The Public Utility Holding Company Act of 1935 (PUHCA) and the Federal Power Act (FPA) were enacted to eliminate unfair practices and other abuses by electricity and gas holding companies by requiring federal control and regulation of interstate public utility holding companies. Comprehensive energy legislation has passed the House and Senate. The House passed H.R. 6 on April 11, 2003. On July 31, 2003, the Senate suspended debate on S. 14, inserted the text of H.R. 4 (107th Congress) as a substitute, and passed H.R. 6. A conference agreement was reached November 17, 2003, and passed by the House the next day. H.R. 6 includes an electricity title that would, in part, repeal PUHCA, would prospectively repeal the mandatory purchase requirement under PURPA, and would create an electric reliability organization. On June 15, 2004, H.R. 4503, a comprehensive energy policy bill, passed the House.

Federal law requires most imports, including many food items, to bear labels informing the “ultimate purchaser” of their country of origin. Meats, produce, and several other raw agricultural products generally have been exempt. The omnibus farm law (P.L. 107-171) signed on May 13, 2002, contains a requirement that many retailers provide, starting on September 30, 2004, country-of-origin labeling (COOL) on fresh fruits and vegetables, red meats, seafood, and peanuts. The program is voluntary until then. USDA on October 8, 2002, issued guidelines for the voluntary labeling program.

On November 5, 1990, the Omnibus Budget Reconciliation Act of 1990 (P.L. 101-508) was signed into law. P.L. 101-508 added Title V to the Congressional Budget Act. Title V, also called the Federal Credit Reform Act of 1990 (the FCRA), changed how the unified budget reports the cost of federal credit activities (i.e., federal direct loans and loan guarantees). Before the fiscal year 1992 (FY1992), for a given fiscal year, the budgetary cost of a new direct loan or loan guarantee was the net cash flow for that fiscal year.

The idea of replacing our current income tax system with a "flat-rate tax" is receiving renewed congressional interest. This report contains information on recent developments regarding flat-rate taxes, the relationship between income and consumption, international comparisons, other fundamental tax reforms, and descriptions of selected proposals.

Some Members of Congress have expressed interest in the feasibility of using a value-added tax (VAT) to either replace all or part of the income tax, finance health care reform, or to fund America’s war effort. A VAT is imposed at all levels of production on the differences between firms’ sales and their purchases from all other firms. Policymakers may be interested in the following aspects of a VAT: revenue yield, international comparison of composition of taxes, vertical equity, neutrality, inflation, balance-of-trade, national saving, administrative cost, intergovernmental relations, size of government, and public opinion.

Proposals to replace all or part of the income tax, proposals for national health care, and a proposal to finance America’s war effort have sparked congressional interest in the possibility of a broad-based consumption tax as a newsource of revenue. A value-added tax (VAT) or a national sales tax (NST) have been frequently discussed as possible new tax sources. Both the VAT and the NST are taxes on the consumption of goods and services and are conceptually similar. Yet, these taxes also have significant differences. This issue brief discusses some of the potential policy implications associated with these differences.
