U.S. Fish and Wildlife Service: Endangered Species Act Decision Making

Testimony issued by the Government Accountability Office with an abstract that begins "The Department of the Interior's (Interior) U.S. Fish and Wildlife Service (Service) is generally required to use the best available scientific information when making key decisions under the Endangered Species Act (ESA). Controversy has surrounded whether former Deputy Assistant Secretary Julie MacDonald may have inappropriately influenced ESA decisions by basing decisions on political factors rather than scientific data. Interior directed the Service to review ESA decisions to determine which decisions may have been unduly influenced. ESA actions include, among others, 90-day petition findings, 12-month listing or delisting findings, and recovery planning. The Service distributed informal guidance in May 2005 on the processing of 90-day petitions. Recovery plans generally must include recovery criteria that, when met, would result in the species being delisted. GAO examined three separate issues: (1) what types of decisions, if any, were excluded from the Service's review of decisions that may have been inappropriately influenced; (2) to what extent the Service's May 2005 informal guidance affected 90-day petition findings; and (3) to what extent the Service has, before delisting species, met recovery criteria. Testimony issued by the Government Accountability Office with an abstract that begins "This testimony discusses our work on the status of efforts to establish federal border control in the Commonwealth of the Northern Mariana Islands (CNMI) and implement the Consolidated Natural Resources Act of 2008 (CNRA) with regard to foreign workers, visitors, and investors in the CNMI. In May 2008, the United States enacted CNRA, amending the U.S.-CNMI Covenant to establish federal control of CNMI immigration. CNRA contains several CNMI-specific provisions affecting foreign workers and investors during a transition period that began in November 2009 and ends in 2014. In addition, CNRA amends existing U.S. immigration law to establish a joint visa waiver program for the CNMI and Guam by replacing an existing visa waiver program for Guam visitors. During the transition period, the U.S. Secretary of Homeland Security, in consultation with the Secretaries of the Interior, Labor, and State and the U.S. Attorney General, has the responsibility to establish, administer, and enforce a transition program to regulate immigration in the CNMI. Testimony issued by the Government Accountability Office with an abstract that begins "GAO’s prior work has highlighted progress and challenges in various areas related to Border Patrol’s implementation of its 2004 National Strategy, which could provide insights as Border Patrol transitions to its 2012 Strategic Plan. Border Patrol officials stated that the 2012 Strategic Plan will rely on Border Patrol and federal, state, local, tribal, and international partners working together to use a risk-based approach to secure the border, and include the key elements of “Information, Integration, and Rapid Response” to achieve objectives. These elements were similar to those in the 2004 Strategy and GAO’s past work highlighted the progress and challenges the agency faced obtaining information necessary for border security; integrating security operations with partners; and mobilizing a rapid response to security threats. Border Patrol successfully used interagency forums and joint operations to counter threats, but challenges included assessing the benefits of border technology and infrastructure to, among other things, provide information on situational awareness. Correspondence issued by the General Accounting Office with an abstract that begins "The Department of Defense's (DOD) long-standing business systems problems adversely affect the economy, effectiveness, and efficiency of its business operations and have resulted in a lack of adequate transparency and appropriate accountability across all of its major business areas. In July 2001, DOD initiated a program to, among other things, develop a DOD business enterprise architecture (architecture). This effort is an essential part of the Secretary of Defense's broad initiative to "transform the way the department works and what it works on." Because DOD is one of the largest and most complex organizations in the world, overhauling its business operations and supporting systems represents a huge management challenge. In fiscal year 2003, DOD reported that its operations involved over $1 trillion in assets, nearly $1.6 trillion in liabilities, approximately 3.3 million military and civilian personnel, and disbursements of over $416 billion. To support its business operations, DOD reported that it relies on about 2,300 business systems, including accounting, acquisition, logistics, and personnel systems. Company sponsors of private defined benefit (DB) pension plans can claim a tax deduction for their contribution amount to a tax-qualified pension plan, and employees' taxes on contributions and investment earnings are deferred until they retire and start receiving benefit payments. To achieve and maintain tax-qualified status, DB plans must comply with multiple federal requirements that are designed to ensure that executives and other highly compensated employees (HCE) do not receive excessively high benefits, both in an absolute sense and relative to nonhighly compensated employees (NHCE). These include limits on total benefit levels, limits on the amount of compensation that can be included in determining benefit levels, and limits on disparities in benefits between HCEs and NHCEs. The goal of the nondiscrimination requirements is to encourage expanded coverage and greater distribution of benefits between the highly paid and workers at lower earnings levels. Since that time, several actions have significantly reduced GAO's FY 2013 appropriation from $511.3 million in FY 2012 to $479.5 million in FY 2013, including 1) a reduction of $5 million imposed in the final CR resulting in an enacted level of $506.3 million, and 2) the $25.7 million sequester and $1 million rescission required by the Budget Control Act--a total reduction of $31.7 million or 6.2 percent below FY 2012."

Since October 2001, the United States has provided Pakistan with over $10 billion for military, economic, and development activities in support of the critical U.S. national security goals of destroying terrorist threats and closing terrorist safe havens. This process includes annually issuing detailed instructions, consulting and assessing information from multiple sources, and collaboratively and iteratively drafting and reviewing the reports. State issues instructions for preparing the country reports each year, outlining a consistent structure and describing, for example, the topics that should be included in each subsection. The instructions also, among other things, indicate that the country reports should build on the previous year’s reports and specify guidelines for new and updated content. In addition, the instructions state that staff preparing the country reports are to use and assess multiple sources, including host governments, local and international human NGOs, labor unions, and host country media as well as classified information. Correspondence issued by the Government Accountability Office with an abstract that begins "Today, GAO issued a correspondence identifying the internal controls that the National Aeronautics and Space Administration (NASA) has in place for reimbursable Space Act agreements and assessing to what extent the agency is adhering to those controls. Specifically, our review focused on NASA's internal controls related to (1) fair reimbursement from agreement partners; (2) interference between agreement partners' work and NASA's use of its facilities; and (3) alignment of agreement partners' work with NASA's mission. In that correspondence, we reported that NASA was generally adhering to its controls for entering into reimbursable Space Act agreements. In our review, however, we also found several instances in which agreements were not completely and accurately recorded in the Space Act Agreement Maker (SAAM) database. In addition, we identified one instance where NASA awarded a reimbursable agreement when similar services may have been available in the private sector. This action appears contrary to the National Space Policy and may have also been contrary to the Commercial Space Competitiveness Act. One condition that is examined in VA-funded research is post-traumatic stress disorder (PTSD), an anxiety disorder that can occur after a person is exposed to a life-threatening event. According to VA, experts estimate that up to 30 percent of Vietnam veterans and up to 20 percent of Operation Enduring Freedom veterans and Operation Iraqi Freedom veterans have experienced PTSD. Veterans suffering from PTSD may experience problems sleeping, maintaining relationships, and returning to their previous civilian lives. Additionally, studies have shown that many veterans suffering from PTSD are more likely to be diagnosed with cardiovascular disease and other diseases. After the Vietnam War, Congress wanted information about the psychological effects of the war on Vietnam veterans to inform the need for PTSD services at VA.
