VHA generally grants individual VAMCs discretion on choosing which process to use. Specifically, VAMCs conduct an initial review to determine how best to respond to an adverse event. According to VHA officials, if the circumstances that led to an adverse event are clear, based on a VAMC's initial review, VAMCs can take immediate corrective action. If the circumstances that led to an adverse event need to be examined further, VAMCs are given discretion to use one or more of the following four processes: (1) root cause analysis, (2) peer review, (3) clinical care review, and (4) administrative investigation board. Because VAMCs generally have discretion in which of these processes they use, different VAMCs that experience similar adverse events may not use the same processes to respond to them. Nonetheless, each process has certain purposes and limitations. Testimony issued by the Government Accountability Office with an abstract that begins "In summary, VA’s SDVOSB program remains vulnerable to fraud and abuse. VA has made inconsistent statements about its progress in verifying firms listed in VetBiz using the new, more-thorough process the agency implemented in response to the 2010 Act. In one communication, VA stated that as of February 2011, all new verifications would use the 2010 Act process going forward. According to the most-recent information provided by VA, there are 6,079 SDVOSBs and veteran-owned small businesses (VOSB) listed in VetBiz. Of these, 3,724 were verified under the more-through process implemented under the 2010 Act, and 2,355—over 38 percent—were verified under the less-rigorous 2006 Act process. The presence of firms that have only been subjected to the less-stringent process that VA previously used represents a continuing vulnerability. In 2011, VA’s Office of Inspector General (OIG) issued a report finding that VA’s document review process under the 2006 Act “ in many cases was insufficient to establish control and ownership [and] in effect allowed businesses to self-certify as a veteran-owned or service-disabled veteran-owned small business with little supporting documentation.”"

Ensuring Drug Quality in Global Health Programs

Correspondence issued by the Government Accountability Office with an abstract that begins "U.S.-funded global health programs have put regulatory and policy requirements in place to help prevent procurement of substandard drugs. USAID, for example, reviews quality assurance information for all drugs before they are procured. Specifically, USAID requires implementing partners to obtain written approval from the agency before purchasing drugs. Through its approval process, USAID determines whether there is sufficient information available to assure that the drug is of acceptable quality. Although USAID’s review process varies for some drugs, the type of information USAID reviews generally includes prior FDA approval of the drug or approval by a comparable stringent regulatory authority, as well as results of prior testing of the drug by an independent laboratory. As an additional quality assurance measure, USAID prequalifies selected wholesalers to procure drugs for U.S.-funded global health programs based on factors such as site visits to the wholesaler’s facility and a review of the wholesaler’s quality assurance practices and procedures. According to CDC officials, CDC requires its implementing partners to follow program-specific quality assurance requirements. In part because of the qualitative nature of the CRA investment test, regulatory ratings cannot be systematically linked to banks' LIHTC investments. Although a bank's overall rating and the associated narrative of its CRA examination are publicly available, the performance evaluation report does not individually list qualified investments and how they were considered for that examination. Furthermore, quantifying potential bank demand for LIHTCs in specific geographic areas is complicated because not every bank assessment area is considered to the same degree in a CRA examination. Although one way to assess demand for LIHTCs is by examining how much equity investors are willing to contribute, the common LIHTC price measure--the ratio of investors' equity contribution to the total amount of LIHTCs in nominal dollars--is subject to misinterpretation. GAO has issued numerous reports on FPS's efforts to protect the General Services Administration's (GSA) facilities. This report (1) recaps the major challenges we reported that FPS faces in protecting federal facilities and discusses FPS's efforts to address them and (2) identifies an additional challenge that FPS faces related to the facility security committees (FSC), which are responsible for addressing security issues at federal facilities. ANS had not yet progressed to the independent testing phase, however. In cancelling ANS and MM-UGV, the Army estimated that approximately $2.5 billion in planned funding for fiscal years 2013 to 2017 could be made available for other Army efforts. Industrial activities in the United States emit significant amounts of carbon dioxide and other greenhouse gases each year, substantially affecting the earth's climate, according to the National Academy of Sciences. In an effort to reduce these emissions, some have suggested capping emissions and allowing them to be traded in secondary markets just as other commodities are traded. We briefed congressional committee staff on the results of our work on July 23, 2010. Specifically, we provided information on (1) carbon-related products currently traded in the United States and the extent of trading; (2) risks and challenges posed by these products; (3) the extent to which and how these products are regulated; and (4) issues that market observers identified for policymaker consideration as part of creating a national cap-and-trade carbon market."

Home Energy Assistance for Low-Income Occupants of Manufactured Homes

Correspondence issued by the Government Accountability Office with an abstract that begins "In 2005, the most recent year for which complete data were available, occupants of older manufactured homes paid over twice as much on average per square foot for energy---$1.75 per square foot as compared with $0.87---as was paid by occupants of detached homes. Annual energy expenditures for older manufactured homes--about 906 square feet on average--were about $1,369, compared with detached homes--about 2,919 square feet on average--were about $2,060. Energy expenditures--both per square foot and annually--varied significantly by region reflecting regional differences in the types and costs of fuels commonly used to heat and cool homes, income levels, and climate, among other things. In 2005, LIHEAP provided more assistance on a per square foot basis--about $0.33 per square foot--to occupants of older manufactured homes than to those of detached homes--about $0.20 per square foot. However, this assistance covers slightly less of the annual energy expenditures of occupants of older manufactured homes than occupants of detached homes--15 and 17 percent, respectively. Based on our analysis of EIA's RECS data, we estimate that about 3 percent of LIHEAP funds--about $57 million--spent in 2005 were used to assist occupants of older manufactured …

Additionally, it appears that DOD is incorporating those practices into its planning for the fifth effort—strategic network optimization—which is still under development. On the basis of our assessment of DOD’s key planning documents and other information for the process improvement, surface optimization, air optimization, and supply alignment efforts, we found that DOD addressed the six characteristics found in the framework. For example, DOD identified the main purpose of the improvement efforts, their scope, and the resources needed to execute individual efforts. Preliminary observations of DOD's planning for strategic network optimization indicate that agency officials are also incorporating results-oriented management practices for this effort. For example, DOD has developed a mission statement and established mechanisms to coordinate with stakeholders. However, because planning is still underway for strategic network optimization, we were unable to fully assess the extent to which DOD has used result-oriented management practices to develop and implement this improvement effort. For example, DOD has not yet decided how to implement the effort nor developed specific performance measures to assess progress."

From September 11, 2001, through fiscal year 2010, approximately $475 million in federal funds was made available for screening, monitoring, and treating WTC responders for illnesses and conditions related to the WTC disaster. These include asthma, persistent coughing, and other respiratory conditions and mental health conditions such as depression, anxiety, and post-traumatic stress disorder (PTSD). As a form of intellectual property, sound recordings are protected by copyright law. The copyright holder (e.g., a record company or performer) may use a license to grant third parties permission to use sound recordings, in return for compensation and compliance with other conditions of the license. Congress established a statutory copyright regime, including a statutory license, which among other things, avoids the potential problems associated with thousands of music service providers seeking licenses from many copyright holders. Under this regime, a party may invoke a statutory license to allow it to use sound recordings under certain conditions and according to specific requirements, in exchange for payment of a set royalty amount. Since 1976, the Copyright Royalty Tribunal, Copyright Arbitration Royalty Panels, and Copyright Royalty Judges have been responsible, successively, for recommending or setting rates, terms, and conditions for statutory licenses. Since then, GSA and the judiciary have been slow to agree upon how to proceed with the project, for which about $366 million in appropriated funds remains available. In 2012, with the judiciary’s support, GSA issued a request for proposal for contractors to design and build a 24-courtoom, 32-chamber courthouse, which would be used in conjunction with 25 existing courtrooms in the Roybal Courthouse. However, this new plan will not address one of the principal justifications for the original project—that the L.A. Court be centralized at one site. Instead, it would increase the distance between the Roybal Courthouse and the planned second court location and the distance to the federal detention center from which prisoners must be transported."

Testimony issued by the Government Accountability Office with an abstract that begins "In April 2013, GAO reported that, since 2007, the Department of Homeland Security's (DHS) Infrastructure Security Compliance Division (ISCD) assigned about 3,500 high-risk chemical facilities to risk-based tiers under its Chemical Facility Anti-Terrorism Standards (CFATS) program, but it has not fully assessed its approach for doing so. The approach ISCD used to assess risk and make decisions to place facilities in final tiers does not consider all of the elements of consequence, threat, and vulnerability associated with a terrorist attack involving certain chemicals. For example, the risk assessment approach is based primarily on consequences arising from human casualties, but does not consider economic consequences, as called for by the National Infrastructure Protection Plan (NIPP) and the CFATS regulation, nor does it consider vulnerability, consistent with the NIPP. ISCD had taken some actions to examine how its risk assessment approach could be enhanced, including commissioning a panel of experts to assess the current approach and recommend improvements. In April 2013, GAO reported that ISCD needed to incorporate the results of these efforts to help ensure that the revised assessment approach includes all elements of risk. In the waiver, DOD found reasonable the Air Force's conclusion that the additional $49 million cost of producing competing prototypes exceeded the negligible expected life-cycle benefits because minimal opportunities exist to increase CAPS technological and design maturity through competitive prototyping. The Air Force's conclusions about CAPS technical and design risk are supported by its market research, but its cost-benefit analysis was incomplete because neither the waiver nor the business case analysis supporting it provided an estimated dollar value for the expected benefits. One option would truncate the SSN so that only the last four digits would appear on the card. However, the full SSN would continue to be used by both beneficiaries and providers for all Medicare business transactions. The other two options would replace the display of the SSN on the Medicare card with a newly developed identifier that CMS calls the Medicare Beneficiary Identifier (MBI). In one of these options, this new identifier would be used by the beneficiary in their interactions with CMS; however, the provider would continue to use the SSN to interact with CMS. In the other, both the beneficiary and provider would use the new identifier printed on the Medicare card and the SSN would be entirely excluded from the transaction. Mine Safety: Reports and Key Studies Support the Scientific Conclusions Underlying the Proposed Exposure Limit for Respirable Coal Mine Dust

Correspondence issued by the Government Accountability Office with an abstract that begins "Our evaluation of the reports MSHA used to support its proposal and the key scientific studies on which the reports were based shows that they support the conclusion that lowering the PEL from 2.0 mg/m3 to 1.0 mg/m3 would reduce miners’ risk of disease. The reports and key studies concluded that miners’ cumulative exposure to coal mine dust at the current PEL over their working lives places them at an increased risk of developing CWP, progressive massive fibrosis, and decreased lung function, among other adverse health outcomes. To mitigate the limitations and biases in the data, the researchers took reasonable steps, such as using multiple x-ray specialists to reduce the risk of misclassifying disease and making adjustments to coal mine dust samples where bias was suspected. In addition to addressing the limitations and biases in the data, researchers used appropriate analytical methods to conclude that lowering the existing PEL would decrease miners’ risk of developing black lung disease.
