6 would provide authorization for exploration and development of the Arctic National Wildlife Refuge (ANWR).

On July 25, 2003, the House approved a supplemental appropriations measure (H.R. 2859) that provides $983.6 million for the Disaster Relief Fund administered by the Federal Emergency Management Agency (FEMA) within the Department of Homeland Security (DHS). During debate Members rejected an amendment to require a rescission from discretionary accounts to compensate for the supplemental. On July 31 the Senate approved the House-passed version of H.R. 2859. The President signed the Emergency Supplemental Appropriation for Disaster Relief Act of 2003 (P.L. 108-69) on August 8, 2003.

Proposals to replace all or part of the income tax, proposals for national health care, and a proposal to finance America’s war effort have sparked congressional interest in the possibility of a broad-based consumption tax as a new source of revenue. A value-added tax (VAT) or a national sales tax (NST) have been frequently discussed as possible new tax sources. Both the VAT and the NST are taxes on the consumption of goods and services and are conceptually similar. Yet, these taxes also have significant differences. On October 15, 1992, the United States ratified the United Nations Framework Convention on Climate Change (UNFCCC), which entered into force on March 21, 1994. This committed the United States to “national policies” to limit “its anthropogenic emissions of greenhouse gases,” with a voluntary goal of returning “emissions of carbon dioxide [CO2] and other greenhouse gases [methane (CH4), nitrous oxide (N2O), hydrofluorocarbons (HFCs), perfluorocarbons (PFCs), and sulfur hexafluoride (SF6)]” at the “end of the decade” to “their 1990 levels.”

The Air Force is proposing to replace 133 of its oldest Boeing KC-135E aerial refueling tanker aircraft by leasing 100 new Boeing KC-767 tankers instead of initially buying them outright. The proposed lease was authorized by Section 8159 of the FY2002 DOD Appropriations Act (P.L. 107-117 of January 10, 2002). The main issue for Congress is whether to approve or disapprove the lease.
