This report discusses the background information and most recent development in U.S.-China relations since mid-1996. The relations also have been marred by continuing allegations of Chinese espionage, ongoing controversy over human rights, charges that China continues to violate its non-proliferation commitments, controversy over the accidental NATO bombing of the Chinese Embassy in Belgrade, and renewed tensions over Taiwan. Since 1990, Congress has faced an annual, contentious decision on whether, and under what conditions, to renew normal trade relations (NTR) status with China for another year. This annual exercise occurred because under U.S. law, China's NTR status is temporary, and the President has to recommend its renewal each year by June 3. In 2000, the 106th Congress considered and passed H.R. 4444, which would eliminate the annual NTR renewal process and grant permanent NTR to China. The President signed the bill into law on October 10, 2000, as P.L. 106-286. But this Act only grants permanent NTR to China once it joins the World Trade Organization. Although this was expected to occur by late 2000, it has not yet happened and is now unlikely to occur until the end of 2001. Consequently, the President again this year will be compelled to recommend another temporary extension of China's NTR status for one year if this status is to continue uninterrupted. The NTR renewal is subject to enactment of a joint resolution of disapproval by Congress.

This Law was formulated in order to prevent desertification, to improve and reclaim desertified land, to protect the environment, and to promote a sustainable economy and society.

The State Council approved the National Tenth Five-Year Plan for Environmental Protection on 26 December 2001, requesting that loca1 governments and the various departments strengthen environmental protection in close relation with the economic restructuring; raise funds for environmental protection through multiple channels in connection with the expansion of domestic demand, and establish the mechanism of environmental protection with the government playing the dominant role with market promotion and public participation. The State Council emphasizes that local governments should undertake the major responsibilities of environmental protection. The governments at various levels should integrate the tasks of the Plan into the target responsibility system for provincial governors, mayors, and county heads. Periodic examination should be carried out on the targets of total pollutant discharge control and environmental quality. The implementation of the Plan should be inspected and reported on every year. The State Council requests that the relevant departments should provide guidance and support in implementing the Plan according to their respective responsibilities. The State Environmental Protection Administration should conduct coordinated supervision, management, and inspection of the implementation of the Plan.

U.S.-China economic ties have expanded substantially over the past several years. China is now the third largest U.S. trading partner, its second largest source of imports, and its fourth largest export market. However, U.S.-China commercial ties have been strained by a number of issues, including a surging U.S. trade deficit with China, China's refusal to float its currency, and failure to fully comply with its World Trade Organization (WTO) commitments, especially its failure to provide protection for U.S. intellectual property rights (IPR). This report explores these issues in detail, especially concerning the lack of protection for U.S. IPR.

Currently, China’s short-term economic outlook is unclear. Economic slowdowns in Asia and the United States in the beginning of 2001 have hurt China’s export industries, and the September 11, 2001 terrorist attacks against the United States will likely further dampen foreign demand for Chinese products and could reduce the level of planned foreign investment in China. The Chinese government has used public spending in recent years to boost the economy, and it is likely that it will continue to maintain such policies until the global economy begins to recover.

This report provides an overview of the Muslim separatist movement in China’s northwestern Xinjiang Uighur Autonomous Region, China’s attempts to stifle activities which it considers terrorism, and implications for U.S. policy. Some analysts suggest that the U.S.-led campaign against terrorism may make it difficult to pressure the Chinese government on human rights and religious freedoms, particularly as they relate to Uighur Muslims in Xinjiang.

The “Falun Gong” movement has led to the largest and most protracted public demonstrations in China since the democracy movement of 1989. On April 25, 1999, an estimated 10,000 to 30,000 adherents assembled in front of Zhongnanhai, the Chinese Communist Party leadership compound, and participated in a silent protest against state repression of their activities. On July 21, 1999, the People’s Republic of China (PRC) government, fearful of the spread of social unrest, outlawed the movement and began to arrest Falun Gong protesters.

China has sought over the past several years to become a member of the World Trade Organization (WTO), the international agency that administers multilateral trade rules. In September 2001, China completed its multilateral negotiations with the WTO Working Party handling its accession application and reached a trade agreement with Mexico, the last of the original 37 WTO members that requested a bilateral trade agreement with China. China’s WTO membership (as well as that of Taiwan’s) was formally approved at the WTO Ministerial Conference in Doha, Qatar in November 2001.

The prospect of future growth in demand for agricultural products makes China’s accession to the World Trade Organization (WTO) an important issue for the U.S. agricultural sector. Most agricultural interest groups strongly support China’s entry into the WTO, because they think it will increase U.S. agricultural exports and enhance farm income. In the 107th Congress, attention is focused on China’s final WTO accession negotiations where differences over agriculture have become an issue.

Since this has not yet happened, President Bush on June 1, 2001, was compelled to recommend another temporaryextension ofChina’s NTRstatusfor one year in order for it to continue uninterrupted. The NTR renewal is subject to enactment of a joint resolution of disapproval by Congress. Such a joint resolution, H.J.Res. 50, was introduced on June 5, 2001, byRepresentative Dana Rohrabacher. The Ways and Means Trade Subcommittee reported the resolution adversely on July 12, 2001, and the House rejected the resolution on July 18, 2001, by a vote of 259-169.

This report examines the major, foreign conventional weapon systems that China has acquired or has committed to acquire since 1990, with particular attention to implications for U.S. security concerns. It is not the assumption of this report that China’s military, the People’s Liberation Army (PLA), will engage in conflict with other forces in Asia.
