Crime and Forfeiture: The Innocent Third Party

Forfeiture has survived through time in American law, and since 1984, the use of forfeiture statutes to divest felons of their spoils has increased substantially. This report reviews the case law which raises the issue concerning many relative to whether some civil forfeiture proceedings constitute punishment which may violate the Eighth Amendment's excessive fines clause.

The Clean Air Act Amendments of 1990 established "Tier 1" standards to limit tailpipe emissions from new motor vehicles, and the Environmental Protection Agency (EPA) is required to determine if more stringent requirements are needed to attain or maintain National Ambient Air Quality Standards. EPA also must assess the availability and cost-effectiveness of technologies necessary to control emissions. Accident Prevention under the Clean Air Act Section 112(r): Risk Management Planning by Propane Users and Internet Access to Worst-Case Accident Scenarios

This report briefly describes two issues associated with EPA implementation of risk management planning requirements in the Clean Air Act Section 112(r): whether dealers and distributors of propane and other flammable fuels should be covered by the law, and whether electronic access to off-site consequence analyses (OCA), and especially worst-case analyses, should be restricted to avoid misuse by terrorists or criminals. These issues are addressed by S. 880, as reported, and H.R. 1301 in the 106th Congress. The statutory requrrements and EPA implementation to date also are described. Covered facilities must submit risk management plans by June 21, 1999. This product will be updated when events warrant. The Coastal Nonpoint Pollution Program: Status and Legislative Issues

In 1990, Congress enacted legislation requiring coastal states and territories to develop programs to help address the problem of nonpoint source pollution in coastal waters, which are especially threatened by pressures of population growth, development, and pollution. The coastal nonpoint pollution program is unique because it expressly links federal and state coastal zone management and water quality programs. Coastal states are now implementing these requirements. Congress has not changed the program since its enactment, but legislative activity in the 106th Congress is possible. One issue receiving attention is whether to integrate the coastal nonpoint pollution program with the activities under the Coastal Zone Management Act.
