D.C. Criminal Justice System: Better Coordination Needed Among Participating Agencies

Although any criminal justice system faces coordination challenges, the unique structure and funding of the District of Columbia (D.C.) criminal justice system, in which federal and D.C. jurisdictional boundaries and dollars are blended, creates additional challenges. Almost every stage of D.C.'s criminal justice process presents such challenges, and participating agencies are sometimes reluctant to coordinate because the costs to implement needed changes may fall on one or more federally funded agencies, while any savings accrue to one or more D.C. funded agencies, or vice versa. The Criminal Justice Coordinating Council (CJCC) was established and staffed as an independent entity to improve systemwide coordination and cooperation. During its two and a half-year existence, CJCC has served as a useful, independent, discussion forum at a modest cost. It has had notable success in several areas in which agencies perceived a common interest, such as developing technology that permits greater information sharing. A letter report issued by the General Accounting Office with an abstract that begins "Twenty-one percent of grant-eligible applicants who did not use the District of Columbia's tuition assistance grant (TAG) funding to attend a participating college or university may have encountered such barriers as college entrance requirements and the absence of minority outreach programs. Whether enrollment caps at colleges posed a barrier for applicants is unclear. In the program's first year, 516 of the nearly 2,500 eligible applicants did not use the grants. About 21 percent of the institutions in which applicants expressed interest restrict the number of out-of-state students that they will accept, although the extent to which this played a role in limiting access to these institutions is unclear. Enrollment at the University of the District of Columbia (UDC) changed little during the TAG program's first year. The TAG program and UDC appeared to serve different freshmen populations, which may account for the TAG program's minimal impact on UDC enrollment. Correspondence issued by the General Accounting Office with an abstract that begins "Since May 2000, California's restructured electricity market has experienced rapidly rising prices and uncertain reliability. In response to disruptions in service, or blackouts, the state has taken steps to increase electricity supplies and to reduce demand through conservation. The California Independent System Operator, the agency in charge of balancing electricity supply with demand, expects high prices and disruptions to persist, and perhaps even worsen, in the summer of 2001. This report reviews (1) the condition of California's electricity market, including changes in demand, supply, and prices; (2) the extent to which the Department of Defense (DOD) can help enhance western electricity supplies during the summer of 2001; and (3) available private backup generation resources and any benefits and problems associated with their deployment. GAO found that electricity demand has risen sharply in recent years while supply has not kept up with the demand, causing higher prices. DOD could help augment western electricity supplies by generating an estimated 90 megawatts of electricity and implementing conservation initiatives. The use of private generation is limited because of business and environmental risks."

Correspondence issued by the General Accounting Office with an abstract that begins "As the electricity industry restructures, California and the west have witnessed extraordinarily high wholesale prices and sharp limitations on the availability of electricity. In California, high prices have led to financial problems for the state's utilities, power outages, and rate increases. In other Western states, the high prices have also led to rate increases for consumers. This report assesses the outlook for California's electricity supplies this summer. Because of a lack of timely direct access to key information and limitation in other data, GAO was unable to assess likely conditions in California. To make an independent, reliable assessment, GAO would need access to data underlying key supply and demand factors, such as power plant outages and electricity supplies that could be imported into California. Furthermore, forecasts of California's electricity market show stark differences in the expected conditions this summer."

Testimony issued by the General Accounting Office with an abstract that begins "Oversight of the Central Intelligence Agency (CIA) generally comes from two select committees of Congress and the CIA's Inspector General. GAO has broad authority to evaluate CIA programs. In reality, however, GAO faces both legal and practical limitations on its ability to review these programs. For example, it has no access to some CIA "unvouchered" accounts and cannot compel its access to foreign intelligence and counterintelligence information. In addition, as a practical matter, GAO is limited by the CIA's level of cooperation, which has varied through the years. GAO has not actively audited the CIA since the early 1960s, when it discontinued such work because CIA was not providing it with enough access to information to allow GAO to do its job. The issue has arisen since then from time to time as GAO's work has required some level of access to CIA programs and information. However, given a lack of requests from Congress for GAO to do specific work at the CIA and its limited resources, GAO made a decision not to pursue the issue further. GAO studied the propriety of practices for bidding, awarding, and monitoring contracts and the adequacy of controls to monitor fuel and other payments to vendors. The network was moved to the Federal Reserve Bank of Atlanta (FRB Atlanta) in September 1998 and renamed Check Relay. Check Relay's internal controls are designed to ensure that each step of the contract evaluation and approval process conforms to FRB Atlanta and Federal Reserve System policies and that appropriate senior officials review and approve contract terms. Check Relay also ensures that all payments to vendors conform to contract terms. Another set of controls verifies that the amount of fuel used by Check Relay's vendors is consistent with expected levels and that fuel is provided only to the appropriate recipients. Check Relay is managed as a unit of the Retail Payments Office, which is managed out of FRB Atlanta. However, neither DOD nor the services have systematically examined the adequacy of the current specialty mix of medical personnel for CB defense. Although some of the services have begun to review the adequacy of staffing of deployable medical units that would manage the consequences of chemical warfare scenarios, they have not done so for biological warfare scenarios. Joint protocols for treating CB casualties have recently been completed, but the services have not yet agreed on which health care providers should provide treatment. Relatively few military health care providers are trained to a standard of proficiency in providing care to CB casualties. The service surgeons general have begun integrating chemical and a few biological scenarios into their medical exercises, but no realistic field exercise of medical support for CB warfare had been concluded. DOD and the services have not fully addressed weaknesses and gaps in modeling, planning, training, tracking, or proficiency testing for the treatment of CB casualties. Testimony issued by the General Accounting Office with an abstract that begins "A 1995 Presidential Decision Directive gave the highest priority to developing the capabilities to detect, prevent, defeat, and manage the consequences of a nuclear, biological, or chemical attack. In addition, the former Secretary of Defense emphasized at his 1997 confirmation hearing the threat that U.S. forces abroad face from chemical and biological weapons. The Office of the Secretary of Defense, the joint staff, and the armed services play distinct but interrelated roles in ensuring medical readiness. Defense planning is led by the Office of the Secretary of Defense, which sets policy and develops defense planning guidance. On the basis of this guidance, the Joint Chiefs issue a biannual Joint Strategic Capabilities Plan for the nation's unified combat commands. These commands are responsible for fighting and winning wars within a particular area, usually defined by geographical boundaries. The commanders-in-chief develop war plans and requirements that specify the combat troops and support that will be needed to meet the threat and mission assigned by the Capabilities Plan. To reduce the effects of such an attack on military personnel, DOD has determined the quantity of chemical and biological protective suits, masks, breathing filters, gloves, boots, and hoods that are needed based on projected wartime requirements. DOD's assessment process is unreliable for determining the risk to military operations. DOD's 2000 report is inaccurate because it includes erroneous inventory data and wartime requirements. Inadequate inventory management is an additional risk factor because readiness can be compromised by DOD's inventory management practices, which prevent an accurate accounting of the availability or adequacy of its protective equipment."

It is a complex but valuable set of tools for federal regulatory agencies to identify issues of potential concern, select regulatory options, and estimate the range of a forthcoming regulation's benefits. However, given the significant yet controversial nature of risk assessments, it is important that policymakers understand how they are conducted, the extent to which risk estimates produced by different agencies and programs are comparable, and the reasons for differences in agencies' risk assessment approaches and results. GAO studied the human health and safety risk assessment procedures of the Environmental Protection Agency, the Food and Drug Administration, the Occupational Safety and Health Administration, and the Department of Transportation's Research and Special Programs Administration. This report describes (1) the agencies' chemical risk assessment activities, (2) the agencies primary procedures for conducting risk assessments, (3) major assumptions or methodological choices in their risk assessment procedures, and (4) the agencies' procedures or policies for characterizing the results of risk assessments."

Although propane can be stored and handled safely, serious propane-related accidents have resulted in death and the destruction of property. At times, the efforts of local emergency personnel to respond to such accidents have been impeded by lack of hazard and safety information. This report describes (1) relevant revisions to the 1998 version of the code that were published in the 2001 version, as well as the process used to revise the code, (2) the views of key stakeholders about whether the 2001 version of the code provides local emergency response personnel with enough information to prepare for and respond to emergencies involving propane, and (3) the status of state and local government adoption of the 2001 code. The 2001 version of the NFPA code strengthens provisions of previous versions regarding information on the off-site effects of accidental propane releases. In 1988, the Army established the Chemical Stockpile Emergency Preparedness Program (CSEPP) to assist 10 states with communities near these eight storage facilities. The Army and the Federal Emergency Management Agency (FEMA) share the federal government's responsibility for the program's funding and execution. Since its inception, the program has received more than $761 million in funding. One third of this amount has been spent to procure critical items. Because each community has its own site-specific requirements, funding has varied greatly. For example, since the states first received program funding in 1989, Illinois received as little as $6 million, and Alabama received as much as $108 million. GAO found that many of the states have made considerable progress in preparing to respond to chemical emergencies. A letter report issued by the General Accounting Office with an abstract that begins "Nationwide, states reported that federal and state expenditures for child care under the Child Care and Development Fund (CCDF) block grant and the Temporary Assistance for Needy Families (TANF) block grant grew from $4.1 billion in fiscal year 1997 to $6.9 billion in fiscal year 1999 and totaled over $16 billion in constant fiscal year 1997 dollars for this three-year period. More than half of the children whose child care was subsidized with CCDF funds were cared for in centers, and CCDF subsidies for all types of care were primarily provided through vouchers. Eligible parents who were subsidized by CCDF were offered a choice of receiving a voucher to pay a provider of their choosing or using a provider who had a contract with the state. More than half of all the states gave TANF and former TANF families transitioning to work first or second priority for receiving child care subsidies while other eligible low-income families were assigned lower priorities. Correspondence issued by the General Accounting Office with an abstract that begins "Congress created the State Children's Health Insurance Program (SCHIP) in 1997 to reduce the number of uninsured poor children whose families incomes are too high to qualify for Medicaid. Congress appropriated $40 billion over 10 years (fiscal years 1998 through 2007) for SCHIP. Each state's SCHIP allotment is available as a federal match based on state expenditures. Although the SCHIP statute generally targets children in families with incomes up to 200 percent of the federal poverty level, 13 states' programs cover children in families above 200 percent of the federal poverty level. This report provides information on (1) enrollment and federal expenditures for SCHIP and estimates of the number of and costs to enroll eligible unenrolled children and income-eligible pregnant women and (2) factors that may influence states' future expenditures for SCHIP and the availability of funding for any program expansion."

A letter report issued by the General Accounting Office with an abstract that begins "This report focuses on the debt collection processes and procedures used by the Department of Health and Human Services' (HHS) Centers for Medicare and Medicaid Services (CMS). The primary reason for the growth of CMS' civil monetary penalties (CMP) receivables was the expansion of fraud and abuse detection activities from fiscal year 1995 through fiscal year 1997 that significantly increased reported fraud and abuse debts in fiscal year 1997. GAO's analysis of CMS' CMP receivable data revealed similar financial accountability and reporting issues as those identified for non-CMP receivables by CMS' external financial statement auditors. GAO identified (1) unreconciled differences of tens of millions of dollars in the CMP receivables balances reported by HHS and CMS for fiscal years 1997 through 1999 and (2) an unreconciled net difference of about $22 million between the CMP receivables balance in CMS' general ledger and the detailed subsidiary systems as of September 30, 2000. The data reliability issue prevented GAO from determining the overall adequacy of the CMP debt collection policies and procedures. A letter report issued by the General Accounting Office with an abstract that begins "GAO confirmed differences among the United States, the United Kingdom, and France in the rates at which illnesses have been reported among their Gulf War veterans; their assessment of nuclear, biological, and chemical threats in the Gulf; and their preparations to meet them. However, because of differences in the experiences of the three sets of veterans, there is no single, unambiguous cause that can be identified for the reported illnesses. If multinational allies are to act in a coordinated fashion, they require a similar level of awareness of and preparation for the threats to be faced; otherwise, force protection and operational success could be jeopardized and the utility of some forces restricted. Gulf War Coalition members prepared for somewhat different threats and used different countermeasures. In addition, the U.S. lacked clear doctrine for timely and systematic warning of allied forces and U.S. ground troops about pending strikes on suspected nuclear, biological, and chemical targets."

Coast Guard: Actions Needed to Mitigate Deepwater Project Risks

Testimony issued by the General Accounting Office with an abstract that begins "The Coast Guard is in the final stages of planning the largest procurement project in its history--the Deepwater Capability Replacement Project. This project will likely cost over $10 billion or more and take 20 years or more to complete. The Coast Guard has already spent about $116 million on the project's design and is asking for $338 million this year to begin the acquisition phase. This testimony discusses the major risks associated with the project. GAO found four major areas in which the project is vulnerable. Coast Guard: Progress Being Made on Deepwater Project, but Risks Remain

A letter report issued by the General Accounting Office with an abstract that begins "The Coast Guard is in the final stages of planning the largest procurement project in its history-the modernization or replacement of more than 90 cutters and 200 aircraft used for missions more than 50 miles from shore. This project, called the Deepwater Capability Replacement Project, is expected to cost more than $10 billion and take 20 years or longer to complete. Congress and the Coast Guard are at a major crossroads with the project. Planning is essentially complete, and Congress will soon be asked to commit to a multibillion-dollar project that will define the way the Coast Guard performs many of its missions for decades to come. The deepwater acquisition strategy is unique and untried for a project of this magnitude. It carries many risks that could potentially cause significant schedule delays and cost increases. Coast Guard: Update on Marine Information for Safety and Law Enforcement System

A letter report issued by the General Accounting Office with an abstract that begins "The Marine Information for Safety and Law Enforcement system is an information system to track marine safety and law-enforcement activities involving commercial and recreational vessels. In 1999, after spending about four years and $26 million, the United States Coast Guard (USCG) terminated a contract to acquire the system and will instead develop the system at its operation systems center. USCG has made progress in developing the system and was ready to deploy a minimum level of functionality in November 2001. However, USCG faces significant challenges and risks in several areas, including managing system requirements and user expectations, testing the system, moving to an operational system, and managing program risks."
