"Fast-Track" or Expedited Procedures: Their Purposes, Elements, and Implications
This report discusses certain provisions of law that commonly are known as “fast-track” or expedited procedures. They are so labeled because these statutory provisions contain special legislative procedures that apply to one or both houses of Congress and that expedite, or put on a fast track, congressional consideration of a certain measure or a narrowly defined class of measures. This report first presents the nature, purpose, and elements of fast-track procedures. Then the report discusses some of the most important ways in which these procedures differ from the normal procedures of the House and Senate and, therefore, how the use of expedited procedures can affect the legislative process in Congress.

Expedited Procedures in the House: Variations Enacted Into Law
Congress enacts expedited, or fast-track, procedures into law when it wants to increase the likelihood that one or both houses of Congress will vote in a timely way on a certain measure or kind of measure. These procedures are enacted as rulemaking provisions of law pursuant to the constitutional power of each house to adopt its own rules. The house to which a set of expedited procedures applies may act unilaterally to waive, suspend, amend, or repeal them.

Campaign Finance: Constitutional and Legal Issues of Soft Money
Prior to enactment of the Bipartisan Campaign Reform Act of 2002 (BCRA), P.L. 107-155, the term “soft money” generally referred to unregulated funds, perceived as resulting from loopholes in the Federal Election Campaign Act (FECA), 2 U.S.C. §§ 431 et seq. Generally, the intent of BCRA, (effective Nov. 6, 2002), which amends FECA, is to restrict the raising and spending of soft money. This Issue Brief discusses constitutional and legal issues surrounding two major types of soft money that BCRA regulates: political party soft money and soft money used for issue advocacy communications. Corporate and labor union soft money, which FECA exempts from regulation and is not addressed by BCRA, is also discussed.

Flexible Spending Accounts and Medical Savings Accounts: A Comparison
This report compares FSAs and MSAs. It begins by describing FSAs, the basis for their tax treatment, and data on their use. It then describes the MSA demonstration authorized by the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the basis for their tax treatment, and data on their use. Charitable Choice Provisions of H.R. 7
H.R. 7, the Community Solutions Act, on July 19 won House passage without amendment by a vote of 233-198. The bill includes basic elements of President Bush’s faith-based initiatives: tax incentives for private giving–scaled back from original proposals (Title I)–and expansion of charitable choice (Title II). Western Water Resource Issues
For more than a century, the federal government has constructed water resource projects for a variety of purposes, including flood control, navigation, power generation, and irrigation. While most municipal and industrial water supplies have been built by non-federal entities, most of the large, federal water supply projects in the West, including Hoover and Grand Coulee dams, were constructed by the Bureau of Reclamation (Department of the Interior) to provide water for irrigation.

U.S.-China Counter-Terrorism Cooperation: Issues for U.S. Policy
After the terrorist attacks on September 11, 2001, the United States faced a challenge in enlisting the full support of the People’s Republic of China (PRC) in counter-terrorism. This effort raised short-term policy issues about how to elicit cooperation and how to address China’s concerns about military action (Operation Enduring Freedom). Longer-term questions have concerned whether counterterrorism has strategically transformed bilateral relations and whether China’s support has been valuable and not obtained at the expense of other U.S. interests.

Global Climate Change: The Kyoto Protocol
Negotiations on the Kyoto Protocol to the United Nations Framework Convention on Climate Change (UNFCCC) was completed on December 11, 1997, committing the industrialized nations to specified, legally binding reductions in emissions of six “greenhouse gases.” The Protocol entered into force on February 16, 2005, and its emissions reduction requirements are binding on the 35 industrialized countries that have ratified it; the United States disengaged from the Protocol in 2001 and has not ratified it.

Broadband Internet Access and the Digital Divide: Federal Assistance Programs
Some policymakers, believing that disparities in broadband access across American society could have adverse economic and social consequences on those left behind, assert that the federal government should play a more active role to avoid a “digital divide” in broadband access. One approach is for the federal government to provide financial assistance to support broadband deployment in underserved areas. Others, however, believe that federal assistance for broadband deployment is not appropriate. Some opponents question the reality of the “digital divide,” and argue that federal intervention in the broadband marketplace would be premature and, in some cases, counterproductive.

Export-Import Bank: Financing Requirements and Restrictions
The Export-Import Bank is an independent U.S. government agency that is charged with financing and promoting exports of U.S. goods and services. The Bank operates under a renewable charter, the Export-Import Bank Act of 1945, as amended, and has been authorized through September 30, 2006. Congress has amended the Bank’s charter at times to meet various objectives, primarily U.S. foreign policy and international economic goals. These amendments restrict the Bank’s activities relative to particular types of economic activities or have acted to advance other U.S. goals and objectives, such as improving workers’ rights, protecting the environment, or protecting U.S. jobs.

The Budget for Fiscal Year 2006
On February 7, 2005, the President presented his FY2006 budget, containing proposals and estimates for FY2006 through FY2010. The proposal has a deficit of $390 billion (3.0% of GDP) in FY2006, and steadily declining deficits through FY2010. The budget did not include estimates of the cost of the war on terror beyond FY2005. It did not include cost estimates of the Administration’s proposals for changes in Social Security. It did include specific proposals that, over five years, would reduce spending among the non-defense discretionary programs; slow the growth in defense spending; slow the growth in selected categories of mandatory spending; and make further tax cuts along with making permanent the 2001 and 2003 tax cuts.

Conditions on U.S. Aid to Serbia
In each of the past five fiscal years (FY2001-FY2005), Congress has conditioned U.S. aid to Serbia on a presidential certification that Serbia has met certain conditions, including cooperation with the International Criminal Tribunal for the Former Yugoslavia (ICTY). The 1 Ogth Congress is considering similar certification provisions in the FY2006 foreign aid bill. Supporters of aid conditionality say such provisions may have spurred Serbia's cooperation with the Tribunal. While the certification process continues to enjoy support in Congress, the Administration appears to favor ending it soon, as well as shifting responsibility for prosecuting war crimes from the ICTY to local courts.
