The Robert T. Stafford Disaster Relief and Emergency Assistance Act authorizes the President to declare that an emergency or major disaster exists that overwhelms state and local resources. Legislation before the 106th Congress (H.R. 707 and S. 1691) would, among other matters, amend the Act to: (1) fund hazard mitigation projects designed to reduce future disaster losses; (2) add conditions to assistance; and (3) consolidate provisions governing the distribution of aid to disaster victims. This report compares provisions of the two bills, and will be updated as legislative action occurs.

This report discusses a variety of animal agriculture issues that generated debate during the 106th Congress, including low livestock prices, especially for hogs. Economic difficulties have revived questions such as the impacts of consolidation in the livestock industry, and the price effects of animal imports from Canada and Mexico. The 104th Congress pursued efforts to reform environmental regulations on several fronts: (1) revising regulatory decision making processes; (2) attaching specific reforms to funding bills; (3) establishing a House corrections day calendar of bills addressing specific regulatory problems; and (4) incorporating regulatory reforms into individual program reauthorization bills. The 105th Congress has pursued regulatory reform in four primary directions: (1) proposals to establish a comprehensive cost-benefit/risk analysis framework for regulatory programs, (2) private property “takings” initiatives, (3) amendments and reforms directed at individual environmental statutes, and (4) oversight of environmental programs.

H.R. 1987, 106th Congress, the Fair Access to Indemnity and Reimbursement (FAIR) Act, which was reported by the Committee on Education and the Workforce on October 14, 1999, would make it easier for small businesses and labor organizations that prevail against the NLRB or OSHA, in administrative or court proceedings, to recover their attorneys' fees from the government. It would do so by requiring fees to be awarded automatically in cases to which it applied, instead of only when the government's position was not substantially justified.

Congressional Research Service (CRS) report entailing information about an amendment made to the Individuals with Disabilities Education Act (IDEA). The amendment outlines the most effective disciplinary actions to be made towards children with disabilities who exhibit violent or dangerous behaviors.

Prior to 1986, general funds of the U.S. treasury were used to pay 65% of the cost to operate ocean and inland ports and to maintain and deepen their channels. The other 35 percent is paid by ports, or by state or local governments. In 1986, Congress enacted the Harbor Maintenance Tax and used the revenues to provide some of the funds for what has come to be considered the federal portion of such costs

The Passenger Service Act (PSA) requires that domestic ocean passenger transportation be provided only by ships that are U.S.-owned, U.S.-built and operated by U.S. crews. Proposed legislation to relax some PSA restrictions was introduced during the 105th Congress. Both the Chairman of the Senate Commerce Committee and the Chairman of the House Transportation and Infrastructure Committee, Subcommittee on the Coast Guard and Maritime Transportation, have made recent public statements indicating their strong interets enacting changes to the passenger Service Act during the 106th Congress. This report will be updated as developments warrant.

Authorization of the Surface Transportation Board (Board or STB), successor agency to the Interstate Commerce Commission, ended September 30, 1998. The FY2000 budget request is $16 million, $2.6 million of which could be offset by user fees which would become available at the beginning of FY2001. The Senate Commerce Committee scheduled a hearing for March 3, 1999, to consider S. 90, a bill to reauthorize the STB. The CRS report discusses the Board and selected public policy issues associated with its authority, activities, and reauthorization.
