Implementation of major farm and food program changes enacted last year under omnibus farm (P.L.104-127) and welfare (P.L.104-193) measures is likely to draw the attention of the 105th Congress. The size and cost of these programs also could make them a target for reductions in congressional efforts to balance the budget.

Federal R&D funding at academic institutions totals over $10 billion annually. About one-third pays for indirect costs or overhead; the rest supports the direct costs of conducting R&D. On May 8, 1996, OMB revised Circular A-21, governing indirect costs policies, to change the designation "indirect costs" to "facilities and administrative costs" (F&A). The Departments of Defense and of Health and Human Services negotiate to determine indirect cost rates with about 96% of U.S. and audit compliance -- DOD with a few schools and HHS with hundreds. F&A costs encompass such items as facilities maintenance and renewal, heating and cooling, libraries, salaries of administrators, and student support.

Over the past decade, worldwide production of illicit drugs has risen dramatically: opium and marijuana production has roughly doubled and coca production tripled. Street prices of cocaine and heroin have fallen significantly in the past 20 years, reflecting increased availability. Despite apparent national political resolve to deal with the drug problem, inherent contradictions regularly appear between U.S. anti-drug policy and other national policy goals and concerns. The mix of competing domestic and international pressures and priorities has produced an ongoing series of disputes within and between the legislative and executive branches concerning U.S. international drug policy. One contentious issue has been the Congressionally-mandated certification process, an instrument designed to induce specified drug-exporting countries to prioritize or pay more attention to the fight against narcotics businesses.

The continued interest in regulatory reform measures in the final moments of the 104th Congress suggests that the 105th Congress will consider them again. At the same time the fact that the 104th Congress enacted flexibility provisions in drinking water and food safety/pesticides legislation could be an indicator that the 105th Congress may pursue reforms in individual reauthorization legislation rather than in broad regulatory reform bills.

In 1997, during the first session of the 105th Congress, the House and Senate will consider many different budgetary measures. Most of these measures will pertain to FY1998 and beyond, but some measures will make adjustments in the budget for the current fiscal year, FY1997. The aging nuclear weapons production complex, managed by the Department of Energy (DOE), faces enormous environmental and waste management problems. Several hundred billion dollars may be needed to clean up leaking waste pits, groundwater contamination, growing accumulations of radioactive waste, and uncontrolled liquid discharges at DOE facilities. DOE's cleanup program is carried out by the Office of Environmental Management (EM). Cleanup funding escalated rapidly after the end of the Cold War, although it has plateaued at about $6 billion per year under the Clinton Administration.

Legislative proposals to privatize the United States Enrichment Corporation (USEC) were introduced in the House (H.R. 1216) and Senate (S. 755) in the 104th Congress. The bills, as amended, were included in the budget reconciliation bill (H.R. 2491). It was cleared by the House and the Senate on November 17, but vetoed by the President on December 6, 1995. A substitute bill for S. 755 was introduced on January 26, 1996, by Senator Murkowski. The Murkowski substitute was included in H.R. 3019, the Balanced Budget Downpayment Act II. The conference report for H.R. 3019 was passed by the House and Senate on April 25, 1996, and was signed by President Clinton (P.L. 104-134) on April 26, 1996.
