FCC Media Ownership Rules: Issues for Congress

The Federal Communications Commission adopted an order on June 2, 2003 that modified five of its media ownership rules and retained two others.1 The new rules will go into effect on September 4, 2003 – thirty days after their appearance in the Federal Register. Because of the potential that changes in these rules – which set limits on national television ownership, newspaper-broadcast and radio-television cross-ownership in a market, and ownership of multiple television or radio stations in a market – could have far-reaching effects, a number of bills have been introduced in the 108th Congress that reflect a range of positions on these issues. This report analyzes each of the areas that have changed as a result of the FCC action or may change as a result of congressional action. The various positions in the debate also are summarized.

Economic Development Administration: Overview and Issues

The Economic Development Administration (EDA), targeted for elimination or major “reinvention” early in the 104th Congress, gained a new lease on life in the waning days of the 105th. Having been kept alive via appropriations bills since its last authorizing legislation expired in 1982, P.L. 105-393 reauthorized the EDA and its programs for 5 years. On October 27, Congress approved a conference agreement recommending $286.7 million for EDAP and $28 million for S&E, for a totalFY2001 appropriation of$411.9 million for EDA. It became part of the Consolidated Appropriations Act (H.R. 4942, P.L. 106-553) signed into law on December 21, 2000.

Campaign Finance Regulation Under the First Amendment: Buckley v. Valeo and its Supreme Court Progeny

This report first discusses the critical holdings enunciated bythe SupremeCourt in Buckley, including those: upholding reasonable contribution limits, striking down expenditure limits, upholding disclosure reporting requirements, and upholding the system of voluntary presidential election expenditure limitations linked with public financing. It then examines the Court’s extension of Buckley in fifteen subsequent cases, evaluating them in three regulatory contexts: contribution limits (California Medical Association v. FEC; Citizens Against Rent Control v. Berkeley; Nixon v. Shrink Missouri Government PAC; FEC v. Beaumont), expenditure limits (First National Bank of Boston v. Bellotti; FEC v. Massachusetts Citizens for Life; Austin v. Michigan Chamber of Commerce; FEC v. National Right to Work; Colorado Republican Federal Campaign Committee (Colorado I) v. FEC; FEC v. Colorado Republican Federal Campaign Committee (Colorado II); FEC v. Democratic Senatorial Campaign Committee; FEC v. National Conservative Political Action Committee), and disclosure requirements (Buckley v. American Constitutional Law Foundation; Brown v. Socialist Workers ‘74 Campaign Committee; FEC v. Leaking Underground Storage Tank Trust Fund (LUST)

The Leaking Underground Storage Tank (LUST) Trust Fund provides money under Environmental Protection Agency (EPA)- state cooperative agreements to pay cleanup and related costs involving leaking petroleum tanks if no financially solvent owners can be found, or if the owner or operator refuses or is unable to comply with an urgent corrective order. Both EPA and the states use trust fund monies to oversee and enforce LUST corrective actions. Primary financing for the trust fund comes from a 0.1 cent per gallon tax on motor fuels. The tax expired December 31, 1995, but was reinstated by the Taxpayer Relief Act of 1997 (P.L. 105-34) for the period October 1, 1997, through March 31, 2005.

Clean Water Act Issues in the 107th Congress

Key water quality issues that may face the 107th Congress include: actions to implement existing provisions of the Clean Water Act (CWA), whether additional steps are necessary to achieve overall goals of the Act, and the appropriate federal role in guiding and paying for clean water activities. Legislative prospects for comprehensively amending the Act have for some time stalled over whether and exactly how to change the law. If clean water issues receive attention in the 107th Congress, consideration of specific issues will depend in part on the CWA policy agenda of the new Bush Administration and on priorities of the key committees that have major jurisdiction over the Act.
