Afghanistan: Current Issues and U.S. Policy Concerns

The United States and its allies are helping Afghanistan emerging from more than 22 years of warfare, although substantial risk to Afghan stability remains. Before the U.S. military campaign against the orthodox Islamist Taliban movement began on October 7, 2001, Afghanistan had been mired in conflict since the Soviet invasion of Afghanistan in 1979. The defeat of the Taliban has enabled the United States and its coalition partners to send forces throughout Afghanistan to search for Taliban and Al Qaeda fighters and leaders that remain at large, including Osama bin Laden. As the war against remaining Al Qaeda and Taliban elements winds down, the United States is shifting its military focus toward stabilizing the interim government, including training a new Afghan national army, and supporting the international security force (ISAF) that is helping the new government provide security.

Clean Water Act Issues in the 107th Congress

Key water quality issues that may face the 107th Congress include: actions to implement existing provisions of the Clean Water Act (CWA), whether additional steps are necessary to achieve overall goals of the Act, and the appropriate federal role in guiding and paying for clean water activities. Legislative prospects for comprehensively amending the Act have for some time stalled over whether and exactly how to change the law. If clean water issues receive attention in the 107th Congress, consideration of specific issues will depend in part on the CWA policy agenda of the new Bush Administration and on priorities of the key committees that have major jurisdiction over the Act.

This report provides an overview of U.S. assistance before the Plan Colombia proposal, describes the Clinton Administration Plan Colombia proposal, and tracks Congressional action on it. It also covers the Bush Administration’s Andean Regional Initiative (ARI), which incorporated the Bush Administration’s Andean Counterdrug Initiative (ACI). Table 2 provides a breakdown of the ARI by country, purpose, and account. Table 1 provides an overview of U.S. assistance from FY1999-FY2001, Tables 3 and 4 compare the Clinton Administration’s Plan Colombia proposal with House, Senate, and conference action on it, and Table 5 charts U.S. assistance from FY1989-FY1998. Discussion of conference action includes a list of certification and reporting requirements, and Clinton Administration responses.

Congressional Budget Resolutions: Motions to Instruct Conferees

Both the House and the Senate have procedures whereby the full bodies may issue instructions to conferees on budget resolutions, usually in the form of a motion. The practices of the House and Senate regarding such motions differ markedly in key respects. First, the House resorts to such motions regularly (having considered 10 such motions in the past 12 years), while the Senate seldom uses them. Second, the House has considered only one motion per budget resolution, while the Senate considered five motions on one budget resolution. Finally, the House regards the motion to instruct conferees strictly as a prerogative of the minority party, while the Senate does not.

Education Vouchers: Constitutional Issues and Cases

This report details the constitutional standards that currently apply to indirect aid programs and summarizes all of the pertinent state and federal court decisions, including the Ohio case that will be heard by the Supreme Court. On September 25, 2001, the Supreme Court agreed to review a case raising the controversial issue of the constitutionality of education vouchers. In Zelman v. Simmons-Harris the Sixth Circuit held Ohio’s Pilot Scholarship Program, which provided up to $2500 to help low-income students in Cleveland’s public schools attend private schools in the city, to violate the establishment of religion clause of the First Amendment.
